HomeMy WebLinkAboutOrdinance 781 t . ` � . s I ORDINANCE NUMBER 781 . AN ORDINANCE CREATING A CITY PLANNING COMMISSION , PRESCRIBING ! THE NUMBER AND QUALIFICATIONS OF ITS MEMBERS AND DEFINING ITS DUTIES . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYEPTEVILLE, ARKANSAS , as follows : SECTION ONE : in order to direct the future development of the City and encourage its social and economic improvement in accordance with modern City planning principles and to insure the orderly, efficient and economic arrangement and development of future public works. .projects , there is herebycreated a City . planning Commission . SECTION TNIO . MEMBERS : The City Planning Commission shall consist of nine ( 9 ) members , including the Mayor ( or City Manager ) , City Engineer, and a member of the City Cluncil , the latter to be select - ed by the Council from among its members . The other six members shall be citizens qualified by experience or knowledge to act upon matters pertaining to the physical , socail and economic ' development of the City . The citizen members shall be appointed by the Mayor , and in the first instance three ( 3 ) members shall be appointed for a period of two years ; three for four years , and . thereafter all appointments shall be made for terms of four years . Appointments to fill vacancies shall be. for unexpired terms only . Any member of the Commission , except the member of the City j Council , may beremoved by the Mayor at any time for due cause shown . All members shall serve without compensation . SECTION THREE . PROCEDURE : The Commission shall elect from among its citizen members , its own Chairman, Vice -Chairman , Secretary and Treasurer and may , from time .to , time , adopt such rules and regulation not inconsistent with existing laws of the State , for its own organization and procedure as it may deem proper . SECTIov FOUR . DUTIES : The duties of the Commission shall be to prepare a comprehensive plan or plans showing its idea and recom - mendation for the physical development of the City : to provide such programs , drawings , maps or plans covering the whole or any portion of said City and of any lands outside of said City which, in the opinion of the . Commission , bears relation to the development or welfare of the City and said plan or plans shall show the Commission ' s idea and recommendations relative to the location, width and arrangements of streets , alleys , bridges , grade separations , parks , parkways , playgrounds , Schools , public institutions or other public grounds or improvements ; the grouping of public buildings , the design and placing of any memorials or works of art ; transportation facilities , such a railroad, railways and motor ; street appubtenances , including lighting standards street name signs , poles and wires , projecting signs and the like ; zoning plan and ordinance for the classification and regulation of land uses and open spaces about buildings ; and any other matters pertainin to the social and economic improvement of ' said City or any portion thereof . SECTION FIVE . SUB-DIVISION TF LARD : All plans and plats for the sub -division or re -subdivision of land into streets and /or buildings lots shall be submitted to the City Planning Commission for its recommendation before final acceptance or approval by the City . Such recommendations by the Commission shall be made within fifteen ( 15 ) days and failure to do so shall constitute a waiver of its rights to pass upon such plan or plat , SECTION SIX . PUBLIC WORKS PROGRAM . : It shall be the duty of the City Planning Commission to prepare and submit an annual public works program to the Mayor and City ' Council on the first day , of Jany . MICROf yO isieof each year , and it shall be the duty of each and every City , DA1E�— Department or Agency to furnish the Commission, upon request , any REEL data , plans , estimates or , programs and to collaborate with the said Commission in the preparation of wuch public works programs . ; J '1 SECTION SEVEN , REPORTS : The Commission shall make an annual report during the month of February to the Mayor and City Council , covering their investigations and recommendations , and such other reports relative . thereto as it may deem proper or as requested by the Mayor or City council amd said Commission may employ such City planners , engineers , architects , clerks and other persons , whAse salaries and compensations and other necessary expenses of said Commission and its members shall be provided for at the discretion of the City , Council by the proper appropriations or ordinances of said City Gouncil is hereby authorized. to do so in any manner not inconsistent with the laws of the State of Arkansas . SECTION EIG3T : LEGISLATION : It shall also be the duty of the t Commission to prepare and recommend such national , state and municipal legislation as may be necessary in carrying out the recommendations or suggestions of , the Commission . SECTION NINE . EFFECT : . This ordinance shall take effect and be in force from and after its passage and approval by the Mayor . Attest : Approved : City Clerk . Mayor . Published in the .
