AN ORDINANCE 0 BE ENTITLED , " AN ORDINANCE TO PROHIBIT THE RUNNING AT LARGE
OF DOGS , TO ' PROVIDE FOR THE TAKING UP AND THE DISPOSITION THEHEOF , AND
PROVIDING THE FINES AND PENALTIES FOR THE VIOLATION " .
BE IT ORDAINED BY THE .CITY COTJNCIL OF THE CITY OF FAYETTEVILLE ,ARKANSAS :
SECTION ONE . That it shall be unlawful for the owner of any dog, or dogs , or
any person heving ' charge of any dog or dogs , to allow or permit such dog or
dogs to run at large upon any premises or street within the corporate limits
of the City of- Fayetteville , Arkansas , during the months of April ,
June , July , August end September of each year .
SECTION Two • It is ' hereby made the duty of each police officer of this City ,
To take into custody any ,and all dogs that may be found running at large
within the corporate limits of said city ' during the months of April , May ,
June , '"July , August, ortSeptember of each year , and to place the same in the
City Dog -ZZ� hereinafter provided for .
SECTION THREE* It is hereby made .the duty of the mayorof the City of Fay-
etteville to provide a suitable place to be used ,known and designated as
the " City Dog , " to carry out the provisions of this ordinance .
SECTION FOTJR . After the xation of five days after any dog has been'
placed i-d�fie . City Dog , as herein provided for , it shall be the duty
of the police officer in charge to kill such dog and dispose of the carcase ,
and the day of taking up of such dog shall be counted the first day .
Provided the owner of any dog may within the five days above provided for ,
or at any time ' before the dog is killed , redeem or clgim . such dog and have
the same ddiivered to him upon the payment of the costs of such taking up
which is ascertained to be fifty cents ( 50 ¢ ) for each day such dog has been
in the City Dog �to the officer in charge or the city collector .
SECTION FIVE : All fee received by any police officer as provided for in
section fottr ( 4 ) of this ordinance ; and all fines assessed and collected
for the violations of this ordinance shall be paid to the city collector
to be kept separate in a f:m d to be known as the Dog Fund to pay the expense
of enforcing / this ordinance as the council may ,by motion direct .

SECTION SIX * whenever any dog has been placed in the c 'D9s provided for
In section Iwo ( 2 ) that has on a collar bearing a City License Tqg , it
shall be the duty of the officer in charge of such dog to notify the owner
or the person to whom the license Tag was issued by the city collector , if
such person or owner cana ound , that the dog has been taked up and
placed in the City Dog and will be killed within five days unless the
fee is paid as provided in section four ( 4 ) of this ordinance .
SS6T16H SEiJBii : It is ascertained by the . city council that the provisions
of this ordinance are separate and independent , and if any word * clause ,
sentence or section should be -declared void by a court of competent juris
diction that it shall not interfere with the remaining provisions hereof .
SECTION EIGHT . Any person or persons violating any of the provisions of
section one of this ordinance , shall upon conviction before the police
judge', be deem guilty of a misdemeanor and fined in any sum not less than
Five Dollars nor more than' Fifteen Dollars
SECTION NINE . It is further declared by the City Council that this ordinance
is ntended to be acctunulative to the ordinances now in force and repeals
only such ordinances and parts of ordinances as are in direct .conflict
herewith
