AN ORDINANCE REQUIRING ALL TAXICABS OPERATED ON Trite STREETS OAHE CITY
OF FAYETTEVILLE TO BE EQUIPPED '7ITH GOVERNORS ; REQUIRING SAID GOVERNORS •
TO BE KEPT IN REPAIR , FIXING FINES AND PENALTIES FOR FAILURE. TO COMPLY
AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION ONE : It shall be unlawful for any person to operate a taxicab ,
or any individual , partnership or corporation engaged in the taxicab
business to permit any taxicab belonging to such individual , partnership ,
or corporation , to be operated within the City of Fayetteville , Arkansas ,
until and unless such taxicab is equipped with a governor , which gover-
nor shall " be properly set , kept in good repair , and actually limit the
speed of said taxicab '• to such speeds as are now or may hereafter be pro-
vided by law .
SECTION TWO : Any person , firm or corporation violating Section One
of this Ordinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof shall be punished by a fine of not less than $ 50 . 00 nor
more than $ 1000 ; and each . day of such unlawful operation , as defined
in this Ordinance shall be a separate offense .
SECTION THREE : It is declared to be the intention of this Ordinance
to place the burden of regulating speeds of taxicabs upon the taxicab
operators , and this Ordinance shall not repeal any other Ordinances
relating to taxicabs in the City of Fayetteville , except insofar as
there is a specific conflict .
SECTION FOUR : It appearing that heretofore taxicabs have been operated
whose speeds were not properly governed and limited , without being
specifically prohibited by Ordinance ; and it being necessary that such
speeds should be limited as herein provided to insure the public health ,
peace and safety ; An emergency is hereby declared to exist and this
Ordinance shall be in full force and effect from and after its passage ,
approval and publication .
