WHEREAS , a petition was duly filed with . the City Council of the City of Fayetteville , Arkansas on the eighth day of January, 1951 , asking the City Council to va 'mate and abandon all that portion of the street designated on the plat of the Archias-Bushnell Addition to the said City, now appearing on record in plat book, volume 1 at page 15 thereof in the office of the Circuit Clerk and Ex-officio Recorder for Washington County, Arkansas . WHEREAS , after due notices as required by law, the Council has at the time and place mentioned in the notice , heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has heretofore been dedicated to the public use as a street herein described ; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat ; that all owners of the property abutting upon the portion of the street to be vacated have filed with the City Council their written consent to such abandonment and that public interest and welfare will not be adversely affected by the aban- donment of such street. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . The City of Fayetteville, Arkansas hereby releases , vacates , and abandons all its rights , together with the rights of the public generally, in and to the street designated as follows : That section of Loretta Street lying between Whitham and Bushnell Streets as same appears on the recorded plat of Archias-Bushnell Addition to the City of Fayetteville , Arkansas . Section 2 . A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of the County. Section 3 . This ordinance shall take effect and be in force from and after its passage . PASSED and APPROVED this 9th day of April , 1951.
