AN ORDINANCE DECLARING THE CARRYING OF PASSENGERS
FOR HIRE A PRIVILEGE1 FIXING A TAX THEREON; PROP
VIDING FOR THE ISSUANCE OF CERTIFICATES OF PUBLIC
CONVENIENCE AND NECESSITY, FIXING PENALTIES FOR
VIOLATIONS , AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE*
Section I The carrying of passengers for hire in the City of Fay—
etteville is hereby declared to be a privilege and no person , firm or
corporation shall carry or offer to carry any passengers ,within the City
of Fayetteville until the privilege tax for the operation of such trans-
portation shall have been paid as hereinafter provided.
Section II The privilege tax to be paid by all persons , firms and
corporations carrying passengers for hire within the city of Fayetteville
shall be one hundred dollars ( $ 100. 00) per annum , whidh period shall
run from January first of each year to the succeeding January first of the
following yeat. Provided, however, that if license is sold on and after
July first of . any year , the liaGnse shall be Fifty Dollars for the privi—
lege of operating until January first , next after the payment of said tax .
Section III No person, firm or corporation shall operate any
vehicle within the City of Fayetteville for the purpose of carrying pase-
angers for hire until and unless they shall have first made application
in the manner hereinafter set forth and have received a certificate of
Public Convenience and Necessity from the City of Fayetteville .
Section IV Any person , firm or corporation desiring a certificate
of Public Convenience and Necessity for the operations mentionedin this
ordmdance shall make written application therefor and file said application
together with remittance to the City of Fayetteville in the sum of One
Hundred Dollars, said application must show the ability of the applicant
to furnish the service proposed , and the proposed charges and schedules
for such service . The City Clerk shall forthwith give notice of the filing
of such application earl by publication in a -newspaper printed, published
and having a general bona fida circulation in the 6ity of Fayetteville.
Said notice shall fix a date• for hearing before the City Council of the
City of Fayetteville not less than two weeks from the date of application ,
at which hearing all interested persons , firms and corporations may appear
and present such matters as they may deem adviseable in assisting the
Council to properly pass upon adid application . x The Council may either
grant or reject said application in their discretion . They may permit
admendments to the application if applicant offer6l to amend and the
Council considers said amendments to be the beeiCi

of Fsyetteville . x In the event said application is granted , the One
Hundred Dollar deposit shall be credited as payment for the privilege tax
herein provided, If the application is re jected, the costs of pub-
lication of the notice and other necessaYy expenses shall be deducted from
the deposit , and the balance returned to the applicant , x
Section V The City of Fayetteville hereby adgpts all of the terms

of Act No . 2 / 3 of the Acts of Arkansas for the year , which Act
applies specifically to taxicabs ,
Section VI Any person, firm , or corporation violating ,ny PpLrt ,
section , clause or phraseo# this or$Anance shall be guilty of a. misde-
meanor and fined in any sum not less than 50 . 00 nor more than 41000 . 00 ,
and each day ' s violation shall be deemed a separate offense .
Section VII All ordinances and parts of ordinances in conflict
hereiwth are hereby repealed, but should any part of this ordianca bemd4oiaaed
goid it shall not affect the remaining portions thereof . Provided ,
however , that this ordi#nance shall not be construed as affecting in any
way the requirement for purchase of the " For Hire " city automobile . licenses
for vehicles used for tharpurpose ,
\ Section VIII It appearing that there is immediate need for proper
regulation of transportation of passengers for hire witbknrthe City of
Fayetteville , an emergency is hereby declared to exist and this ordinance
shall be in full force and effect from and after its passage , approval
and I)ublication.
