AN ORDINANCE PROHIBITING THE PARKING OF TRUCKS LOADED WITH
ANIMALS OR FOWLS WITHIN THE RESIDENTIAL DISTRICTS OF THE
CITY OF FAYETTEVILLE AND LIMITING THE LENGTH OF TIME WHICH
SUCH LOADED TRUCKS MAY BE PARKED IN THE BUSINESS DISTRICT
OF THE CITY OF FAYETTEVILLE , AND FOR OTHER PURPOSES,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE ,
ARKANSAS :
SECTION 1 . It shall be unlawful for any person , firm or
corporation to park or leave in the residential areas of the City
of Fayetteville any trucks , wagons or cars loaded with animals or
fowls , and any person , firm or corporation so parking or leaving
said conveyances loaded with animals or fowls in any of the
residential districts of the City of Fayetteville shall be guilty
of a misdemeanor and upon conviction thereof shall be punished by
a fine of not to exceed $100 . 00 ; provided , that this ordinance shall
not apply to vehicles unavoidably parked or left in residential
districts due to mechanical failure of the conveyance .
SECTION 2 . It shall be unlawful for any person , firm or
corporation to park or leave standing upon the streets in the business
area of the City of Fayetteville any truck , wagon or car loaded with
animals or fowls for a period longer than thirty minutes ; and any
person , firm or corporation violating the terms of Section 2 of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine of not to exceed $100 . 00 ,
SECTION 3 . All ordinances or parts of ordinances in conflict
herewith are hereby repealed , and it appearing that numerous trucks
loaded with livestock have been parked on the residential streets
of the City of Fayetteville , and that they constitute a nuisance
and a menace to the public health , peace and safety of the residents
of the City of Fayetteville , an emergency is hereby declared to exist ,
and this ordinance shall be in full force and effect from and after
its passage , approval and publication .
