AN ORDINANCE TO FIX BUILDING LINES IN RESIDENTIAL SECTIONS
OF THE CITY OF FAYEMWILLE , PROVIDING PENALTIES , AND FOR
OTHER PURPOSES ,
BE IT ORDAINED by the City Council of the City of
Fayetteville , Arkansas :
SECTION 1 . That no building shall be erected within the
residential district of the City of Fayetteville , Arkansas , closer
than twenty ( 20 ) feet to the property line adjoining any street
within the City of Fayetteville , Arkansas ; provided , however , that
if a building line in any particular block in the residential
district of the City of Fayetteville is located more than twenty
feet from the property line adjoining any street within the City
of Fayetteville , then the building line shall remain as it is
established by buildings already in place , Provided further that
residences now located closer to the street than herein permitted
may be repaired in the manner now or hereafter provided by the
ordinances of the City of Fayetteville .
SECTION 2 . No out -building , garage or other structure shall
be erected on any lot in the residential section of the City of
Fayetteville closer to the street than the residence in connection
with which it is used,
SECTION 3 . No building permit shall be granted either for
new construction or for major repair of present construction if the
proposed construction or repair is nearer to the street than the
building line hereinabove provided. Provided, however , that nothing
in this ordinance shall prohibit the erection of a residence or
out -buildings closer than twenty feet to the property line adjoining
any street within the City of Fayetteville , Arkansas , if said
residence and out-buildings are to be constructed on a corner lot
Having a width or frontage as the case may be of fifty feet or less ,
and in the event it is desired to erect a residence with its usual
out-buildings on a lot of fifty feet or less , $he application to
so construct such residence and out-buildings used in connection
therewith shall be referred by the Building Inspector to the City
Council of the City of Fayetteville after he has given due notice
of the application as in cases provided for the erection of business

buildings in residential districts and property owners owning
property in the immediate vicinity may enter their protests in like
manner as now provided by the ordinances of the City of Fayetteville
for entering protests against the erection of business or commercial
buildings in resWential sections , but protests of property owners
shall not be necessary to invoke the jurisdiction of the City
Council and all construction shall be begun only after the City
Council has specifically authorized such construction by motion or
resolution duly adopted, and the Building Inspector shall not issue
a permit for such construction until after he is authorized to do
so by the City Council aforesaid,
SECTION 4 . Any person , firm or corporation violating the
terms of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine of not less
than Twenty—five Dollars ( $"25 , 00 ) nor more than One Hundred Dollars
( $100 , 00 ) and each day the terms of this ordinance are violated shall
be considered as a separate offense ; and in addition thereto , the
City may at its election remove any building or part of building or
rgquire the property owner to remove said building erected or repaired
in violation of the terms of this ordinance .
SECTION 5 , Whereas , it is apparent that building lines within
the City of Fayetteville are not uniform , and that many residential .
sections have been materially damaged by a lack of uniformity and
that unless this ordinance becomes immediately effective there will
be a continual damage to the residential sections of the City of
Fayetteville ; an emergency is hereby declared to exist and this
ordinance shall be in full force and effect from and after its
passage , approval and publication ,
