AN ORDINANCE TO PROVIDE FOR•THE REMOVAL OF PUTRID SUBSTANCES WHETHER VEGETABLE OR
ANIMAL, FROM PRIVATE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE ,
ARKANSAS.
SECTION 1. It is hereby made the duty of the City Health Officer to at all time see
that no putrid substances , whether vegetable or animal are allowed to remain upon any
lot or lots within the corporate limits of the said City.
SECTION 2 . The City Health Officer is hereby directed to cause written notice to be
served upon the owner or agent of any real estate upon which there is any putrid sub-
stance, whether animal or vegetable, ordering such putrid substance removed within a
reasonable time to be fixed in said notice , but in no event to exceed one week from
date of service . If the owner or agent cannot be found, said notice shall be posted
on the real estate upon which any putrid substance shall be located. The City Health
Officer may also order any lot or lots to be raised, filled up or drained by like order
and service .
SECTION 3 . In the event the owner of any such lot or lots shall fail, neglect or refuse
to comply with the order of said Health Officer within the time as fixed in said notice
then it shall become the duty of the City Health Officer to at Na once report the
matter to the City Council , The City Council may by resolution proceed to carry the
orders of the City Health Officer at the expense of the City which expense shall be a
debt due said City from the. o ner or owners of such real estate , and shall from date of
such resolution be a loin upon the real estate affected, Such amount , plus 5 per centum
for collection together with cost off suit shall be oolleoted as provided by Section 5459
of Kirby ' s Digest of the Statutes of Arkansas . Provided, nothing herein contained shall
prevent the enforcing of such orders of the City Health Officer by other means provided
by law.
SECTION 4. It shall be the duty of the City Health Officer to report to the Council once
each month the number of notions served, upon whom served and results obtained.
SECTION $. The term (Putrid Substance ) as used herein is meant to include and does in•
olude all trash offal, oans , litter, dirt , filth, weeds , underbrush, stagnant and running
water, and all substances the presence of which in the City is a menanoe to publio, 1
health or is apt to become a nuisance .
SECTION 6 . That this Ordinance be in force and effect from and after its passage • appro-
val and publication and ordinances or parts thereof in -conflict herewith be and the
some are hereby repealed. Provided, nothing herein contained shall be so construed as
to repeal Ordinanoe Number 155 passed and approved August 6th, 1905 .
