AN ORDNANCE TO BE ENTITLED " AN ORDINANCE TO ABOLISH THE BOARD OF
MANAGERS OF THE CITY WATER PLANT AND THE SEVERAL WATER IMPROVEMENT
DISTRICTS OPERATED IN CONNECTION THEREWITH AND FOR CIPHER PURPOSES " .
WHEREAS , a question has been raised as to the authority of the
City Council to create a Board of Managers for the purpose of oper-
ating and maintaining the City Water Plant and the several improvement :
Districts used in connection therewith, and
Whereas , the validity of the ordinances of the City of Fayetteville ,
creating said Board of Managers has been questioned.
NOW, THEREFORE , be it ordkined by the City Council of the City of
Fayetteville : '
Section 1 . That the Board of Managers of the City Water Plant and
the several water improvement districts in operation in connection
therewith, be and baid Board is hereby abolished
Section 2 . ' All ordinances and pacts of ordinances in conflict here-
with are hereby repealed and it appearing that under the Statute said
City Council has the authority to operate said plant , an emergency is
hereby declared 'and this ordinance shall take effect from and after its
passage , approval and publication, and said City Council shall . take
over and manage said plant from and after the effective , date of this c c
ordinance *
PASSED and APPROVED this 20th day of December , 1937 .
