To be entitled ,
An ordinance to tax dogs owned or kept in the
City of Fayetteville Arkansas .
Be it ordained by the City council of ' the City of Fayettoville
Arkansas .
Section 1 . That there shall be collected on every dog owned or kept
in the City of Fayetteville Arkansas a tax of $1 . 50 per annum, except
female dogs on each of which the tax shall be $5 . 50 per annum which tax
shall be paid to or collected by the Chief of Police of said City; the
period for which such tax shall be paid shall and on the 31st of December .
each year. Every person owing or keeping a dog within the corporate limits
of' said City of Fayetteville shall apply to the Chief of Police of said
City and upon payment to him of the said sum of $1 . 50 for each male dog
owned or kept by him and the sum of $5 .50 owned or kept by him shall
receive a receipt for the sum paid and shall be furnished with a tag
showing that such sum has been paid which tag shall be attached by the owner
or keeper to the dog for which payment was mado , by a collar securely
fixed around the neck of such dog.
Every person owning or keeping a dog or dogs . in the said City of
Fayetteville without paying the tax herein provided or keeping the tag
evidencing such payment attached to such dog shall be subject to a fine
of not less than $5 .00; provided , that no person shall incur this penalty

until five days after he has been notified by the Chief of Police of his
liability to pay said tax and the failure thereafter to pay the same .
Section 2 . That where dogs owned or kept in the City of Fayetteville
are found about any promises or in the streets of said City of Fayetteville ,
after the Ist day of February of each year on which no taxes have been paid
or to which no tax is attached as required in section 1 of this ordinance ,
it shall be the duty of the Chief of Police of the said City of Fayetteville
to verbally notify the person in charge of such promises or the owner or
keeper if known of any dog found upon the %treats of the City to come

forward within three days and pay said tax and unless such person so notified

shall disclaim any ownership in such dog by himself or any member of
his family when so notified shall fail for three days aftor such notification
to pay the tax on the dog he shall be guilty of a violation of this
ordinance and punishable as provided in section 1 thereof .
Section3 . That if the owner of said premises or person in charge thereof
shall disclaim any interest in such dog or claim thereto by any member of his
family or if the owner or keeper of any dog found upon the streets of the
City be unknown it shall be the duty of the Chief of Police to employ
some competent person who shall take charge of said dog and keep the same
in some convenient place in the City of Fayetteville for a period of 24
hours and if during that period no person shall pay the tax on such dog
then it be the duty of the person so employed to kill the dog so kept by
him and bury the carcas in a place designated for such purpose by the
City council.
It shall be the duty of the said Chief. of Police to contract with such
person on the best and most resonable terms that may be with reference to Ilia
impounding and killing of dogs as herein provided not exceeding fifty conte
per head .
Section 4. That it shall be the duty of the Chief of Police of the City
of Fayetteville to procure a sufficient number of tags for the do4s in said
City and that he shall furnish the same to all persons who apply thereof
on or before the first day of February of each year at and ofr the sum of $1.00
for each male dog and the sum of $5 . 00 for each female dog in the City.
After the first day of February in each year all persons liable for
such tax shall pay the full amount of the tax required by sextion 1 of this
ordinances to wit : $1 . 50 for each male dog and $5 . 50 for each female dogs
provided; that where a dog is,-brought into the City after the said 1st
r \day of February ;J the person liable for the tax on ouch dog shall have
days in which to pay the said $1 .00 if a male dog or if a female dog
and failing to pay the required tax within such period he shall be required

it shall be . the duty of the Chief of Police to notify all persons
in the City liable for the tax herein provided to pay the same within
five days from the date of such notice and if the same is not so paid
to take such steps as herein provided for the enforcement of this
ordinance and the collection of such tax .
Section 6 . At the first regular meeting of the City council in each
month it shall be the duty of the Chief of Police to submit a report
showing in detail all collections made by him under this ordinance during
the preceeding month and that he has deposited the same in the City
treasury to the Credit of the general revenue fund .
Section 7. That ordinance 145 passed by the City council July, 26th,
1904 and all other ordinances or parts of ordinances in conflict herewith
be and the same are hereby repealed and this ordinance shall take effect 0�
and be in force from and after its passage and publication.
