HomeMy WebLinkAboutOrdinance 111 AND ORDINANCE TO IMPROVE THE SANITARY CONDITION OF THE CITY OF FAYETTEVILLE , Be it ordained by the City Council of the City of Fayetteville Arkansas . Section , l . That upon the complaint to any one of the board of health of the City of Fayetteville of any matter , �Opsubstance , thing act or practice within the corporate limits or within one mile beyond the corporate limits of said city , which in its natural effects , is or may become dangerous , injurl6us or detrimental to the health of the inhabitants of said city , it shall be the duty of the board of health to examine such matter , substance , thing, act or practice and if the same is found to be dangerous , injurious or detrimental to the health of the inhabitants of said city , to declare the same a nuisance and order the same abated , discontinued or removed . Section 2 . If the board of health shall declare as a ` nuisance any matter , substance , thing , act or practice within the corporate limits or within one mile beyond the corporate limits of the city of Fayetteville , then it shall be the duty of the City Marshal or the Sanitary Police of said City to notify the person or persons who may be responsible for such matter , sub- stance , thing , act or practice or upon whose premises such matter , substance , thing, act or practice , may exist , that the same has been declared a nuisance and order it abated . Section 3 . If such nuisance is not abated , discontinued � CLr removed within twenty four hours after a notice in writing has been served upon such person or persons responsible for such nuisance or upon whose premises such nuisance -exists or who may be in porosession or control of such premises , then it shall become the duty of the City Marshal or the Sanitary police to abate , discontinue or remove the same at once . Section 4 . Section 5 . That all ordinances or parts of ordinances in conflict with this ordinance be and the same are hereby repealed and this - Ordinance to take effect and be in force from and after its passage and publication .
