WMIMAS, labs have been enacted by the .State of Arkansas which set forth definitions
and prescribe peanities for the violation thereof, which definitions and penalties are
at a variance with existing City ,ordinances and
,WEFZAS, it is necessary that the ordi. names of the City of Falietteville conform with
State laws on the same subject,
NOP7, TH"MMFJRE , BE IT ORDAINSD by the City Council of the City of Faw tteville , Arkansas :
Section 1. It shall be unlavrful and punishable as provided in Sectirn 2 of this Ordinance ,
off' r ony person who is an habitual user of narcotic drugs or any person vrho is under th^
influence of intoxicating liquor or narcotic drugs to drive any vehicle within the corpora-
te limits of the City of Fayetteville , Arkansas .
Section 2 . Every person who is convicted of a violation of Section 1 hereof, shall be
punas a imprisonment of not less than ten days or not more than one year by a fine of
not less than 3100. 00 nor more than 61000. 00 or by both such fire and imprisonment ; and
upon a . second and subsequent conviction, . he shall be punished by imprisonment for not
less than ninety days nor more than $1000.00 .
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed,
ans ordinance being necessary for the preservation of public safety shall be in full
force and effect from and after its passage, approval and publication .
