AN ORDINANCE AUTHORIZING EXHIBITIONS . OF CARNIVALS WITHIN CERTAIN ZONES .
OF THE CITY OF FAYETTEVILLE, PROVIDING LICENSE FEES OR PERMITS , REPEALING
ALL CONFLICTING ORDINANCES , AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF FAYETTEVILLE , ARKANSAS :
Section 1 . It shall be lawful for carnival companies to set up the
usual stands and equipment and to conduct the usual business of carnival
companies in the City of Fayetteville , Arkansas provided that the stands ,
amusement machines and other attractions usually accompanying carnival
cmpanies are located not closer than one mile to the public square in the
City of- Fayetteville , Arkansas; provided further , that the �name Ocom=.i
paid' shall for the purposes of this ordinance include not only a corpora-
tion but also firms , associations or individuals as the case may be . .
Section 2 . A privilege tax ". or permit fee of three hundred dollars
($300 .00 ) is- hereby levied against any such company. as defined in Section 1
hereof for the privilege of exhibiting for a , period of not more than one
week in the zone or zones pexmited in Section' 1 of this ordinance , which
fee shall be paid to the City Clerk of the City of Fayetteville , Arkansas
before any of said equipment or amusement devices , buildings , tents or
other property of such carnival is erected, installed -or put in operation
as the case may be .

Section 3 . -Ali ordinances or parts of ordinances in conflict ' }iere-
with are hereby repealed, and it appearing that under present ordinances
no carnival companies can exhibit within the City of Fayetteville, Arkansas
and -it further , appearing that since the 'passage . of the ordinance prohibiting
such exhibitions , the city limits of the City of Fayetteville , Arkansas
have been expanded and now embrace grounds upon which carnival companies
" have always-exhibited; and - it being - the desire of ' the City ` of Fayetteville
to permit the use of said grounds and it' being necessary for the preserve-
tion of the public - health , peace and safety, an emergency is hereby declared '
to exist and this ordinance shall be in full force and effect from and after
its passage and approval.
