AN ORDINANCE TO ABANDON THE NORTH EIGHTY 060 ) FEET OF A CERTAIT ALINT TEA
( 10 ) FEET RIDE WHICH RUNS NORTH AND SOUTH PARALLn TO ST . CHARLES AVENUE
AND 111. 8 FFET WEST THEREOF FROM BOLES STREET TO WATSON STREET, IN WATSON
PLACE ADDITION. CITY OF FAYFTT-MLLE , ARKANSAS .
WHEREAS , a petition was duly filed with the City Council of the City of
Fayetteville, Arkansas , on the 2/s,iday of f.« ,. . 1683, asking
that said City Council vacate North eighty rest of a certain alley
ten ( 10) feet wide which rune north and south parallel to St. Charles Avenue
and 111 . 8 feet west thereof from Boles Street to Watson Street, in Watson
Place Addition, City of Fayetteville, Arkansas , and
ZMREAS , the abutting lots affected are Lots One ( 1 ) and Thirteen ( 13 ) , in
Watson Place Addition, of the City of Fayetteville , Arkansas, "
WHEREAS , after due notice as required by law, the City Council has , at the
time and place mentioned in the notice, heard all persons desiring to be heard
on the question and has ascertained thet the portion of the alley hereinabove
described was heretofore dedicated to the public use as an alleys that the portion of
said alley never has been opened and that the public interest and welfare will
not be adversely affected by the abandoiment of the portion of said alley.
NCR, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYFTTEVILLEt
Section 1 . The City of Fayetteville, Arkansas, hereby relesses , vaoates
and abandons all its rights , together with the rights of the public generally,
in and to that portion of the alley described as the north eighty (80) feet
of a certain alley ten ( 10) feet aide -:hioh runs north and south parallel to
3t . Charles Avenue and 111 . 8 feet west thereof from Boles Street to Antson
Street, in 'Matson Place Addition. City of "a ;Ttteville, Arksness , reserving
unto said City of Fayetteville, Arkansas , its successors and assigns an ease-
ment or right of may on, over , under and across the portion of said alley de-
scribed herein to be vacated, for the purpose of constructing, installing, lar
ing and relaying, relocating and w.aintaining all public utilities now located
or which vtay hereafter be located upon said vacated portion of said alley by
said City of Fayetteville or any corporation laving a franchise or right of
way from said City.
Section E . A copy of this Ordinance duly certified by the Ulty Clark
shall be filed in the office of the Recorder of said Cou:.%- affil recorded in
the deed records of said county.
Section 3 . This Ordinance shall take effect and be in force and effect
from and after its passage.
