An ordinance to secure for the City of Fayetteville , from Washington
County Arkansas , the supervision , use and control of the public square
in said City for a public park , and the right to offices in the court
house of said County for City pur" oses .
Whereas the county Court of Washington County Arkansas , is
about to con¢aonee the erection of a suitable court house , which when
compl:oted , 1.-:ill be of sufficient capacity to furnish two rooms or offices
for City purposes after furnis'rinL ample accomodations to the courts
and offices of said County , and
Whereas it . is desirable that such court house be erected
upon -some suitable location to be selected' by said county court within
one and ono half blocks of the prssonr court house and that said City
have the use , supervision and . control of tha present public square for a
public park , and
iV.heraas the county court of said county proposes to turn
over to said City the control and supervision of said public square for
the period of ninty nine ( 99) years for the purposo of using and maintaining-'
tha sane as a public park for the use and benefit of the people of
said City and county and further proposes to furnish to said City two
rooms or offices for the use of said City and its offices for the period
mf twenty ( 20) years in consideration of the sum of five thous.urd ( $5 ,000) ,
to be paid said County as hereafter provided . ., . .,
Therefore , be it ordained by the City council of the City of
Fayetteville Arkansas ,
Section 1 . That in consideration of the use , control and su—
pervision by said City of the present public square therein for a public
park , for the period of ninty nine ( 99) years and the further use and
occupancy by said City of two suitable ro61s or offices in the basement
story of said proposed court house for City purposes for the period of
twenty ( 90) years , said City to pay to said County of Washington said sum
of five thousand ( $5 ,000) dollars in the manner provided in section 2 of

this ordinance ; provided that said county shall have the right to use and
control the present court house and public square until said proposed
court house shall be completed and shall have a reasonable time after the
completion of such now court house to remove all brick and other material
from its present court house , and provided said County may use for Jury pur—
poses said two offices in said basement during the session of
tine Circuit Court .
Section 2 . Said sum of five thousand ( 5 ,000) dollars shall
be. due and payable in ton equal annual installments of five hundred
( $$500) each , the first installment of five hundred ( 500) dollars shall
be due and' payable on the 15th day of July , 190$ and the sum of five hun—
dred dollars on the 15th day of July of each year thereafter until said
sum of five thousand ( 5 ,000) dollars shall have been paid .
Suction 3 . If said court houso from any cau:,e be not comple—
ted within three years from Jan . lot , 1903 , and the present court house
be not removed' from the presont public square within six months from the .
dato of completion of said new court houso , said county shall refund to
said City all moneys paid to said county under and by virtue of this
ordinance ; and shall surrender to said City any and all. warrants or other
evidences of indebtedness issued by said City under this ordinance .
Section 4 , Upon the acceptance of the provisions of this
ordinance by the county court of Washington County , the same shall be and
become a binding contract between said county and said City; and there—
upon demand of the county judge of said county , tis recorder of
said City shall issue to said county , warrants for the amounts , and pay-
able as provided in section 2 of this olidinance .
Section 5 . That this ordinance take effect and be in force
from and after its passage and publication .
