AN ORDINANCE VACATING A PORTION OF AN ALLEY IN FULBRIGHT ' S REVISED PLAT
OF THE NORTH FIFTY FEET OF LOT EIGHT AND ALL OF LOT TEN, BLOCK B AND ALL
OF BLOCK - C OF LEVERETT ' S SECOND ADDITION TO THE CITY OF FAYETTEVILLE,
ARKANSAS AND OTHER PURPOSES ,
WHEREAS, a petition was duly fled with the City Council of the City
of Fayetteville, Aj :j....zbs on the la day of , 1949 ,
asking the City Council to vacate and abandon all that portion of the alley
described asafifteen foot alley running North and South through the center
of what formerly was known as Block C, Leverett ' s Second Addition to the
City of Fayetteville , Arkansassand what is now the North 295 feet of
FulbrightIs Revised Plat of the North Fifty feet of Lot 8 and all of lot
10, Block B and all of Block C of Leverett ' s Second Addition to the City
of Fayetteville, Arkansas , said alley lying between lots 1, 4, b and 8
and Lots 2, 3, 5 and 7 , Block C in the formerly Leverett ' s Second Addition
and between Lots 1 , 2, 3 , 4 and 5 and the North 30 feet of Lot b to the
Vest and Lots 10, 11 , 122 13 , and 14 and the North 30 feet of Lot 15 $o
the East in said Fulbright ' s Revised plat ; the plat of Leverett ' s Second
Addition now appearing of record in Plat Book at page
thereof, and the plat of Fulbright ' s revised Plat , aforesaid, appearing
in Plat book / at page thereof , all in the office of the
Recorder of Washington County, Arkansas .
Whereas , after due notices as required by law , the council has , at
. the time and place mention in the notice, heard all persons desiring to be
heard on the question and has ascertained that the portion of said alley
hereinabove described has heretofore been. dedicated to the public use
an an alley herein described; has not been actually used by the public
generally for a period of at least five years subsequent to the filing
of the plat ; that all the ovmers of the property abutting upon the
portion of the alley to be vacated have filed with the Council their written
consent to such abandonment ;. and that public interest and welfare will
not be adversely affected by the abandonment of such alley .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF .
FAYETTEVILLE, ARKANSAS :
Section 1 . The City of Fayetteville , Arkansas , hereby releases ,
a
vacates and abandons all its rights , together with the rights of the
public generally, in and to the alley designated as follows :

a fifteen foot alley running North and South through the center of what
formerly was known as Block C, Leverett ' s Second Addition to the City of
Fayetteville , Arkansas and of what is now the North 295 feet of Fulbright ' s
Revised Plat of the North 50 feet of Lo' . ./and all of Lot 10, Block B
and all of Block C of Leverett ' s S Gond Addition to the City of Fayette-
' `vthl-&,-.Axleansas , said alley lying between Lots 1, 4, 6 and 8 and Lots 2,
3; 5 and 7 , Block C in .the formerly Leverettts Second Addition and between
Lots 12 2, 33 4 and 5 and .the North 30 feet of Lot 6 to the West and Lots
10, 11, 12, 13 and 14 and the North 30 feet of Lot 15 to the East in said
Fulbright ' s Revised Plat ; the Plat of Leverett ' s Second Addition now appear-
ing of record in Plat Book �_ at Page �� thereof, and the plat
of Fulbright ' s revised Plat , aforesaid , appearing in plat book —L. at
page jill thereof, all in the office of the Recorder of Viashington
County, Arkansas ,
Section 2 . A copy of this ordinance duly certified by the City Clerk
shall be filed in the Office of the recorder of Vivashington County, and
recorded in the . deed records of said County .
Section 3. This ordinance shall take effect and be in force from
and after its passage .
