HomeMy WebLinkAboutOrdinance 1022 ' ORDIITANCE NO , 1022 AN ORDINANCE REGULATING AND FIXING FARES OR TARIFFS TO BE CHARGED BY UNI- VERSITY CITY TRANSIT COMPANY, INC . , A PUBLIC CARRIER OF PASSENGERS IN THE CITY OF FAYETTEVILLE, ARKANSAS , AND 17ITHIN A FIVE (5 ) )m RADIUS BEYOND THE ODRPO- RATE LIT TS , PRESCRIBING PENALITES, AND FOR OTHER PURPOSES . VWHEREAS , the University . City Transit Company, Inc . , is the - only bus company engaged in' the transportation of passengers in the City of Fayetteville , Arkansas and within a five ( 5 ) mile radius beyond the ccVorate limits of said city . MIEREAS , incre_ased ' costs of operation of bus lines in the City of Fayette- ville, Arkansas, as compared to rider volume , has not ' given the owners of the University City Transit ComparWj Inc . -a fair return on their investment . WHEREAS , the City Council of the City of Fayetteville, Arkansas , has made a careful study of rates and fares to be charged by bus lines in the City of Fayetteville, Arkansas , and finds that .the rates and tariffs hereifter' set forth will give the public reasonable fares with a fair return to the bus line owners . NOW THEREFORE, BE IT ORDAINED By the City Council of the City of Fayetteville, Arkansas : SECTION I . ' That the following schedule of bus fares in the City ' of Fayette- ville, Arkansas, and within a £ive, ( 5 ) mile radius beyond the corporate limits of said City are hereby fixed as follows :-- Adult fare, fifteen cents ( 150 ) , with reduction of fare to 1220 per ride for those wishing to purchase tickets giving them- twelve rides for $1. 50, if used within thirty days from date of purchase . Fare for children under twelve years of age tep . cents ( 100 ) , or twelve rides .for $1.00, if, they purchase 30-day tickets Highschool students shall ride for the -same fare as children under 12 years of age between the hours 6f ,7 :00 a . m. and 5 : 00 p .m. Mon- day through Friday during the school year .' Riders 'above the 'age of 12 in the zone ' between ' Purdyl's Market and the -toTin of Greenland on Higlrvay'71 South"shall' be ' charged 150 , which will be in addition to the 15-cent fare charged for rides between Purdy ' s store and sections. o£ the City of 'Fayetteville . Children under twelve years of age riding in the Greenland zone shall be charged ten cents , but shall- not- be charged an extra fare when riding into or out of the city zone, this same rule applying to high school students only on school days between the hours 7 : 00 a .m. and 5 : 00 p .m. No charge shall be made . for transfers , although the University City Transit Company, Inc . , _ is hereby grantedthe right to refuse them in cases where riders may be served by more direct routes , or where two separate routes cover approximately the same territory for a consi- derable portion of their length . No fare books or tickets shall be sold at reduced rates, except as provided in Section One ( I ) 'above; and ' if arty ' unused -book or tickets are outstanding at the time this Ordinance becomes effec- tive, they shall not entitle the holder to passage ' in any bus, but shall be re- deemed by the issuing company for the unused portion Idre. %1;& 0i /acfw- . I%d & , G %30 SECTION' III . The ' a1qove schedule of fares shall become effective at N o ' clock a .m. , Saturday, May 102 1952 : SECTION IV . Any person, firm or corporation violating the terms of any section or part of section of this Ordinance shall be deemed guilty of a misde- meanor and upon conviction thereof shall be fined in any sum not less than ten dollars ( $.10 . 00 ) nor more than one hundred dollars ( "$100 . 00 ) and each violation shall be deemed a separate offense . SECTION V . If any person, firm ' or corporation now operating under a certi- fixate or under Grandfather Rights in lieu of a certificate , issued or waived by the City of Fayetteville, Arkansas , as the ' case may be, - shall knowing permit any employee to violate the terms of this Ordinance; such operator shall be guilty of a misdemeanor and shall be punished by ' a fine of not less than ' fifty dollars - ( $50 ) . nor more than five hundred dollars ( 0500 . 00 ) ; and each violation of an employee ' of which the employer knows shall be a separate offense; and iii- addition thereto 'the City Council of the City of Fayetteville, Arkansas , may revoke the permit ' un- der which such passenger carrier is operating and may take such steps as necessary to prohibit further operations . SECTION VI . All Ordinances or parts 'of Ordinances in' conflict herewith_are_ hereby repealed; and it appearing that fixing-- of fares ' is - im<nediately required, an- emergency riemergency is hereby declared to exist and 'this Ordinance shall be in full force and effect from and after its passage and approval .
