AN ORDINANCE REGULATING THE HANGING 'OF SIGNS EXTENDING OVER SIDLVALKS
OF THE CITY. OF FAYETTEVILLE, ARKANSAS, REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH . AND FOR OTHER PURPOSES .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS :
Section 1. It shall be unlawful for any person, firm or corporation
to erect, construct, maintain or hang from any building or any other support
any. sign hanging or extending over the ' sidewalks of the City of FayettevilleS; '
Arkansas unless such persons firm or corporation shall have first complied
with the provisions hereinafter set forth .
Section 2. Any person, firm or corporation who may desire to erect
or maintain any sign extending over or across any sidewalk4or street in the
City of Fayetteville, Arkansas extending more than eighteen inches from the
building to which it is attached or extending more than eighteen inches
over any sidewalk if not attached to a building, shall submit to the city
engineer of the City of Fayetteville , 'Arkansas an application for a permit
to erect or maintain such sign, together with the design and specifications
showing the size and construction of such sign and the matter to appear
thereon. If said City Engineer approves such application, design and specs
fications , he shall endorse thereon his approval and the applicant shall
then present said application . so endorsed by the City Engineer to the City
Clerk of the City of Fayetteville, Arkansas , who shallissue a permit on
condition that the work be done under the supervision and inspection of the
City Engineer or his duly -authorized representative, provided that the
applicant shall pay for said permit and inspection the sum of Two Dollars
and Fifty Cents ($2.50) which shall be a prerequisite to the issuance of
such permits .
Section 3 .' All signs provided for under Section 2 hereof. shall be of
metal construction of sufficient strength to insure the safety of the public
and the method of attachment of said sign as well as the height from the
sidewalk or street level as the case maybe; shall also be of construction
such as to insure the safety of the public and to that end the City Engineer
shall require the applicant to show the method of suspending or hanging of
said sign, :::the .height above the sidewalk or street level and such other

information with respect to said sign as is necessary to determine that its
installation will not endanger the public .
Section 4. Electric signs shall be of such design and materials as
may be approved by the City Engineer.
Section 5 . Any person, firm or corporation violating any provisions
of this ordinance shall be guilty of misdemeanor and fined in the sum of
not less than $5 .00 nor more than $15 .00 and each dap the said provisions
of this ordinance is violated shall constitute a separate offense.
Section 6 . All ordinances and parts of ordinances in conflict here.
with are hereby repealed, and this ordinance shall be in full force and
effect from and after its passage and publication.
