AN ORDINANCE ACCEPTING AND APPROVING THE PL ' N OF TIE PLAnIING CONYISSION OF THE CITY OF FAYETTEVILLE , ARKANSAS , PROVIDING FOR BUILDING SET BACK LINES .ALONG NORTH COLLEGE AVENUE A DISTANCE OF 10 rEEr FROM FRONT PROPERTY LINES , FROM EAST SPRING STREET TO PROSPECT STREET ; AND SET BACK LINES A DISTANCE OF 15 FEPT FROM FRONT PROPERTY LINES , FROM PROSPECT STREET TO NORTH STREET ; REPEALING ALL ORDINANCES IN CONFLICT , AND FOR OTHER PURPOSES . : hereas , the City Planning Commission of the City of Fayetteville , I Arkansas , as a part of their overall plan has recommended to the City Coun- cil of the City of Fayetteville , Arkansas , that building set back lines be established along North College Avenue , a distance of 10 feet from front ► property lines , from East Spring Street to Prospect Street ; and building set back lines a distance of 15 feet from front property lines from Pros - . pect Street to North Street . Now , T4erefore , Be It Ordained by the City Councils P, of the City of Fayetteville , Arkansas : Section One : No building shall be built on North College Avenue between East Spring Street and Prospect Street , closer than 10 feet to the property line adjoining North College Avenue ; nor shall any building be built on North College Avenue between Prospect Street and North Street , closer than 15 feet to the property line adjoining North College Avenue . Section Two : No Permit shall be Issued for construction of build- ings in the area mentioned in Section One , hereof , unless the applicati6n for such permit is accompanied by a Plat or Drawing , prepared by a compe - tent Surveyor showing the location of the building or buildings on the tract and that the set back line is not nearer than the distances prescribed in Section One , hereof. Section TfIree . All Ordinances or harts of Ordinances in conflict XyX herewith are hereby repealed , and this Ordinance being necessary for the establishment of a uniform method of building and for the preservation of the Public Healkth, Peace and Safety ; an emergency is hereby declared to exist and this Ordinance shall be in fthll force and effect from and after its passage , Approval and publication.
