l7hereas , the City Council of the City of Fayetteville , Arkansas
granted unto John McCullough August 27th , 1928 a fifty year gas fran-
chise ; and whereas more than 15% of the qualified electors of the City
of Fayetteville , <:rkansas petitioned that said franchise be put to a
vote of the people ,- as provided by Amendment No . 13 of the Constitution
of Arkansas ; and whereas the Mayor of the City of Fayetteville , Arkansas
then issued a proclamation directing that said special election be held
January 21st , 1929 as provided by law ; and whereas said election was held
according to law on the date set ; and whereas the County Election Board
has certfied unto the City Council that said franchise was defeated by
the vote of the people NOW THEREFOER BE ITORllAIT1ED- BY THE CITY COUNCIL
OF THE CITY . 011 FAYETTEVILLE , ARP,AN'SAS :
Section 1 . That all rights granted to John McCullough under odinance
number 692 are hereby declared to be null and void and that ordinance
number 692 granting a gas franchise for a term of fifty .years to John
McCullough is hereby declared to be repealed and held for r_alu ht .
Section 2 . That this ordinance shall be in force and effect from
and after its passage , approval and publication , and all ordinances or
parts of ordinances in conflict herewith , be , and the same are hereby
repealed .
