AN ORDINANCE REGULATING THE INSTALLATION OF GAS PIPE, FITTINGS , AND APPLIANCES INSTALLED
FOR THE PURPOSE OF USING GAS IN ALL BUILDINGS AND STRUCTURES OF GAS CONSUMERS; PROVIDING
THE MANNER AND WAY IN WHICH SUCH PLUMBING tiWRK SHALL BE DONE, THE KIND AND CIASS OF MA-
TERIAL USED IN SUCH WORK, PROVIDING SPECIFICATIONS; PROVIDING FOR INSPECTIONS AND FEES
FOR INSPECTIONS; REQUIRING BONDS; PRESCRIBING POWERS AND DUTIES OF GAS PLUMBING IIS
SPECTOR; AND PROVIDING FOR THE ENFORCEMENT OF THE PROVISIONS OF THIS ORDINANCE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, WASHINGTON COUNTY,
ARKANSAS :
SECTION le That this ordinance shall be known as the Gas Plumbing Code
Ordinance of Gni y of Fayetteville , Arkansas ,
SECTION 2 . That the Mayor of the City of Fayetteville , Arkansas , be and he
1s hereby au o ze and empowered to employ a Gas Plumbing Inspector whose duties
shall be as hereinafter set out. The said Gas Plumbing Inspector shall file a bond in
the sum of $1,000.00, conditioned that he will faithfully perform his duties as herein
set out .
SECTION 3 : That the said Gas Plumbing Inspector and his assistants are here-
by authorizes— ,�owered and directed to supervise all gas piping, installation of
appliances or fixtures placed in or in any manner connected in any building or struc-
ture, and to see that all such piping complies with the conditions of this ordinance
and is in accordance with the "Standards of the National Board of Fire Underwriters" ,
which rules and regulations are hereby adopted and made a part of this ordinance, under
which all gas piping must be done (NBFU Pamphlet No. 54) .
SECTION 4. LICENSE : No license shall be issued to arUr person, firm or
corporation to do any gas wor , to open or excavate in or upon the streets, alleys ,
highways , parks , sidewalks , or other public ways of the City of Fayetteville until such
person, firm or corporation shall have filed with the City Council bond in the sum
of One Thousand ($19000.00 ) Dollars , with good and sufficient sureties ,. - to be approv-
ed by the City Council, condition of bond being that the applicant for a. license
will obey all ordinances regulating his work as may 'now exist or may hereinafter be
passed to protect the inhabitants of said City of Fayetteville from imperfect or de-
fective gas plumbing or appliance installation. Said bond shall be further conditioned
that such person, firm, or corporation, shall without additional cost 'to the persons for
whom work is done, remedy and defect therein due to faulty workmanship or incorrect con-
struction or due to faulty material used or furnished by such person, firm or corpora-
tion within forty-eight hours after notice from the Gas Plumbing Inspector is given to
remedy or repair same . Said applicant will refill said excavations in or upon the
streets , alleys , highways , parks, sidewalks , or other public ways and replace all:. pave-
ments in as good condition- as same was prior to their opening or excavation; will place
and maintain lights and guards around all excavations or gas materials left in any
street, alley, highway, park, sidewalk or public place; and will hold the City of
Fayetteville harmless from all damages that may occur by reason of any gas work done
or excavations made by said applicant . If the City Council is satisfied that the said
applicant is fully qualified to do gas piping and the installation of gas appliances ,
upon approval of said bond by the City Council, the person, firm or corporation de-
siring to do such work shall file with the Gas Plumbing Inspector the names of each
and every member or representative of the firm obtaining the license and pay the sum
of Ten Dollars ($10.00 ) per annum for such license.
SECTION 5 - PERMITS : The Gas Plumbing Inspector shall not issue any per-
mit - for individual jobs to be done except upon written application by the licensed
applicant , which shall describe the character of work to be done, together with the
exact location of same , the number and locations of gas openings , and the number, name '
and character of gas appliances or fixtures to be put in, which shall be signed by
the party applying therefor; and upon such application the Gas Plumbing Inspector
shall issue a permit accordingly, the original to be handed to the party applying
therefor and a duplicate , together with such application, shall be kept as a per-
manent record of said Gas Plumbing Inspectorts office . No person, firm or corpora-
tion shall do any gas work of any character or install or connect any gas appliance
or fixture or repair arty gas work or make any extension or alteration to gas lines or
change the location of any gas appliance , except as hereinafter provided, until he
has first obtained an annual license to operate as a gas plumber, nor until he has
made written application to the City Gas Inspector and received a permit to do such

work from said Inspector, provided that Licensed Gas Plumbers need make no application
or secure a permit to run any exposed gas line to connect one gas range, stove, or
appliance, not exceeding five (5) feet in length, providing, however, that such exten-
sion must conform to other provisions of this ordinance . Before any street , alley,
sidewalk, road, park,' highway or any other public way of the City of Fayetteville is
opened or excavated for the purpose of laying gas pipe or gas service or for any re-
pairs to either of same, a permit shall be obtained from the City Engineer, in writing,
authorizing said cut to be made.
SECTION 6 - INSPECTIONS AND TESTS : It shall be the duty of the Gas Fitter
to notify the Gas Plumbing Inspector etween the hours of 8 :00 a.m. and 5 :00 p.m. ,
not less than eight working hours -before the work is to be inspected or tested, and it
shall be the duty of the Gas Fitter to make sure that the work will stand the test. pre-
scribed before giving the above mentioned notice ..
For inspection of new gas piping, extensions , branch lines and alteration
work in any building, the Gas Plumbing Inspector shall charge and collect from the
Licensed Plumber applying for szch inspection, the sum of One Dollar ($1.00 ) for each
inspection. The Gas Plumbing Inspector going to the same job more than once for the
same inspection shall charge One Dollar ($1.00 ) for each and every inspection there-
after if the workmanship is defective, the installation contrary to this ordinance or
the work is not ready for inspection. If and when the work passes the inspection
tests as prescribed in this ordinance , the Gas Plumbing Inspector shall issue a Cer-
tificate of Inspection, with a copy thereof furnished to the Gas Company, and this
will authorize the Gas Company to install gas service or meter at the premises (or
building ) covered by the Certificate of Inspection. No meters shall be installed by
the Gas Company until sich Certificate of Inspection';has been furnished them by the.
Gas Plumbing Inspector.
SECTION 7 - POPPERS OF PLUMBING INSPECTOR: The Gas Plumbing Inspector and
the Fire Marshall shall each have the power o con mn any work hereinafter or hereto-
fore installed when, in their opinion, such work is dangerous to the safety of the
community in which any of said work may exist . They shall shut off or cause to be
shut off, all gas service in residence or business houses where , in their judgment, the
housepiping or appliances are unsafe . The gas will remain shut off until such time
as the unsafe conditions are . corrected by the property owner or the fitter installing
same, and a Certificate or Inspection issued by the Gas Plumbing Inspector and a copy
thereof furnished to the Gas Company, after which the Gas Company may restore the
service .
SECTION 8 - STOVES, WATER HEATERS, APPLIANCES, CONNECTORS , ETC . : All stoves
water heaters , or gas appliances hereinafter installed shall be approved by the Ameri-
can Gas Association and their stamp of approval shall be plainly marked on such appli-
ances . All connections to room or space heaters should be of iron, aluminum, brass or
copper pipe and connections. No fibre or rubber hose connections may be used for any
purpose . No flexible connections may be used, except those bearing the stamp of
approval of the National Board of Fire Underwriters or the American Gas Association.
No gas appliance of any description used for heating or cooking purposes shall be
connected without an additional cutoff at the floor line or baseboard and it shall be
unlawful for any person to so connect any heating stove, kitchen range, hot water
heater, or steam boiler without the above regulation. No valves or unions shall be
placed between ceiling and floor or located in such a position that the stuffing box
or valve cannot be replaced. . Only ground joint type unions shall be used, and no union
may be concealed. Water heaters shall not hereafter be installed in bathrooms or
sleeping rooms , or closets . When water heaters are installed in small rooms with a
volume of less than 300 cubic feet, such rooms should have a tight fitting door, and
must have some provision made for the admittance of outside air, preferably through aft .
opening in the floor of the room; 'the area of: such openiri .lo,.egual` ten (10 )" square
inches for every 10 ,000 B. T.U. of gas consumed per hour .
SECTION 9 - GAS APPLIANCE VENTS : No person, firm or corporation shall in-
stall or connect any appliance for t purpose of heating water for domestic purposes
by combustion of artificial or natural gas or any inflammable liquid as fuel, unless
such appliance is provided with a metallic down-draft divertor and all such water
heaters shall be attached to a vent connection not less than the size of the heater
opening and discharging directly into a chimney that would comply with the standards
of the National Board of Fire Underwriters . Flue connections shall be required of all
domestic appliances with input ratings in excess of 40,000 B. T.U. per hour, excepting
domestic gas ranges . Flue connections shall be required of all automatically controlled
appliances with input ratings in excess of 5,000 B. T.U. per hour . Flue connections
shall be required of all automatically controlled appliances with input ratings of
less than 5,000 B. T.U. per hour, unless q ipped with an automatic device to prevent
the escape of unburned gas at the main burner or burners . All floor furnaces , central
furnaces., unit heaters , and boilers shall be vented. All vents shall comply with the
standards of the National Board of Fire Underwirters (NBFU Pamphlet #54) as mentioned
heretofore.
SECTION 10 - GAS SERVICE LOCATION: Any gas fitter, before installing a
house service line or meter loop for gas "Mhl consult the Gas Company for a proper lc-
cation of the said meter. All house service lines shall be run in as direct a line as
possible from the building to the curb line and no gas pipe shall be run within 12
inches of a sewer trench or water pipe . The proper spread must be made at the meter
location and the correct distance left by the plumber for all meters to be set. Infor-
mation as to the distances required can be obtained from the Gas Company.
SECTION 11 - RULES FOR GAS PIPING: Pipes in the construction of gas work
shall be new best quality -wrought iron or Reel with malleable iron fittings. Sizes
and lengths shall comply with the aforementioned t'Standards of the National Board of
Fire Underwriters for the Installation, Maintenance and use of Piping and Fittings for
City Gas" ,4 and all work will be done in accordance with these regulations . For all
large or industrial buildings or jobs not adequately covered by the above rules and
regulations , plans for piping or installation of equipment should be taken up with the
officials of the Gas Company.
All pipes under house must be securely strapped to the bottom of joists ,
or other secure places , with iron straps of pipe hooks . No pipe or fitting shall be ,
covered or concealed from view UNTIL INSPECTED AND APPROVED by the Gas Inspector . No
pipe shall be laid so as to support any weight except fixtures or meters , or be subject
to any strain. All outlets not connected to fixtures shall be capped. Ordinary dwell
Ings must be piped with the following pipe sizes and the greatest length of pipe of
various sizes will be found in the table below:

No less than 11 in. pipe shall be run from the meter to the first opening in any case,
and no less than 1 inch pipe shall be run from the customers property line to the
house . a 3/4 inch opening shall be left for gas ranges , and for floor furnaces , and
circulators with input capacity of 50,000 B. T.U. per hour or over . The total area of
all gas outlets shall not be more than the area of the pipe from the meter to the first
opening.
SECTION 12 - GAS METERS : The gas meter is the property of the Gas Company
and must not be disconnecte for any cause, by anyone other than those specifically
authorized to do so; if change is desired, notify the Gas Company. The Gas Company
may not install a meter or turn on the gas in any building until a Certificate of In-
spection has been issued by the City Gas Inspector. After a meter has been set and
additional work is done, the plumber or gas fitter shall report such change or exten-
tion to the City Gas Inspector.

SECTION 13 — PENALTIES : Any person, firm, or corporation who engages in
the businesso p umbing wi=first having secured the required license, as provided
in this ordinance, shall be deemed guilty of a misdemeanor and, upon conviction, shall
be punished by a fine of not less than Five Dollars ($5.00j and not more than One
Hundred Dollars ( $100.00) .
Any person, firm, or corporation who violates any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and, upon conviction, shall be
punished by a fine of not less than Five Dollars ($5.00 ) and not more than One Hundred
Dollars ($100.00 ) .
The Gas Plumbing Inspector shall have the power to revoke the license of any
person, firm, or corporation who violates any of the provisions of this ordinance,
provided, however, that, in the event the said person, firm, or corporation feels that
an injustice has been done by the revocation of his license , he may appeal to the City
Council, who will have the authority to reinstate his license after a hearing has been
had.

SECTION 14: If any section, paragraph, subdivision, phrase or provision of
this ar•dinance sFia � adjudged invalid or unconstitutional, the same shall not affect
the validity of this ordinance as a whole , or any part or provision, other than the
part so decided to be invalid or unconstitutional. 11
SECTION 15. It is hereby ascertained and declared that by reason of the
fact thatr e snow a gas distribution system being installed in the City of
Fayetteville , Arkansas , and there now being no ordinance regulating the installation .of
gas pipe, fittings , and appliances or providing for inspection of same within said
City, and said ordinance being necessary for the preservation of the public health
and safety of the inhabitants of said City, an emergency is hereby declared to exist
and this ordinance shall take effect immediately upon its passage , approval, and
publication.
