HomeMy WebLinkAboutOrdinance 992 ORDINANCE ' .;Z� AN ORDINANCE TO ABANDON A PORTION OF HIGHLAND AVENUE IN THE CITY OF FAYETTE* VILLE, ARKANSAS LYING BETWEEN LOUISE STREET AND TRENTON BOULEVARD . WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas on February 26, 1951, asking that said City Council vacate and abandon all that portion of Highland Avenue lying between Louise Street and Trenton Boulevard, and WHEREAS, the abutting lots affected are Lots 7 and 91 Block 14, and Lots 1 and 8 . Block 15 of A . L. Trent ' s Revised Plat of City Park Addition to the City of Fayetteville Arkansas, which now have become Lots 5, 62 7, and 8 . Block 14, and Lots 1; 2; ll, 12 and 13 , Block 15 of the Replat of Blocks 14 and 15 , A . L. Trent ' s Revised Plat of the City Park Addition to the City of Fayetteville, Arkansas, having been heretofore duly accepted by the Fayetteville City Council, and WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the notice , heard all persons desiring to be heard on the question and has ascertained that the portion of the street hereinbefore described was heretofore dedicated to the public use as a street; that the described portion of said _street never has' been opened and that ' in fact this portion of the stl;eet as originally platted 'would have- had to run down a steep hill side and that it would be for the general welfare and benefit of the City for the described portion of said street to be abandoned; that all owners of the property abutting upon the portion of the street to be vacated have filed with the City Council their written consent to such abandonment; and that pub- lic interest and welfare will not be adversely affected by abandonment of the street, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1. The City of Fayetteville, Arkansas hereby releases, vacates and abandons all its rights , together with the rights of the piblic generally, in and to that portion of Highland Avenue lying between Louise Street and Trenton Boulevard , reserving unto said City of Fayetteville a right-of-way over and across said lots for construction ane maintenance of all public utilities situated thereon. Section 2 . A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of said County and recorded inthe deed records of said County . Section 3 .
