AN ORDINANCE TO ABANDON A PORTION OF HI0ILAND AVENUE IN THE CITY OF
FAYETTEVILLE , ARKANSAS , LYING BETWEEN PROSPECT STREET AND THE SOUTH
LINE OF 3LOCK 18, A . L .T RENTIS REVISED PLAT OF CITY PARK ADD= ION OF THE
CITY OF FAYETTEVILLE , ARKANSAS .
WHEREAS , a petition was duly filed with the City Council of the
City of Fayetteville , Ar4ansas , on the 3rd day of August219530asking that
said City Council vacate and abandon all that portion of Highland . Avenue
lying between Prospect Street and the South Line of Block 18 , A . L . Trent ' s
Revised Plat of City Park Addition to the City of Fayetteville .. Arkansas ,
and
71?TrJ- EAS , the, abutting lots affected are Lots 4 ( except the east 10
-
feet ) , 5 , and the East 10 feet of Lot 6 , in Block 18 , A . L .Trent ' s Revised
Plat of City Park Addiction to the City of Fayetteville , Arkansas , having
been heretofore duly accepted by the Fayetteville City Council , and
IIEREASpLot 5 , Park Village Addition to the City of Fayetteville ,
was included in the petition ( which petition was signed by Oliver Lollar ) ,
but the City Council has found this lot does not abutt on said portion
of Highland Avenue , and
','i_E SEAS , after due notice as required by law, the City Council has
at the time and place mentlibned in the notice , heard all persons de4�ring
to be heard on the a_uestion and has ascertained that the portion of ,

Avenue hereinbefore described was heretofore dedicated to the public use
as a street ; that the described portion of said Avenue neveP has been._ opened
and that the public interest and welfare will not be adversely affected
by the abandonment of said Avenue ..
NOW2T17REFORE , BE IT ORDAINED BY THE CITY COUNCIL :
SEC1ION '1 . The City of Fayetteville , Arkansas hereby releases , variates
and abandon all of its right s , together with the rights of. the public `
generally, in and to _ that portion of Highland Avenue lying between Pros-
pect Street and the South Line of Block 18 , A . L . Trentfs Ievised Plat of
City Park Additioh of the City of Fayetteville , Arkansas , subject to exist -
ing facilities as same are now located.
SECT ION 2 . A copy of this Ordinance duly certified by the City Clerk
shall be filed in the 0 -Tice of the Recorder of said County and recorded in
the deed records of said County.
SFCTION 3 . This ' Ordinance shall take effect and be in force from
and after its passage .
