AN ORDINANCE VACATING THAT PORTION OF WILLOW AVENUE LYING BETWEEN BLOCKS
ONE ( 1) AND TWO ( 2) IN EVELYN HILLS, AN ADDITION TO THE CITY OF FAYETTEVILLE0
ARKANSAS, SAND FOR OTHER PURPOSES :
WHEREAS, a petition was duly filed with the City Council of the City
of Fayetteville, Arkansas on the 2 4*day of June, 1950 asking the City
Council to vacate and abandon all that portion of Willow Street lying
between Blocks One and Two in Evelyn Hille , an addition to the City of
Fayetteville, Arkansas as designated on the plat of said addition now
appearing of record in the plat book, page ZTthereof in the office
of the Recorder of Washington Country, Arkansas .
WHEREAS, after due - notice as required by law, the Council has at
the time and place mentioned in the notice, heard all persons desiring
to be heard on the question and has ascertained that the portion of the
Street above described has heretofore been dedicated to the public use as
a street ; has not been actually used by the public generally for a period
of at least five years subsequent to the filing of the plat, that all the
owners of the property abutting on the portion of the street to be vacated
have filed with the Council their written consent to such abandorment ; and
that public interest and welfare will not be adversely affected by the
abandonment of such street .
NOWO TEEREFCRE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTTEVILLE, ARKANSAS :
Section 1 . The City of Fayetteville, Arkansas hereby releases, vacates
and abandons all its rights , together with the rights of the public generally,
in and to the street designated as follows :
All that portion of Willow Avenue lying between Blocks One ( 1)
and Two ( 2) in Evelyn Hills, an addition to the City of Fayette-
ville, Arkansas, plat of which addition is recorded in the plat
book at page 2S thereof, in the office of the Circuit Clerk and
Ex-Officio Recorder of Washington County, Arkansas .
Section 2. A copy of this ordinance, duly certified by the City Clerk,
shall be filed in the Office of the Recorder of Washington County, and
recorded in the deed records of said County.
Section 3. This ordinance shall take effect and be in full force and
effect from and after its passage.
