AN ORDINANCE TO ABANDON A PORTION OF YEATER AVENUE IN THE CITY OF, FAYETTEVILLE,
ARKANSASy LYING BETWEEN EAST DICKSON STREET AND EAST LAFAYETTE STREET .
MEREAS, a petition was dWy filed with the City Council of the City of
Fayetteville . Arkansas, on the �/o .`• day of /Yo , 1952, asking
that . said City Council•' vacate arca abandon a11I� ofTeater Avenue
lying between East Dickson Street and East Lafayette Street; and
WHEREAS, 'the abutting lots affected are Lots 2 and 3 of Block Eleven ( 11 )
in the. Masonic Addition to the City of Fayetteville, Arkansans which now have
become Lots 1, 22 3 , 4s 5, '6, and . 7 in Block 1, and Lots 1, 2, 3s 4s 5s 6 and 7
in Block 2, of McIlroy ' s Addition to the City of Fayetteville, Arkansas, having
been heretofore duly accepted by the Fayetteville City Council; and
a
WHEREAS, after due notice as required by law, the City Council has at the
time and place mentioned in the notice heard all persons desiring to be heard
-.on the_question- and has ascertained that the portion of the Street hereinabove
described was heretofore dedicated to the public use as a street; that the de-
scribed portion of said street never has been opened and that the public
interest and welfare will not be adversely affected by the abandonment of said
street;
NOW, THEREFORE; BE `IT OEDAINED BY THE CITY COUNCIL OF-THE CITY OF FAYETTE-
VILLE :
Section 1. The City of Fayetteville, Arkansas, hereby releases, vacates
and abandons all �its rights, together with the rights of the public generally,
in "and to - that portion of Yeater Avenue, lying between East Dickson Street and
Fast Lafayette Street, " r'eservi.ng unto said City of Fayetteville an easement
over and across the above described street for construction and maintenance of
public utilitylines .
Section 2 . A copy of this ordinance duly certified by the City Clerk
shall be filed in the office of the Recorder of said County and recorded in
the deed records of said county.
Section 3 . Thi's Ordinance shall take effect and be in force from and
after its passage . "
