AN ORDINANCE PROHIBITING THE ERECTION , BUILDING , OR
CONSTRUCTION OF BULK STORAGE TANKS , VATS OR OTHER
CONTAINERS FOR INFLAMMABLE LIQUIDS OR GASES WITHIN
THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE ,
AND FOR OTHER PURPOSES ,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
SECTION 1 . It shall be unlawful for any person , firm or
corporation to build, construct , erect or locate any tanks , vats
or any other type of container designed for or actually used
to store inflammable liquids or gases within the corporate
limits of the City of Fayetteville , Arkansas ; provided that this
ordinance shall not apply to the maintenance and necessary repairs •
of tanks already located within the corporate limits of the City
of Fayetteville , Arkansas , and provided further that this ordinance

SECTION 2 . Any person , firm or corporation violating the
terms of this ordinance shall be deemed guiltyof a misdemeanor
and upon conviction thereof shall be punished by a fine of not
more than $500 . 00 , and in addition thereto all tanks , vats or
other containers constructed in violation of the terms of this
ordinance shall be removed by the person , firm or corporation so
violating the terms of this ordinance , and the failure of such
person , firm or corporation to remove such containers after having
been ordered to do so by the Municipal Court of the City of
Fayetteville shall be punishable as in other contempt proceedings ,
and the City may at its election remove such containers and the
cost of removal shall be adjudged against the person , firm or
corporation violating the terms of this ordinance .
SECTION 3 . All ordinances or parts of ordinances in conflict
herewith are hereby repealed , and it appearing that the presence
of large quantities of inflammable liquids and gases within the

corporate limits of the City of Fayetteville , Arkansas , constitutes
a menace to the public health , peace and safety , an emergency is
hereby declared to exist , and this ordinance ehall be in full
force and effect from and after its passage , approval and
publication .
