'6HEREAS , a number of years ago there uas duly created in the City of
Fayetteville , Arkansas , an Improvement District known as Water Improve-
ment District No . 1 of the City of Fayetteville , Arkansas ;
WHEREAS, bonds were duly issued by the duly appointed Board of Improve-
ment, and said Viater Plant use duly constructed ;
+HEREAS , each and all of said bonds have duly paid off and retired ;
WIIEREAS , the City Council of the City of Fayetteville , Arkansas now
elects to exercise its rights under the law and take over said Water
Plant for the purpose of naming a way to manage the same ;
N%; , THEREFORE, BE IT ORDAINED BY Tffir CITY COUNCIL OF' F'AYETTEVILLE , ARK :
1. That the full management, operation, and control of the *dater
Plant of Viater Improvement District No . 1 of the City of Fayetteville ,
Arkansas be , and the same is hereby taken over by the City of . Fayette-
ville , Arkansas to be managed, operated, and controlled as hereinafter
set forth.
2 . That the management, operation, and control of said Viater Plant
of Water Improvement District No 1 of the City of Fayetteville, Arkansas
be turned over to a Board of Managers consisting of J. H. McIlroy, Li . J .
Lewis , C . Vi. Appleby, B. F. Campbell, and James 'English, qualified
electors of the City of Fayetteville, Arkansas under the general super-
vision and direction of the City Council of the City of Fayetteville ,
Arkansas ,
3. Within ten days after the passage , approval , and publication of
this ordinance , said Managers shall take the oath of office required by
the Constitution and laws of the St<•.!te of Arkansas, and shall forthwith
meet at some convenient place , by notice to each member, and proceed to
organize by electing one of their number as Chairman, and such other officers
as they may see fit--said Board of. Hanagers to adopt their own rules with
reference to the time of meeting and procedure of business .
4. The said City Council specifica7.ly reserves the right to at any
time dispose of the services of either one or all of said Board of tanagers
vita or without d'ause , and with or without a hearing being given them,
after ten days notice has first been given such member of said Boards and
said Doard shall be subject, at all times , to the directions of the City
Council of the City of Fayetteville , Arkansas ,
5. This Ordinance shall take effect and be in force from and after
its passage , approval, and publication and all Ordinances and parts of
Ordinances in conflict herwith be and the same are hereby repealed .
