AN ORDINANCE PROVIDING FOR THE ASSESSMENT AND COLLECTION OF BENEFITS
UPON REAL PROPERTY LOCATED WITHIN LAFAYETTE AVENUE IIMROVEMENT DISTRICT
NUMBER ONE OF FAYETTEVILLE , ARKANSAS .
WHEREAS , the majority in value of the property holders owning property
adjoining the locality to be affected and situated in Lafayette Avenue
Improvement District Number One , organized for the purpose of grading ,
draining , rolling , mocadamizing Lafayette Avenue , from Olive Street to
College Avenue ; and for . the construction of curbs and gutters along
said part of said avenue , have petitioned this council of the City of
Fayetteville for the construction of said improvement , and that the
cost thereof shall be assessed upon the real property of said district
according to benefits received; and
WHEREAS , said benefits received by each and every block , lot and parcel
of real property situated in said district equals or exeeedo the local
assessment thoreof ; and
WHEREAS , the estimated cost of said improvement is $4 , 500 ;
THEREFORE , it is now ordained by the City Council of the City 6f
Fayetteville , Arkansas , that said several blocks , lots and parcels of
real property in said district be assessed according to the asnesement
list for said improvement district as the same now remains in the office
of the City Clerk , and that 20 per centum of said blocks , lots and
parcels shall be paid annually on or before the IOth day of June until
the whole of oaid local assessment shall be paid .
And said local assessment shall be a charge and lien against all the
real property in said district from the date of said ordinance , and shall
be entitled to preference over all judgments , executions , inopmbrances
or liens whensoever created , and shall continue until such local assess-
ment , with any penalty and costs that may accrue thereon , shall be paid;
provided , as between grantor and grantee all payments not due at the date
of the transfer of such real property shall be payable by the grantee .
That this ordinance be in effect and force from and after its passage ,
approval and publication and all ordinances or parts thereof in conflict
herewith be and the same are hereby repealed .
