AN ORDINANCE PROVIDING FCR THE PROMULGATION OF RULES AND REGULATIONS
GOVERNING THE WATER..DEPAR.Th= OF THE CITY OF FAYETTEVILLE, ARKANSAS,
PRESCRIBING PENALTIES FOR THE VIOLATIONS OF SUCH RULES AND REGULATIONS,
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH,
AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE PCITY OF FAYETTEVILLE, ARKANSAS :
Section 1. The Superintendent of the City Water Plant of the City of
Fayetteville.. Arkansas is hereby authorized to prepare such rules and
regulations in connection with the maintenance, operation, repair, extension,
tapping of mains, size of mains, and all other matters and things in
connection with the operation of the City Water Plant of the City of
Fayetteville, Arkansas as towbMM:A:& shall seem proper, necessary or
expedient . Upon the preparation of such rules and regulations as herein
provided, they shall be submitted -to the City,- Council of the City of . Fayette-
ville, Arkansas and upon approval. by the City Council of the City of Fayette—
ville, Arkansas either by motion or resolution, such rules and regulations
shall govern the water department -operations as therein "provided and shall
repeal all rules , regulations or ordinances in conflict therewith.
Section 2. The prepared rules and regulations of the superintendent
of the City Plater Plant, when approved by the City Council of the City of
Fayetteville, Arkansas, shall have the same force and effect as law and
violations of such rules and regulations shall be punishable as herein—
after provided.
Section 3. Any person, firm or corpo ration violating any of the
rules and regulations of the City 4ater Plant of" the City of Fayetteville.,
Arkansas prepared and adopted as herein provided shall be deemed guilty
of a misdemeanor and upon conviction thereof shall be fined in any sum
not. exceeding One Hundred ( $100 .00) Dollars and each day of such violation
shall be considered a separate offence.

Section 4. All ordinances or parts of ordinances in conflict with .
any of the rules and regulations prepared and approved as provided herein
or which may be prepared and approved as provided herein are hereby re—
pealed, or in case such rule or regulation is hereafter prepared and approved
as provided in this ordinance and there is then a conflict between present
ordinances applicable to the • City Plater Plant of the City of Fayetteville,, ,
the present ordinance or ordinances shall be repealed upon the approval
by the City Council of the City of Fayetteville, Arkansas of such rule or
regulation.

Section 5 . It appearing that many of the practices of the City Water
.Plant of the City of Fayetteville, Arkansas are uneconomical and are not
presently serving equitably and have not taken into consideration the
increased. costs of labor and materials and scientific progress on new
material, an emergency is hereby declared to exist and this ordinance,
being necessary for the preservation for the public peace and safety,
shall be in full force and effect from and .after its passage and
approval. `
