AND SALE OF MILK AND MILK PRODUCTS : THE INSECTION OF DAIRY HERDS ,
DAIRIES AND MILK PLANTS : THE ISSUTAiG AND REVOCATION OF PERMITS TO
MILK PRODUCERS AND DISTRIBUTORS : THE PLACARDING OF RESTAURANTS AND
OTHER ESTABLISHMENTS SERVING MILK AND MILK PRODUCTS : AND - THE P1. X' tNG.> �

THE CITY 'OF FAYETTEVILLE ORDAINS : -
SECTION 1 . - The production, transportation , processing ,
handling , sampling , examination, grading, labeling , re -grading;
and sale of all milk and milkrproduct &. sold for- ultimate
consmmption within the city* of Fayet -beville , or its police
jurisdiction , the inspection of dairy herds•, dairies , and
milk plants , the issuing and revocation of permits to milk
producers and distributors , the placarding of restaurants
nand other establishments serving milk or milk products, and
the fixing of penalties , shall be regulated in accordance with;
the terms of the 1934 edition of the U . S . Public Health ;
Service Milk �Ordinance , a certified - copy of which shall be on
file in the office of City Clerk ; prdvided that the blank space ,
following the words " Cit-y of ° in, - said Public Health Service
Milk Ordinance shall be understood to refer to the City of

Fayetteville ; provided further that in Section 8 of said . Publi
Health Service Milk Ordinance the secondralternative wording"
shall apply ; providing further that Sections 18 and 19 of said,
Public Health Service Milk Ordinance shall be replaced,
respectively, by Sections 3 and 4 below .
Section 2 . - It shall be unlawful for any person, firm or
corporation to sell or offer for sale in the City of
Fayetteville , Arkansas , any milk or milk products , as defined
in this ordinance , who does not possess an un-revoked permit

from said City . Each Applicant for a permit , under this I

ordinance , shall present to the City Clerk a certificate
showing that each of his cows has been tested for T . B . , and

ina addition thereto shall pay an annual inspection fee ,
I
payable on or before February 1st , of _ each_ -year , of : $7 . 50 ,
provided he has not over 5 cows ; if said applicant has more ;
thanr.5 cows , he shall pay or cause to , be paid a fee of $ . 50
for each additional cow from which such applicant obtains or

proposes to obtain any supply of such milk or milk products .

A maximum fee of $ 100 . 00 is hereby established and in no event
is any applicant required to pay in excess of said maximum
I

SECTION 3 . - Any person , firm or corporation violating any
provision of this ordinance shall upon conviction be punished

by a fine in any sum of not less than $10 . 00 nor more than $100 * j
i
or by any imprisonment in the City Jail for not more than thirty
days , or by both fine and imprisonment .

SECTION 4 . -All Ordinances and parts of Ordinances in conflict with

this Ordinance are hereby repealed ; and this ordinance being
necessary to protect the health , peace and safety of the CitizensI
I
of Fayetteville , Arkansas , an emergency is hereby declared to
exist , and this ordinance shall be in full force and effect
from and after its passage , approval and publication *
