AN ORDINANCE APPROPRIATING $69000900 �FROM THE UNAPPROPRIATED SURPLUS OF THE
GENERAL FUND AND $500. 00 MONTHLY FROM GENERAL REVENUES FOR THE PURPOSE OF
PROVIDING FUNDS FOR THE PLANNING, DESIGNING , LOCATING, ACQUIRING, CONSTRUCTING,
ALTERING, USING, MAINTAINING, LEASING AND OPERATING OF OFF STREET PARKING
FACILITIES WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTHVlLLE, ARKANSAS,
AND FOR OTHER PURPOSES* .
WHEREAS, on February 22, 19549 a petition of 168 resident citizens of the
City of Fayetteville, Arkansas , was duly presented to the Fayetteville City
Council and filed in the office of the City Clerk, and
WHEREAS, said petition requested that the City Council take appropriate
action to provide off street parking facilities within the corporate limits
of the City of Fayetteville,
NO14, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTE-
VILLE, ARKANSAS : .
Section 1. That there is hereby appropriated out . of the unappropriated
surplus of the General Fund of the City of Fayetteville, Arkansas, the sum of
Six Thousand Dollars ( $6,000.00) to be credited to 4 which is
hereby designated as the "Off Street Parking Fundq for the purpose of providing
funds for the planning, designing, locating, acquiring, constructing, altering,
using, maintaining , leasing and operating of off street parking facilities
within the corporate limits of the City of Fayetteville, Arkansas .
Section 2 . That each and every month from and after the passage. and approval
of this ordinance until termbatsd by appropriate action of the City Council, there
shall be appropriated from the general revenue funds of the City of Fayetteville,
the sum of Five Hundred Dollars ( $500. 00 ) ' per month which shall also be credited
to the "Off Street Parking Fund" . for the . purposes set forth in Section 1 hereof.
Section 3 . That the City Council_ may at any ',time hereafter direct . the deposit
of the funds credited to the "Off Street Parking :Fund" , as a general deposit in
any bank or banks of this City, either in a checking or savings account; or the
in7estment .of said funds in bonds which are the direct obligations of or the
principal and income of which are unconditionally guaranteed by the United States
of America .
Section 6 That all revenues and expenditures from the "Off Street Parking
Fund" shall be accounted for independently of other funds.
Section 5. That the appropriations hereinabove authorized shall not be
diverted by the City Council except in the event of emergency. For the purposes
of this section "emergency" shall be defined as a sudden, unexpected and unfore-
seen condition or occurrence in municipal affairs of such public gravity and exi-
gency as to require forthwith municipal action, and does not mean expediency,
convenience, or best interests.
Section 6. That this ordinance shall be in force and effect from and after
its passage, approval- and publication, and all ordinances and parts of ordinances
