HomeMy WebLinkAboutOrdinance 955 ORDINANCE N0. AN ORDINANCE PROVIDING FOR THE REGISTRATION' OF BICYCLES- IN THE CITY OF FAYETTEVILLE, . ARKANSAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVI LLE, ARKANSAS : Section 1 . It shall be unlawful for any person to operate- Dr use a bicycle pro- o- � pelled wholly or in part by muscular power upon , any o£ . the streets -, oilleys, or public highways of tha City of Fayetteville , Arkansas , •wi'thout first obtaining from the Police Department a license therefor. . Section- 2o The _P,olice Department is hereby authorized and directed to is ue upon mitten application bicycle licenses which shall be effective from the • l • , day' Of 1949 to and including December3l, 1949 and thereafter said licenses, shall be issue for the calender year, commencing on the first day of January of/sai alender years and ending on the 31 day of December of said calender years . Said licenses when issued shall entitle the llicensee to operate such bipyble for which said license has been issued, upon the streets , alleysi and public highways , exclusive of the sidewalks thereof in City of Fayetteville : Section 3 . The city of Fayetteville, Arkansas shall provide each year "suitable license plates , tags , insignia ter Ether Wrkingeandnregistration cards having numbers stamped thereon in numerical order begin}}ng with number one and indicating the year for wAich the same are issued and the owner ' of each bycycle subject to the terms of this ordinance isohereby required to attach such license. . insignia to his bicycle . All persons - engaged -in the 'business of selling new or second hand bicycles are hereby required to report'to + the Police Department withingt24 hours of the date of each sale. a list of 'all- sales made by� such dealers which list shall include the name and address of each person to whom sold, the kind of bicycle sold together with a description and 'the frame numbethereon, and the number _. of- license, plate ,or insignia .attached: thereon, if- any., _ .. . .: . Section 5. It shall be the duty of each person who sells or transfers ownership of any bicycle except as provided in Section 4 to report such sale or transfer by retuning to the Police Department the ' registration card issued to such person as licensee thereof together with the name and address of the person to whom said bicycle• was. sold or transfered, Ml �report shall be made within five days of date of said transfer. The purchaser or transferee. of such bicycle shall apply for transfer of registration therefor within five. days of said sale or. transfer . Section 6 . It shall be unlawful to willfully or maliciously remove , destroy mulilate or alter the number of any bicycle frame licensed pursuant to the terms of this ordinance . It shall- be unlawful for any person to remove , destroy, or alter any license plate ; tag , or insignia or registration card during the time for which said license . plate , tag , or insignia , or registration card is in force , provided, however, that nothing in this . ordinance . shall prohibit the Police Department from stamping numbers MICROFILMED DATE OCT 6 1978 REEL _ on the frames of bicycles on . which no number can be found, or on which said number is . illegible or insufficient for identifucation purposes * Section 7 * . 'The annual license fee to be paid for each bicycle shall be 25¢ and shall be paid in advance , but the *Yor . of• the City of Fayetteville may by proclamation extend the time of such payment of . such bicycle license for a period of not more than 60 days from the date said license becomes due'* The 'transfer fee for all licenses shall be 25¢ which shall be 'paid at the time application for. transfer or registration is made * License fees for the remainder of the , year , 1949 shall be 10¢ . Section 86 . Any bicycle operated upon any of the streets , alleys , or - public highways of Fayetteville , Arkansas , .which ,does not have a license plate , ' tag or insignia thereto shall be impounded by. the Police Department of Fayetteville , Arkansas , who shall retain possession of such bicycle until the license provided for herein is obtained by the ,owner of said bicycle . Section 9 • All ordinances , or . parts of ordinances - in 'conflict hereto are hereby repealed. This ordinance shall not apply to any- vehicles ' now required to be licensed by the revenue department of the • State of Arkansas or any ordinance ao w in force WO in the City of Fayetteville , Ark * '.; t Section 10.
