in 7ashinJton County, Arkansas , and is bounded on the east by the west 50 feet of Lots 1 ,
2 and 3 of Block 22 ovmed by Gene Price and wife , Phyllis Price and by the west 50 feet of
Lots 4, 5 and 6 of Block No. 22 owned by Otto Gage and wife Joy Lee Cage , and is bounded
on the west by Block No . 23 , ovmed by Frank N . Hinkle and wife, Virginia L . Hinkle , and by
Mock No* 24' ormod by -Fred arid wife'. Josephine M. Brown, all'in said Cynter Addi-
tion ao the- City of _Fayetteville9 ' Arkansas , whe presented to -this City Council a petition
.praying that said alley be abandoned and vacated;
VIHEOLEAS, the City Council by resolution directed the City Clerk to give notice as provided
by Section 3 of Act Ab . 17 of the Acts of Arkansas , 1945 ; Arkansas Statutes , 19471 Sep ,
19-3826, of the hearing of said petition and the said Clerk gave notice as provided by ,
said law,
F7HEREAS the aforesaid alley has not been actually used by the public generally for a
period of at least five _ ( 5 ) years subsequent to the filing of said plat of Gunter Addi-
tion to the City of Fayetteville , Arkansas ,
W101LAS hearing has been duly had upon said petition before the City Council as provided
by law, and it has been determined by the, city. Council that the property included within
the alley above described should be abandoned as an alley and said alley should be closed;
that all abutting property c niers and persons directly interested , have consented to the
said petitioneners ,abandonment said alley and no one has. appeared to oppose , the granting of the prayer of

Arkansas , that the alley 20 feet in width extending from - Johnson Street on the south to
Rebecca . Street on the north, which .alley separates Block No . 22 from Blocks No . 23 and 24
in .Gunter A.:iditicn to the said City of Fayetteville , . in Washington County, Arkansas , and
is bounded on the east by the west line of the west 50 feet of Lots 1 , 2 and 3 of Block
No . 22 ovmed by Gene Price and wife , Phyllis Price , and by the west lane of the west 50
feet of Lots 4, 5 and 6 of said Block No. 22, owned by Otto Cage and wife , Joy Lee Gage ,
and is bounded on tthe west by the east line of Block No. 23 owned by Frank Ne Hinkle and
wrife , Virginia L. Hinkle , and by the east line of Block No , 24 owned by Fred I . Brown and
wife , Josephone tri. Brown ; that the property inclWed vdthin said alley be abandoned as an
alley and ihat 'said alley be closed; that the property within said alley to the center
line thereof shall vest in the owners of the adjoining real estate as provided in said .
law, reserving unto said City an easement over and across the above described alleyway
for construction and maintenance of public utility lines,
