the North Arkansas and Western Railroad Company ; his sucessors ,
grantees or assigns , the right to lay all necessary track on
and occupy the old P & G . E . right of way and operate and
maintain a railrpad through the City of Fayetteville Arkansas
over and across all streets , alleys and highways necessary for the

construction and maintainance and operation of a railroad passing
through that portion of the city of Fayett6ville Arkansas , from
Spring Street South , along the P & G . E . right of way .
Be it ordained by the City Council of the City of Fayetteville
Arkansas ,
Section 1 . That W . A . Bright as trustee for himself and the
North Arkansas and "estern railroad Company and his successors ,
grantees and assigns be , and he as such trustee , is hereby the
right , privilege and authority to lay , build and construct and
maintain all necessary railroad tracks ' and side tracks and to use
and occupy for railroad purposes all otrebts and alleys so far
as is necessary to build , operate and maintain a railroad on the
old Pacific and Great Eastern right of way within the corporate
limits of the City of Fayetteville Arkansas , and to use and
occupy all streets along the said right of way,,, including all
other streets , road ways and alleys , needed toconstruct , build
operate and maintain said railroad to and from the crossing
11 Irk of Spring Street in the City of Fayetteville Arkansas .
Section 2 . That Ci . A . Bright as such trustee for himself and
the North Arkansas and Western Railroad Company , and his successors
grantees and assigns , be and is hereby grcnted the right , privilege
and authority , to lay , build , construct and maintain all necessary
railroad tracks and side tracks over and across Spring Street ,
Meadow Street , Center Street , Rock Street , South Street , West
Street , South of Spring Street , Gregg Street , The National

Cemetery road , and all other streets , roads , lanes and alleys
necessary to be crossed in constructing in and out of the
corporate linits of the City of Fayetteville Arkansas , a rail -
road , provided that said tracks at each of said crossings , shall
be so constructed , built and maintained as not to unnecessarily
obstruct or impede the usual travel on any of said streets , lanes
road ways or alleys and provided further that said road at its
oun expense make all proper and suitable cvossings on said streets
and do and perform all necessary labor so as to make the grafle .
of the said strdet crossins properly conform to the grade of the
said railroad tracks .
Section 3 . That all ordinances or parts of ordinances in
conflict with this ordinance be and the same are hereby repealed
and that this ordinance thke effect from and after its passage ,
November 17th , 1899 . Ordinance No , 105 .
