HomeMy WebLinkAboutOrdinance 876 1 ORDINANCE N0 . -4z� AN ORDINANCE TO PROVIDE A MORE ADEQUATE REGULATION OF THE SPEEDS OF TAXI CABS AND TO PROVIDE ADDITIONAL SAFETY OF OPERATIONS OF TAXI CABS AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTE- VILLE , ARKANSAS : SECTION I That on and after the effective date of this S ordinance all taxi cabs operating in the City of Fayetteville , Arkansas , shall be equipped with governors for the purpose of regulating the speeds , which governors shall be installed , main- tained and repaired as hereinafter provided . SECTION II The governors to be used on said taxi cabs shall be of a standard type approved by the Chief of Police and the Police Committee of the City Council of the City of Fayette- ville , and shall be installed , maintained and repaired under the supervision of the Police Department of the City of Fayetteville and by qualified mechanics whose names shall be furnished to the Police Department together with records of all installations or repairs of governors . SECTION III Governors on said. taxi cabs shall be set to operate at such speeds as are now or may hereafter be permitted by law . And to the end that it may be determined that said governors are in proper working condition the Police Department shall approve the installation of said governors and shall test the taxi cabs upon which said governors are placed in order to determine that the speeds are properly regulated and no taxicab shall operate in the City of Fayetteville until the Police Department approves the installation and setting of said gov- ernors , and in the event said governor is set by the use of a key , the setting shall be done under the supervision of the Police Department and the key shall remain in the possession of the Police Department of the City of Fayetteville , Arkansas , qnd in the event said governors are sealed , the seal shall be affixed in the presence of the Chief of Police orhis designated agent and shall MICROF&MED DATE 6 1978 REEL 11 "� not be broken except by and with the consent of the Chief of Police of the City of Fayetteville and in the event the sealIG are broken or key settings are changed , whether by and with the consent of the Chief of Police or not , said cab shall not again be operated in the City of Fayetteville until said governors are re- set under the supervision of the Chief of Police or his designated representative in the manner hereinabove provided. SECTION IV A violation of any of the sections or parts of sections of this ordinance shall be deemed a misdemeanor and any taxi cab driver who operates a taxi cab in violation of the terms of this ordinance , oranytaxi cab company , partnership , firm or individual who knowingly permits his drivers to operate taxi cabs in 'violation of the terms of this ordinance shall each be guilty of a misdemeanor and upon conviction thereof shall be punished by fine of not less than Fifty ( $ 50 , 00 ) Dollans nor more than Two Hundred Fifty (250 . 00 ) Dollars , and each day a taxi cab is operated in violation of the terms of this ordinance shall be deemed a separate offense . SECTION V The Police Department shall have the right at any time to inspect any taxi cabs to determine that the governors thereon are in proper working condition and are controlling the maximum speeds effectively and in the event any cab is discovered whose governor is not in proper working condition the Police De- partment shall have the right to proceed under a criminal violation bf this ordinance and to prohibit the operation of said cab. until said governor has been properly repaired and reset as hereinabove provided. SECTION VI All ordinances or parts of ordinances in conflict herewith are hereby repealed and it appearing that because of the reckless manner in which taxi cabs have been operated in the City of Fayetteville the health , peace and safety of the residents of the City of Fayetteville are endangered , an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after the / g� day of Aj/vz4, AAW , 1943 .
