" AN ORDINANCE PROHIBITING CARNIVAL COMPANIES ,
STREET CARNIVALS AND SIMILAR PUBLIC EXHIBITIONS
WITHIN THE CITY OF FAYETTEVILLE , ARKANSAS AND FOR
OTHER PURPOSES AND FIXING PUNISHMENT FOR VIOLATION
OF THE TERMS OF SAID ORDINANCE. "
i?HEREAS , there are no suitable locations within the
City of Fayetteville where carnival companies , street carnivals
and amusement rides can be located without creating a nuisance
and unsanitary conditions to many of the inhabitants of the
City of Fayetteville , and
WHEREAS , there are adequate locations outside of the
city limits of the City of Fayetteville where such amusements
may be installed without creating a nuisance or causing undue
menace to the public health ;
NOU , THEREFORE BE IT ORDAINED by the City Council of
the City of Fayetteville , Arkansas :
SECTION ONE : That carnival companies , street carni—
vals and amusement rides shall not be erected or operated within
the corporate limits of the City of Fayetteville , Arkansas :
SECTION TWO : Any person , firm , or corporation who shall
cause to be located in the City of Fayetteville , Arkansas any
carnival company , street carnival or amusement ride shall be
deemed guilty of a misdemeanor and upon conviction thereof shal 1
be - punished by a fine of not less than Fifty Dollars nor more
than Five Hundred Dollars ( $ 500 . 00 ) and each day of the operation
or exhibit of any of the shows or amusements herein probibited
shall constitute a separate offense .
SECTION THREE : All ordinances and parts of ordinances
in conflict herewith are hereby repealed and it appearing that
the shows and amusements herein prr)hibited have in the past opera—
ted until late hours at night and unsanitary and unhealthful con—
ditions have been created by reason of such operations and this
ordinance being necessary for the preservation of the public
health , peace and safety an emergency is hereby declared to exist
and this ordinance shall take effect and be in full force from
