ORDINANCE NUMBER
AN ORDINANCE TO BE ENTITLED , ° AN ORDINANCE TO PROVIDE FOR THE
REMOVAL BY THE CITY COUNCIL OF ANY ELECTIVE OR APPOINTIVE OFFI*
CER OF THE CITY OF FAYETTEVILLE ,ARKANSAS , FOR INEFFICIENCY , MIS -
CONDUCT , INSUBORDINATION , NEGLECT , OR FAILING TO FAITHFULLY DIS -
CHARGE THE DUTIES OF HIS OF-HIS OFFICIAL OFFICE ; TO PROVIDE FOR
THE PROCEEDURE AND HEARING BY `THE CITY COUNCIL OF THE CHARGES ,
AND FOR OTHER PURPOSES " *
BE IT ORDAINED BY THE CITY COTNCIL OF THE CITY OF FAYETTEVILLE ,
ARKANSAS :
SECTION ONE : That if any official either elective or appointive
of the City of Fayetteville , Arkansas ,, shall be guilty of Miscon -
duct , inefficdency , insubordination , neglect , or failing to fsith-
fully discharge the duties of his official office , may be removed
from office by the city council in the manner and form \as herein -
after provided .
SECTION TWO : The Mayor , or any three Aldermen of said city , who
have information , or reasonable cause to beleive that any official
of the City of Fayetteville , Arkansas , as set forth in section one
of this ordinance , is guilty of official misconduct in office , and
has failed to faithfullydischarge the dut"fes of his office , may
file with the City Clerk of said City , a written accusation or com-
plaint against said official to . be proceeded against , stating in
plain language the charge or complaint to be answered ; and a copy
of said complaint shall be served on said official by the chief of
police , who shall file his affidavit of service with the City Clerk .

SECTION THREE : . After the written accusation or complaint has been '
served for three days on the official charged , the city council
shall at an adjourned session or at its next regular meeting, shall
hear the complaint , and the defense , if any , and upon a concurrent
vote of two thirds of all aldermen elected to the city council , a
member of the city council or any elective officer of said city . or
of any ward or districj of said city may be removed from office ;
and upon a concurrerlt vote of a majority of all aldermen elected -to
the city council of said city , an appointive official of said city
or any ward or district thereof may be removed from office . In
event any official is removed from office as provided for herein
the vacancy shall be filled as is now provided by law for filling
such vacancies .
SECTION FOUR : All ordinances and parts .of ordinances in conflict
herewith are hereby repealed and this ordinance shall be in force
and effect , from and after its passage , approval and publication * .
