AN ORDINANCE AMENDING ORDINANCE N0 . 1013 OF
THE CITY OF FAYETTEVILLE, ARKANSAS : AND
DECLARING AN EMERGENCY.
YIEREAS, the City of Fayetteville , Arkansas, acting. by and through its
City Council; has considered and determined that there is need for improvement
and extension to the municipal sewer system, and this requires the issuance
of additional revenue bonds, and in order to pay the principal and interest

of the proposed bond issue of approximately $ 9it is necessary for the
Council to establish minimum rates to be charged- for the services to be rendered '
by the sewer ;
NOW, THELREFCRE, . BE IT ORDAINED by the City Council of the City of Fayette-
ville, Arkansas :
SECTION 1. That Section 2 of Ordinance No ._ 1013 , passed and approved on
the 17th day of December, . 1951 be and the same is hereby' amended to read as
follows : .,
"SECTION 2 : Sewage Service Charges : , There is hereby fixed and established
charges for the use of the Sanitary Sewage System, said' cnarges to be based upon
the amount of water used per month , with necessary adjustments as hereinafter
provided for . The monthly rates shall be as follows :
"For the first 3, 000 gallons or less, a
minimum monthly charge of $ 0 . 75
For the next 2, 000 gallons 0. 22 per M
For the next 20, 000 gallons 0. 16 per M
For the next 75 , 000 gallons 0 . 12 per M.
For the next 400, 000 gallons 0 . 08 per M
And all over 500, 000 gallons 0. 06 per M
"PROVIDED, that those properties which are to be served by the extension
of the sewer system to be financed by the issuance of bonds as hereinabove set
forth will pay $1. 00 per month in addition to the schedule of charges hereinabove
set forth , so that the minimum monthly charge for each user of the - Bystem to be
served by the extensions herein contemplated shall be $1 . 75 per' month:
" ( a) All users shall be . classedas either domestic or commercial, depending
upon whether or not the water consumption of the individual user is used for
domestic or commercial purposes . For the purpose of definition, all users other
than residences shall be classed as commercial .
" ( b) Where a user has both residential and commercial users on the same
meter , the usage shall be classed . as commercial usage for the purpose of computirg
bills .

" ( c ) In the case of domestic ,users, the monthly- sewage service incurred
for any month shall be based upon the average water usage for the previous months
. of November, December, January , February, March and April . Said charges shall be
computed for a twelve-months' period beginning with the billing for the month of
June, said uniform rate shall be charged for the following twelve months ' period,
at the end of which time new rates shall be computed. Where residential users have
established a monthly sewage service, rate as set out above and moves to a new for
cation the same sewage service rate as established shall apply at the new location
in the case the general household conditions are the same . Sewage service rates
for the ' new residential users shall be based upon monthly water usage . until such
• times as their rates have been established by the usage of water for the months
heretofore specified ,
" ( d) In the case of commercial users, the monthly sewage service charge
shall be determined by applying the rate schedule to each monthly water bill
throughout the year .
" ( 0 ) Where a user of the Sanitary Sewage System utilizes water other than
residential use so that such water does not enter the Sanitary Sewage System,
rates as herein fixed shall be charged . only on sewage- entering tYie system.
° ( f) In the case. of users of the Sanitary Sewage System where water is
obtained from sources other than the City Water Department , the City will
determine the amount of the water entering 'the Sanitary Sewage System, which shall .
be subject to the rate . as set out above , "
SECTION 2" In all other respects Ordinance No . 1013 shall remain in full
force and effect , - e
SECTION 3 , It is hereby ascertained and, declared that the urgent need for
additional sewer lines and outfall sewers 'endangers the health and safety of the
inhabitants of the City of Fayetteville, and therefore ' an emergency exists and
this ordinance, - being necessary for the immediate preservation of the public
peace, health and safety; shall take effect and- be in force from "and after its
passage.
