AN ORDINANCE ORDERING THE REMOVAL, RAZING AL®/OR REMODELING OF CERTAIN BUILDINGS ,
HOUSES , AND OTHER STRUCTURES IN THE CITY OF FAYETTEVILLE, ARKANSAS, - AND FOR OTHER
PURPOSES
SEAS , in many part& of the City of Fayetteville, Arkansas , owners .of real e
estate have allowed certain buildings and/or structures situated thereon to become
run down, dilapidated, unsafe, unsightly; dangerous , obnoxious, unsanitary, and
detrimental to the public welfare of the citizens of the City . of Fayetteville, and
WHEREAS, the oondition of such buildings and/or structures constitute a serious
fire hazard and unless immediate action is taken to remedy this situation, there is
a great likelihood that the surrounding property will be destroyed by fire originating
in suoh •unsafe and hazardous structures .
NCO THEREFORE BE IT ORDAINED BY THE CITY COIINCIL OF THE CITY_OF FAYETT_EVILLE, '
ARKANSAS :
Section 1. That-the owner or , owners of the following described real sets
be and they are hereby ordered to remodel, remove or raze the dilapidated buildings,
and/or structures now standing upon said real estate within thirty (30 ) days from
the date of service of a copy of this ordinance upon said owner or owners to- wit :
Tract No. 1 '
Nest part of Lot 40 County . Court Plat Sal* Section 15 Township 16 North
Range 30 West, beginning at the NU corner of said lot, and running,
thence East 1011 feet more or less to NES corner of lot deeded to City
of Fayetteville, Arkansas , by Jacob and Nancy Swigger; thence South
with West line of last mentioned lot 58 feet, more or . less , to North
line of Huntsville Road; thence Northwesterly with North line of said
road to the beginning point .

Part of the SE} of . the SEJ of Section 17 Township 16 North, Range 30
West, described as : Beginning at a point on North line of U. S . Highway
No. 62 which is 209 feet East .and 299 feet- North of the SO corner of
said forty acre tract, and running, thenoe North 225 feet ; thence Eget
150 feet; thence South 225 feet, more or less, to North line of highway=
thence West 150 feet to beginning point .

Section 2 . The Chief of the Fire Department is hereby authorized and instructed
to serve the owner or owners of each of said above described tracts of real estate ,
with a copy of ttiie ordinance and notify said owner or owners that the respective '
dilapidated buildings and/or structures now standing thereon must either be torn -
down and removed or. remodeled in accordance with applicable buildingand zoning
ordinances of the City of Fayetteville, Arkansas , within thirty (30days from date
of service of a certified copy of this ordinance upon said owner or ownerd•
Section 3 . In the event the owner .or owners of any of said real estate cannot b
be located, the Chief of the Fire Department is, instructed to serve notice by
posting a oopy of this . ordinance on the front floor - or 'exterior wall of each of
said buildings and to mail, a certified oopy_ of same by registered mall to said
owner or owners last known address and report such action to the Fire Committee
of the City Council. `

Section 4. All persons, firms , oorporatioas •violating the temps and pro-
visions of this ordinance shall upon conviction thereof be fined in any sum not
leas than .Twenty-Five Dollars ($26 .00 ), nor. more than Three Hundred (0500.00 )
Dollars .
Section 5 . The City Attorney is hereby ; direotedto, iaatitute such legal ,.
proceedings against suoh. persons as may be ,neoeasary iri order to enforce the
provisions of this ordinanoe , ' and -to remedy the dangerous, unsanitary, and
unsightly conditions brought ebout' .as.. a result of _the failure of 'the owner to ,
properly keep up said real estate . = '
Section 6 . Because the dilapidated buildings and/or 'structures situated upon
the real estate heretofore described causes a constant fire hazard and menace to
the public peace , health and eafetyj and because this hazard and the condition of
the nuisance created by such properties should be removed and abated at once, an
emergency is hereby declared to exist, and' this ordinance is found to be neoessary
for the preservation of the public peaoe , health and safety, and the an shall be
in full - force and effect from and after its ,passage and approvals
