HomeMy WebLinkAboutOrdinance 827 ORDINANCE N0 . 8 2 7 "AN ORDINANCE PROHIBITING THE USE OF SOUND TRUCKS ON THE STREETS OF THE CITY OF FAYETTEVILLE, FIRING PENALTIES for VIOLATMONS AND FOR OTHER PURPOSES . " WHEREAS , the use of electrical amplifying systems used on automobiles touring the streets of Fayetteville has become a nuisance to the residents of said city and , WHEREAS , it is the desire of the City of Fayetteville to prevent the use of so-called sound trucks , and publid address systems upon the streets of said city . NOW, THEREFORE , Be It Ordained by the City Council of the City of Fayetteville : SECTION ONE : It shall be unlawful for any person , firm or corporation to use loud speakers , sound trucks , public address systems , electrical amplifying systems or other devices calculated to , or actually amplifying normal sounds , upon any of the streets of the City of Fayetteville ; provided however that amplifying systems may be used when necessary for the public welfare , such necessity to be determined by the Mayor , who shall issue a permit , if in his judgment such necessity exists . Failure to secure .-the permit herein provided shall be punishable as provided in Section Two of this Ordinance . SECTION TWO : Any person , firm or corporation violating the terms of Section One of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than Five Dollars ( $5 . 00 ) nor more than Fifty Dollars ( $50 . 00 ) , and each day of said violation shall be deemed a separate offense .
