AN ORDINANCE AUTHORIZING FXKNG AND BOATING ON THE CITY RESERVOIR ON CLEAR CREEK PROVIDING FOR THE PROMULGATION OF RULES AND REGULATIONS , AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section One. Subject to the rules and regulations to be adopted in the manner hereinafter set forth , it shall be lawful to fish in the City reservoir on Clear Creek in Washington County, Arkansas , and to operate boats on said Lake. Section Two. Fishing and boating on said lake shall be permitted at the times and in the manner hereafter authorised by motion or resolution of the City Council of the City of Fayetteville, Arkansas , having due regard for the rules and regulations of the Board of Health of the State of Arkansas and of the recommendations of the Arkansas State Game and Fish Commission. Section Three. The City of Fayetteville shall from time to time by resolution or motion pmmu]gateall necessary rules and regulations in connection with the use of said Lake for boating and fishing and all necessary rules and regulations with respect to the time fish may be taken and the types of boats which may be used on said lake, and limitation on power of motors to be used on such boats , and to provide such other rules and regulations in connection with boating and fishing activities on said Lake as may from time to time be desirable, including the fixing of permit fees and such other matters and things as the City of Fayetteville may deem advisable and proper. Section Four. It appearing that the Clear Creek reservoir is rapidly filling and that the• Arkansas State Game and Fish Commission has already begun the stocking of said reservoir with fish, and that recommendations may be made by the Arkansas State Game and Fish Commission within the near future with respect to the opening of said reservoir to fishing, and it further appearing that adequate safeguards should be provided to prevent pollution of the reservoir as a water supply, and this Ordinance being necessary for the public health , peace and safety, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval .
