AN ORDINANCE ENTITLED: AN ORDINANCE TO CLOSE AND VACATE FIVE FEET ON EACH
SIDE OF N . POLLARD ST . BETWEEN Be PROSPECT ST . AND Be CLEBIIRN STe , RMSERVING
A RIGHT#01?-WAY FOR SIDEWALK ON THE WEST FIVE ( 5 ) FEHP , AND FOR OTHER PURPOSES .
Whereas , a petition was duly filed with the City Council of the City of
Fayetteville , Arkansas , on the 3rd day of January , 1950 , asking the city coun-
cil to vacate and abandon all that portion of the street designated on the plat
of A.L. Trent • s Revised Plat of City Park Addition to said city , now appearing
of record in Plat Book at Page 125 in the office of the Recorder of Washington
County , as North College Extension ( re-named North Pollard ) comprising the
Bast five feet of said Street and the West five feet of said Street beginning
at East Prospect Avenue and ending at East C leburn Street.
Whereas , after due notices as required by law , the council has , at the
'time and place mentioned in the notices heard all persons desiring to be heard
ba.•the question and has ascertained that the portion of street as hereinbefore
described has heretofore been dedicated to the public use as a street herein
described ; that the portion sought to be vacated has not been actually used by
the public generally for a period of at least five years subsequent to the filing
of the plat ; that all the owners of the property abutting upon the portion of
the street to be vacated have filed with the Council their written consent to
such abandonment ; and that public interest and welfare will not be adversely
affected by the abandonment of said portion of street.
Now, therefore , be it ordained by the City Council of the City of Fay-
etteville , Arkansass
Section 1. The Gity of Fayetteville , Arkansas , hereby releases , vacates
and abandons all its rights , together with the rights of the public generally ,
in and to the portion of street designated as follows :
A strip five ( 5 ) feet wide off the East side and a strip five ( 5 ) feet
wide off the West side of Pollard Avenue ( originally platted as North
College Extension ) between East Prospect Avenue and East Cleburn Street
( ct .gdnally platted as Garland Avee ) , so that Pollard Mrset between
Bast Prospect and Bast Cleburn Streets shall be forty feet in width in-
stead of fifty feet as platted in Plat Book Page 125 in the Office of
Circuit Clerk of Washington County , Arkansas , with a right-of-way reserved
by the City of Fayetteville , Arkana&a , for sidewalk on the West five ( 5 )
feet above described.
Section 2. A copy of this. ordinance duly certified by the City C lark
shall be filed in the office of the recorder of the county and recorded in the
deed records of this county. The absolute ownership of said abandoned portions
of street shall vest as follows: the strip lying along the Beat side of said
street shall vest in the owners of the real estate abutting on the Bast side
of said street , and the strip 3ying along the West aide of said street shall
vest in the owners of the real estate abetting on the West side of said street*
Section 3. This ordinance shall take effect and be in force from and after
its passage.
Passed and approved this 30th day of January, 1950 .
