REGULATE SALES AT PUBLIC AUCTION OF UEWEIRY,
WATCHES , CLACKS , AND .SILVERWARE WITHIN THE CITY
OF FAYETTEVILLE ; AND FOR OTHER PURPOSES .
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1. That hereafter any person, firm or corporation selling or
offering for sale jewelry, watches , clocks, and silverware at public auction
within the corporate limits of Fayetteville , Arkansas , shall be required to
obtain a permit therefor before conducting such sale .
SECTION 2 . Application for said permit shall be made to the City
Council of the City of Fayetteville by such person , firm or corporation in person
or by their legal representatives or agents at least ten days prior to the date
such sale is to be held. Said application shall be accompanied by a fee of $2 .50
to cover the cost of the investigation hereafter provided for and the issuance of
a permit for such sale .
SECTION 3 . Upon .receipt of such application, the city council itself,
or through its duly authorized representatives, shall investigate the proposed
auction including thefinancial condition of the person, firm or corporation pro-
posing to conduct said auction and shall file a report thereof with said city
council. Such report shall be open to the public for inspection .
SECTION 4 . The city council may, as a result of such investigation,
issue or decline to issue a permit to such person, firm or corporation to conduct
such auction.
SECTION 5 . If such permit is granted it shall clearly sett forth the
date of such auction on the face thereof, and the application for such permit
provided for in Section 1 of this ordinance shall likewise clearly set forth the
date of the proposed sale at auction.
SECTION 6 . It is the intent of this ordinance that the provisions
hereof shall not apply to public or private auctions conducted under the orders
of any court, or administrators or executors sales , or sales at locations commonly
referred to as " sales barns" or " sales pavilions ." Such ordinance , however , is
expressly designed to include jewelry stores or places where jewelry, watches ,
clocks , and silverware is kept or stored for sale to the public .
SECTION 7 . The conducting of a public auction in violation of this
ordinance and without a permit being granted is hereby declared to be a misde-
meanor and shall be punishable upon conviction by a fine of not less than $25 .00

nor more than $100 . 00 , or by imprisonment in the city jail for not less than 10
days nor more than 30 days , or by both such fine and imprisonment.
SECTION 8 . 19REREAS it is ascertained that the sale of jewelry, watches ,
clocks , and silverware at unlicensed and unsupervised public auction is liable
to be accompanied by gross abuse to the detriment of the general public , and
19NEREAS this ordinance is necessary for the protection of the public
peace , health and safety of the citizens of Fayetteville , Arkansas , an emergency
is hereby declared and the provisions of this ordinance shall be in full force
and effect from and after its passage , approval and publication .
