Sec . 1 . That hereafter it shall be unlawful for any person, firm, or
corporation to dig into arW paved or otherwise permanently improved street
within the corporate limits of the City of Fayetteville , Arkansas without
first having filed with the Mayor and City Council, a written application
for permission to so dir into such street, and without having obtained from
said Mayor and City Council such permit.
Provided, that said Mayor and said City Council shall not under any
circumstances issue any such permit until said applicant shall have
deposited with the City Treasurer a cash bond, for the purpose of
guaranteeing tha replacemefs0 of said street in as good condition as the
same was before the same was dug into by the said applicant, paid cash
bond shall be in any amount fixed by the City Engineer of the City of
Fayetteville,Arkansas , not less than Fifty (W50. 00 ) Dollars , nor more than
One Thousand (;;1,000. 00) Dollars .
Sec . 2 . If any person, firm, or corporation shall so dig into such
street, the same shall be papaired by such person, firm, or corporation,
at his own proper expense, and in a manner to be approved by the City
Engineer of the City of Fayetteville, Arkansas . Provided, when such repair-
ing is so made and approved and paid for, then the said City Engineer shall
authorize the City Treasurer " pay back to said applicant the sue so
deposited by him, less the fee of the City Engineer to be fixed by the City
Council. In case said applicant shall fail, refuse, or neglect to repair
said street, then in that event the said City of Fayetteville , or its
designated agent, shall repair said street, paying for as= out of the
money so deposited by said applic4rt, with said City Treasurers and the
balance of the money, if any, shall then be returned by said City Treasurer
to said applicant.
Sec . 3. Any person, firm, or corporation violating ary of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be fined in any sum not less than One Hundred (9)100. 00) Dollars
nor more than One Thousand ( 1s000.00 ) '.Dollars .
Sec . 6. That all Ordinances and parts of Ordinances in conflict herewith
be and the same are hereby repealed , and this Ordinance shall take effect and
be in force from and after its p04;,age , approval, and publication.
