1. OPEN AVENUES, INC: A resolution to approve a lease agreement of a portion of the
airport with Open Avenues, Inc.

2. UPCHURCH ELECTRICAL SUPPLY COMPANY: A resolution to authorize the
purchase of a variable frequency drive from Upchurch Electrical Supply Company, a
division of Mayer Electric Supply Company, Inc. in the amount of $18,468.51 plus
applicable taxes for use at the Hamestring Lift Station.

3. ALLGEIER, MARTIN AND ASSOCIATES, INC.: A resolution to approve

electrical work at the Noland Water Resource Recovery Facility.

5. MARCK RECYCLING AND WASTE SERVICES OF NW ARKANSAS, LLC: A
resolution to approve an agreement with Marck Recycling and Waste Services of NW

Fayetteville.

6. BOARD OF TRUSTEES OF THE UNIVERSITY OF ARKANSAS: A resolution to
approve a services agreement with the Board of Trustees of The University of Arkansas
acting for and on behalf of the University of Arkansas for Medical Sciences’ Psychiatric
Research Institute, Arkansas Employee Assistance Program for employee assistance
program services for police, fire, and community resources employees in the amount of
$26.00 per covered employee.

7. RFQ 18-09 IMS INFRASTRUCTURE MANAGEMENT SERVICES, LLC: A

and to approve a project contingency in the amount of $15,000.00.

8. GAMETIME C/O CUNNINGHAM RECREATION: A resolution to approve the
purchase of bleacher covers from Gametime C/O Cunningham Recreation for the Kessler

cost of installation, pursuant to a U.S. Communities National Cooperative Purchasing
Program Contract.

9. HARK AT THE CENTER FOR COLLABORATIVE CARE: A resolution to approve
an agreement with Hark at the Center for Collaborative Care for the establishment and
management of the help a neighbor fund, and to approve a budget adjustment in the amount
of $5,000.00 to pay for the staff time utilized for the establishment and management of the
fund.

10. AXON ENTERPRISES, INC.: A resolution to accept and agree to a quote from Axon
Enterprises, Inc. for the purchase of body worn cameras and software pursuant to a
National IPA Contract in the amount of $6,787.84 for 2018-2019 and $2,910.36 annually
for the following four years for a total of $18,429.28 and to authorize Mayor Jordan to sign
this quote.

B. Unfinished Business:
1. RZN 18-6317 (WEST OF MARKHAM RD./MARKHAM HILL): An ordinance to
rezone that property described in rezoning petition rzn 18-6317 for approximately 119.43
acres located west of Markham Road from rsf-4, residential single family, 4 units per acre
and cpzd, commercial planning zoning district to rezone approximately 75.42 acres to ri-
u, residential intermediate-urban and approximately 44.01 acres to r-a, residential
agricultural, subject to a bill of assurance.

2. C-PZD 18-6318 (2231 W. MARKHAM RD./PRATT PLACE INN & BARN): An
ordinance to approve a commercial planned zoning district entitled c-pzd 18-6318 for
property located at 2231 West Markham Road reducing the existing 68.99-acre commercial
planned zoning district to 24.06 acres while retaining the existing uses, and adding up to
5,000 square feet of event space, 12,000 square feet of restaurant or commercial space, 80
hotel rooms, and 43 dwelling units.

C. New Business:
1. WALTON ARTS CENTER CURRENT PAYMENT FOR SERVICES: A resolution
to express the intention of the city council to divide the current payment for services to the
Walton Arts Center into three equal payments to the Walton Arts Center, Theatresquared,
Inc. and to the city for infrastructure improvements in the Entertainment District Parking
District.
THIS RESOLUTION WAS TABLED INDEFINITELY.
2. MCCi, LLC: An ordinance to waive the requirements of formal competitive bidding and
authorize the purchase of additional Laserfiche user licenses and modules, annual software
maintenance, and future software and service needs through the end of 2022 from MCCI,
LLC in an amount not to exceed $90,000.00 plus applicable taxes.

3. JCI INDUSTRIES, INC.: An ordinance to waive competitive bidding and accept a repair
quote of $14,570.00 plus applicable taxes from JCI Industries, Inc. to repair a wastewater
pump used at the Gregg Street Sewer Lift Station.

4. RZN 18-6308 (1400 & 1424 N GREGG AVE/BIRGIN): An ordinance to rezone that
property described in rezoning petition rzn 18-6308 for approximately 0.39 acres located
at 1400 and 1424 North Gregg Avenue from rsf-4, residential single family, 4 units per
acre to ri-12, residential intermediate, 12 units per acre.

5. RZN 18-6330 (1101 S BEECHWOOD AVE/ASPEN HEIGHTS PARTNERS: An
ordinance to rezone that property described in rezoning petition rzn 18-6330 for
approximately 13.26 acres located at 1101 South Beechwood Avenue from i-1, heavy
commercial & light industrial to cs, community services.

6. REPEAL ARTICLE XXVIII CITY BOARD OF HEALTH: An ordinance to repeal
Article XXVIII City Board of Health in Chapter 33 Departments, Boards, Commissions
and Authorities of the Fayetteville City Code.

at City Council meetings. If you wish to address the City Council on an agenda item, please wait for the Mayor or Chair to
request public comment then queue behind the podium. When the Mayor or Chair recognizes you, approach the podium and
give your name and address. Comments are to be addressed to the Mayor or Chair. The Mayor or Chair will direct your
comments to the appropriate elected officials, staff, or others for response. Keep your comments respectful, brief, to the
point, and relevant to the agenda item being considered. Each speaker from the public will be allowed one turn at the
microphone for discussion of an agenda item.
Below is a portion of the Rules of Order and Procedure of the Fayetteville City Council pertaining to City Council meetings:
Agenda Additions: A new item which is requested to be added to the agenda at a City Council meeting should only be
considered if it requires immediate City Council consideration and if the normal agenda setting process is not practical. The
City Council may only place such new item on the City Council meeting’s agenda by suspending the rules by two-thirds
vote. Such agenda addition shall be heard prior to the Consent Agenda.
Consent Agenda: Consent Agenda items shall be read by the Mayor and voted upon as a group without discussion by the
City Council. If an Alderman wishes to comment upon or discuss a Consent Agenda item, that item shall be removed and
considered immediately after the Consent Agenda has been voted upon.
Unfinished Business and New Business:
Presentations by Staff and Applicants: Agenda items shall be introduced by the Mayor and, if an ordinance, read by the City
Attorney. City staff shall then present a report. An agenda applicant (city contractor, rezoning or development applicant,
etc.) may present its proposal only during this presentation period, but may be recalled by an alderman later to answer
questions. City staff, City Council members, and applicants may use electronic visual aids in the City Council meeting as part
of the presentation of the agenda item.
Public Comments: Public comment shall be allowed for all members of the audience on all items of old and new business and
subjects of public hearings. A simple majority of the City Council members, present and voting, may authorize a
representative of a Fayetteville citizens' group opposing the ordinance or resolution to present an electronic visual aid not to
exceed five minutes, but no other electronic visual aid presentations will be allowed; however, the public may submit photos,
petitions, etc. to be distributed to the City Council. If a member of the public wishes for the City Clerk to distribute materials
to the City Council before its meeting, such materials should be supplied to the City Clerk's Office no later than 9:00 A.M. on
the day of the City Council meeting. Any member of the public shall first state his or her name and address, followed by a
concise statement of the person's position on the question under discussion. Repetitive comments should be avoided; this
applies to comments made previously either to the City Council or to the Planning Commission when those Planning
Commission minutes have been provided to the City Council. All remarks shall be addressed to the Mayor or the City Council
as a whole and not to any particular member of the City Council. No person other than the City Council member and the
person having the floor shall be permitted to enter into any discussions without permission of the Mayor. No questions shall
be directed to a City Council member or city staff member except through the Mayor.
Courtesy and Respect: All members of the public, all city staff and elected officials shall accord the utmost courtesy and
respect to each other at all times. All shall refrain from rude or derogatory remarks, reflections as to integrity, abusive
comments and statements about motives or personalities. Any member of the public who violates these standards shall be
ruled out of order by the Mayor, must immediately cease speaking and shall leave the podium.

Dear City Council,
I wish to voice my objection to rezoning the Markham Hill area under discussion for redevelopment. The increased commercialization from business
as well as the addition of more residential units will eliminate green space that provides a huge number of benefits to the environment. I used to live
on Hornsby Drive just off of Markham Road and over the 30 plus years we lived there, intrusions from UA sports events and traffic steadily
increased.
Watching the flooding and destruction produced by Harvey and now Florence, we can see the effects of over development and the elimination of
green wooded areas that provide protection from flooding, soil erosion and runoff.
I urge the city council to put long term environmental concerns above the quick gain of profits to developers by voting no to rezone the property in
question.

As it is currently zoned, I and my neighbors of this area will be subjected to
greatly increased traffic with very few streets in and out of this large scaled plan
along with a clear cutting of significant proportions. At the current RS4 for 72
acres, we would see approximately 280 new homes built and see and experience
all of the traffic from these residents as they travel by car. At my home, we have
four cars for four people. 280 houses with a similar make up would involve about
1,000 extra cars traveling through our neighborhood. Only one street extension is
planned and that doesn’t seem safe enough.
With Seth’s plan of changing the zoning to RIU, this would put upwards of 11
homes/apartment complexes per acre. That is over 500 homes and then add
their cars at about 2,000 extra vehicles to our neighborhood. I can’t believe this
request. Homeowners bought their homes here because of the wooded
uniqueness, large lots, and the ease of walking or driving to the University of
Arkansas. Seth’s plans would greatly take away from that.
The Urban Forester tells me that talks have occurred about the existing trees on
the Markham Hill site. But I also hear that it is encouraged to keep a certain
percentage due to it being a hilltop overlay. Encouraged isn’t a comforting word.
It should be required. Melissa Evans tells me that yes, he could tear down every
tree but replace with new trees. That is horrible and again another reason to not
approve this travesty upon Fayetteville. Listen to the neighbors that will be most
be affected by this and please oppose this plan.

I write regarding my opposition of the proposed re-zoning of Markham Hill. Our city has a goal of attainable housing and this definitely does not fit that goal. Mr.
Mimms would love to build over 500 homes on our hill. He currently could build around 280 homes. He told us at the Environmental Action meeting on
September, 17th that a 1,100 square foot home would be $200,000 and others that are larger would be $400,000 or more. Mr. Mimms also mentioned that the
P.O.A. would be $1,200 a year. How is this attainable housing? Attainable housing is frequently defined as 30% of ones gross income. I have homes near me in
the University Heights neighborhood that are curently for sale and they are in that price range and have been for sale for about 6 months. If there was a need,
these homes would have sold by now.
Mr. Mimms seems to want to bribe the city of Fayetteville with his offer of the land on the West side being put into a conservation easement IF his rezoning request
is permitted. I'm just naive or innocent to this type of business dealings. It seems unethical. Mr. Mimms presents himself as concerned with the environment and
ecologically minded. If he truly was, he would protect many acres of the total 119 acres without stipulations. If I was a council member representing my ward
during this re-zoning, I would listen to my neighbors and vote against it. Most of those neighbors in your Wards helped to put you where you are to represent
them.

The Honorable Lioneld Jordan, Mayor
The Pratt Place/Markham Hill area currently under consideration for development holds a special
place in Fayetteville's history and prehistory. The Waterman/Archer house was listed by the
National Register for Historic Places in 1999 (#WA0842). The house was designated for both its
architectural and resident significance; it is built in the 1929 Tudor style and exhibited a unique
design and was the home of Evangeline Archer. Mrs. Archer played a key role in the Ozark
Society, the citizen’s group that was successful in saving the Buffalo River from being dammed.
Pratt Place/Markham Hill was the home of a children's camp beginning in 1900 -1941. “The
campgrounds covered forty-six acres, with a camp for boys in a western meadow and a camp for
girls in an eastern meadow. Both areas had their own playgrounds, assembly house, kitchen,
dining room and shower baths and the twain came together only on arranged occasions. Other
structures on the campgrounds were a dining hall, a recreation hall, nine residential camp cabins
and swimming pool. The Pratt House was utilized as camp headquarters, bakery, boarding house
for visiting parents, craft area and hot bathhouse for girls.” This area is listed on the Arkansas
Register of Historic Places.
The Arkansas Archeological Survey, the repository for prehistoric remains and location of sites,
recently reviewed the area and found at least two recorded sites on Pratt Place/Markham Hill.
The Pratt Place/Markham Hill property has played a significant role in Fayetteville’s shared
history and has been recognized by the NRHP and ARHP as well as containing recorded
prehistory activity. For these reasons, the Fayetteville Historic District Commission has serious
concerns about these features of the property being impacted by anticipated development. Every
effort through use requirements or other such safeguards should be considered. It is important
that these significant sites be protected and preserved for future generations.
The Historic District Commission urges you to exercise restraint when deciding the fate of this
significant area of Fayetteville.

I have lived on Ora Drive now for almost 6 years and love this location. However the majority of homeowners on my street rent
their homes to college students. This creates a great opportunity for homeowners but the reality of this is that my son will never
ride his bike in our neighborhood or play with his friends. I want a place that allows him this opportunity that keeps us in this
area! Close to our favorite restaurants and shops, while providing us the chance to leave our car in the driveway then walk to
our neighborhoods amenities if we so chose. This type of neighborhood seems quintessentially Fayetteville to me and am so
glad that Specialized is the developer on the scene. This project champions conservation and susatainabilty while providing
housing for mid-career families. This project is one I would love to see the City Council get behind!

I understand that building density is green building, but without a certain amount of green space in that density, future citizens
will fry. East Fayetteville has land North of Lake Louise, Gully, Wilson, East Mt Sequoia. What does our already cramped
neighborhood have? They way it is currently zoned limits developement to 50 acres. That seems like a better deal for the area!

Dear Fayetteville City Council, University Heights neighbors, Friends of Markham Hill:
Attached is a flyer you can copy and hand out at Farmer's Market and Bikes Blues & BBQ and give to your friends and neighbors. It opposes any
rezonings of the Markham Hill property and seeks to save as much of the mountain from development as possible, This would protect the urban
forest, natural habitat, environment, historical sites, and Native American archaeological sites. This would also prevent problems with pollution,
water quality, air quality, carbon emissions, noise, sewage, traffic, roads, flooding, and escape from fire (with single exit from high density RIU and
80-room hotel). In addition, this would protect the value of our low density properties by preventing commercialization and higher density housing in
the middle of our unique RSF-4 neighborhood.
Important to remember:
(1) The current zoning still allows Specialized Real Estate Group to develop the 72-acre RSF-4 on the west side of the mountain. They will need to
follow hillside/hilltop ordinances by saving 30% of the tree cover and follow tree preservation codes as all developers should. This fits with the RSF-
4 surrounding neighborhoods and is more appropriate and compatible development for our area.
(2) The current zoning protects the 72-acre PZD on the east side of the mountain from any development and any additional commercialization (the
Pratt Inn and Event Barn already exist). It protects what I listed above and prevents what I listed above. This was a promise made by previous City
Council members and the Mayor. We hope that the current City Council members will examine the history of this carefully worked-through
arrangement and honor those promises. We want to be able to trust our City government no matter who is in office.
Thank you for your help and support in this effort to save Markham Hill from as much development as possible and to protect our rural residential
RSF-4 neighborhood from the frantic fad of urbanization, infill, and development at all costs.

present zoning with a new PZD and RIU to create a large commercial and residential development.
Why do we want to save Markham Hill from as much development as possible?
• Saving Markham Hill meets two of Fayetteville’s Vision 2050 Guiding Principles: Naturally Beautiful City and
Ecosystem Preservation. Markham Hill is an important and significant part of Fayetteville because of its large
acreage of trees, wooded pastures, plants, birds, rock formations, wildlife, and history. Markham Hill is the
last large acreage of woods where wildlife can take refuge this side of the interstate highway. For many years
bird enthusiasts, naturalists, and University of Arkansas professors and students have studied and enjoyed the
nature and wildlife of Markham Hill.
• Markham Hill is historically part of Fayetteville’s mature tree cover and green infrastructure , contributing to
the City’s environmental health. One acre of trees will trap 2.6 tons of carbon dioxide, helping to eliminate
greenhouse gases and mitigate climate change. Tree cover improves a city’s air quality by decreasing air
pollution. Trees act as natural water filters, providing cleaner water to our watersheds and resulting in less
expense to the City in dealing with sewage, drainage, erosion, and water quality. Markham Hill is one of
Fayetteville’s Natural Areas and so requires conservation and preservation according to Fayetteville’s 2030
Plan.
• Markham Hill’s 144 acres of woods within the City is an example of Fayetteville’s diversity in land and
neighborhood types. Diversity is highly valued in Fayetteville and is part of the City’s character and appeal.
Having 144 acres of protected and preserved forest within a City is special and unique.
• Markham Hill contributes to the physical and emotional well-being of Fayetteville residents. Over the years
nature lovers, bird enthusiasts, horseback riders, hikers, runners, campers, and explorers have enjoyed
Markham Hill. Many can tell you stories of their fond experiences.
• Markham Hill/Pratt Place property is in the Arkansas Register of Historic Places. Its history goes back to 1900
when the Pratt family settled the land. Markham Hill has remained in the Pratt family ever since until very
recently. We would like to honor the two Pratt sisters, Joy Markham and Evangeline Archer, by permanently
protecting Markham Hill as a nature and wildlife preserve. Both sisters did much for the good of Fayetteville
and Arkansas during their lives.
The future of Fayetteville is one of expansion. That means the City must make a concerted effort to both protect
and grow our urban forest to continue to enjoy the benefits it provides. The plans outlined by Specialized Real
Estate Group for the 144 acres of Markham Hill would seriously decrease these benefits. In summary, the 144
acres of Markham Hill must be protected and preserved as much as possible.
What you can do to help:
(1) Sign our petition on change.org. Type Save Markham Hill in the Browse/Search to find it.
(2) Join the Facebook group Friends of Markham Hill to see photos of Markham Hill, learn about its history,
read updates, learn the reasons why the current zoning is the best, and see announcements of meetings.
(3) Write letters to the City Council today at ssmith@fayetteville-ar.gov opposing the rezonings and why.
(4) Come to the Oct 2 and Oct 16 City Council meetings at 5:30pm at City Hall 2nd floor. If able, please speak

Please save all 144 acres of Markham Hill (the land currently owned by
RMD Properties but formerly owned by the Pratt family for over 100 years)
from development and make it a nature and wildlife preserve for the
many reasons stated in the petition below. This begins with opposing any
rezoning.
We, the undersigned, respectfully request the City of Fayetteville to:
(1) Oppose the rezoning of the 144-acre Markham Hill property for
development.
(2) Secure and protect the 144-acre Markham Hill property as a nature and
wildlife preserve.
Specialized Real Estate Group is asking the City of Fayetteville, Arkansas
to rezone the 144-acre Markham Hill property, modifying the present
zoning with a new PZD and RIU in order to create a large commercial and
residential development.
Why do we want to save Markham Hill from development?
- Saving Markham Hill meets two of Fayetteville’s Vision 2050 Guiding
Principles: Naturally Beautiful City and Ecosystem Preservation. Markham
Hill is an important and significant part of Fayetteville because of its large
acreage of trees, wooded pastures, plants, birds, rock formations, wildlife,
and history. Markham Hill is the last large acreage of woods where wildlife
can take refuge this side of the interstate highway. For many years bird
enthusiasts, naturalists, and University of Arkansas professors and students
have studied and enjoyed the nature and wildlife of Markham Hill.
- Markham Hill is historically part of Fayetteville’s mature tree cover and
green infrastructure, contributing to the City’s environmental health. One
acre of trees will trap 2.6 tons of carbon dioxide, helping to eliminate
greenhouse gases and mitigate climate change. Tree cover improves a
city’s air quality by decreasing air pollution. Trees act as natural water
filters, providing cleaner water to our watersheds and resulting in less
expense to the City in dealing with sewage, drainage, erosion, and water
quality. Markham Hill is one of Fayetteville’s Natural Areas and so requires
conservation and preservation according to Fayetteville’s 2030 Plan.
- Markham Hill’s 144 acres of woods within the City is an example of
Fayetteville’s diversity in land and neighborhood types. Diversity is highly
valued in Fayetteville and is part of the City’s character and appeal. Having
144 acres of protected and preserved forest within a City is special and
unique.
- Markham Hill contributes to the physical and emotional well-being of
Fayetteville residents. Over the years nature lovers, bird enthusiasts,
horseback riders, hikers, runners, campers, and explorers have enjoyed
Markham Hill. Many can tell you stories of their fond experiences.
- Markham Hill/Pratt Place property is in the Arkansas Register of Historic
Places. Its history goes back to 1900 when the Pratt family settled the land.
Markham Hill has remained in the Pratt family ever since until very recently.
We would like to honor the two Pratt sisters, Joy Markham and Evangeline
Archer, by permanently protecting Markham Hill as a nature and wildlife
preserve. Both sisters did much for the good of Fayetteville and Arkansas
during their lives.
The future of Fayetteville is one of expansion. That means the City must
make a concerted effort to both protect and grow our urban forest in
order to continue to enjoy the benefits it provides. The plans outlined by
Specialized Real Estate Group for the 144 acres of Markham Hill would
seriously decrease these benefits. In summary, the 144 acres of Markham
Hill must be protected and preserved.

(a name I find pretentious) Markham Hill was our playground and a
place of exploration for us. Wildlife was prevalent. Mrs. Archer ran

Widder family kept their mule along Cross St. There were foxes, and
even a wolf once near Sang and Cleveland. The old neighborhood
is no longer the welcoming place to me it once was. But I hope city
officials will stop the headlong race for developement and preserve
a little of the old wooded areas as they were.

approved at all. Assurances were made back then that if Pratt Place

Dear City Council,
Which is more important: protecting urban forests or building houses? In 10-20 years, if the environment is severely damaged or destroyed, it won't
matter where we live because we'll be either very sick from pollution, carbon emissions, and impure air and water, or we'll be dead.
Will Fayetteville be remembered for protecting the environment or for destroying it to build houses and hotels? Which Fayetteville would make us
feel most proud or would we rather live in?
I wish the City Council could see that keeping the current zoning for Markham Hill, no matter the owner and developer, saves most of the urban
forest, prevents the most pollution, prevents traffic and flooding and sewage problems, saves the most historic and Native American sites, and also
gives the developer the opportunity to develop in the existing RSF-4 area on the west side of the mountain.
The developer bought the land as is: (1) 72-acre PZD promised by previous City Councils where no development is allowed and no more
commercialization than the Pratt Inn and Event Barn is allowed, and (2) 72-acre RSF-4 where 30% tree cover (hillside/hilltop) must remain and the
land can be developed with a max of 4 houses per acre. The surrounding neighborhood is low density RSF-4. This fits.
Are 230 additional homes worth the destruction of 100 acres of Markham Hill that a rezoning would accomplish? That's the approximate difference
between the rezoning (520 homes or living units) and the existing zoning (288 homes).
The best compromise between total preservation and total destruction of Markham Hill is the current zoning. The neighborhood has what is most
compatible and appropriate and the developer has exactly what they bought, i.e., they can develop the 72-acre RSF-4 with 30% tree cover preserved.
Please oppose the rezoning requests from RMD Properties and Specialized Real Estate Group and all future developers and owners of the Markham
Hill property. Markham Hill is worth saving for Fayetteville. There are plenty of areas in Fayetteville where trees and natural habitat have already
been destroyed and where old buildings can be renovated and repurposed for housing. Check out Morningside Drive where many neighbors want to
sell their acreages. Encourage RMD Properties and Specialized Real Estate Group to pursue development there instead. Also, I pray you will
encourage them to sell at a reasonable and generous price to Fayetteville residents who want to purchase the land to put in a conservation easement
and make it a nature and wildlife preserve. Surely kindness toward people who love nature, wildlife, clean air and water, history, archaeology, safe
roads, and rural life can rise above their desire to make a lot of money, especially in the case of Markham Hill.

Please say 'Yes' to urban forests and the environment being more important than building houses.
Please listen to the 2560+ people who have so far signed the 'Save Markham Hill' petition. They are all asking you to oppose the rezonings for the
many valid reasons listed in the petition.

These photos were taken last weekend at the Mission Heights development on Highway 45 across the street from Westwood Gardens.
This development has been mentioned as an example of the kind of housing envisioned for Markham Hill. Lawrence Finn is the Development
Manager for SREG and has been very involved with the Markham Hill project. He was one of the developers of Mission Heights. The Facebook page
for Mission Heights says it was "designed in harmony with the hillside”. It does not seem harmonious to me.
The individual homes have attractive, traditional design features. But the density and lack of meaningful front, rear and side setbacks diminishes
their appeal. This is the difference between housing developments built in a high density zoning district versus the existing RSF-4 district. These
houses perched on the steep hillside along Mission Boulevard seem out of sync with the scale of the surrounding residential and commercial
structures. It is not pleasing from the roadway.
Finn was also the director of development for The Village at Hendrix in Conway. It is a complete mixed-use neighborhood that was built on 100
acres owned by and adjacent to Hendrix College. It has been described as "the first fully-developed neighborhood in Arkansas to adopt New
Urbanism principles”. The topography is flat and it is very centrally located near the college and downtown Conway. It truly is a stretch to describe
Markham Hill as centrally located near downtown Fayetteville and the UA campus. It is an isolated, wooded hilltop with one way in and one way
out.
The master planner for Hendrix Village was Duany Plater-Zyberk & Co (DPZ). Their most notable project is Seaside, Florida. A former director of
town planning for DPZ, Michael Watkins, started his own firm in 2007 and is currently the land planner and architect for Johnson Village, a mixed
use development under construction off of Carley Road in Springdale. Once again, the site for Johnson Village is not a steep, somewhat isolated
mountainside. It is easily accessible from I49, Springdale and surrounding communities.
These kinds of new urban developments are here to stay in northwest Arkansas IF the early ones stand the test of time in terms of popularity. There
certainly is room in Fayetteville for these kind of "complete neighborhoods". But location would seem to be the key to long term success. It is my
sense that Mission Heights has been very slow to develop and has not been embraced by Fayetteville residents looking for attractive, affordable

housing in a traditional neighborhood setting. So far, I am not aware that any commercial spaces have been developed that would serve as “gathering
places” for the neighborhood village.
Building out a development like this one on top of a steep, wooded hill seems fraught with logistical problems. Building out a complete
neighborhood arguably is inherently incompatible with the topography of Markham Hill. The limited accessibility into the site from existing roads
makes it seem equally incompatible for construction of a complete neighborhood with a town center, even taking into account possible future street
connections. Its siting within a well-established, low to medium density residential neighborhood seems incompatible, as well.
Over the years, City Attorney Kit Williams has advised mayors and council members that compatibility is the most important factor to consider in
making zoning decisions. The Markham Hill proposal submitted by Specialized Real Estate Group is incompatible with the existing nature of the
surrounding property and the current land uses.
The zoning laws don't exist just to pave the way for development. They were designed also to protect the interests of other property owners impacted
by the plans of a nearby property owner. The zoning laws are supposed to balance those competing interests. Somehow, we seem to have lost that
perspective in Fayetteville. Equal consideration is not given to the value of preservation over new development. The legitimate interests of property
owners opposed to a radical change in zoning in their neighborhood seems to get lost in the discussion as enthusiasm for growth and newness takes
hold. In this case, a good balance between the interests of competing property owners was struck several years ago with the current PZD that limits
commercial uses of the property and retains the medium density housing allowed in an RSF-4 residential zoning district.
We need not overpopulate all of the old neighborhoods in Fayetteville with new urbanism developments that eliminate so much of our dwindling
mature tree canopy and remove forever structures and places of historical significance. There are other more appropriate locations where these new
kinds of neighborhoods could be built.
The number one long term development goal of the city is not simply infill. It's "appropriate" infill. Building a village on top of Markham Hill is not
appropriate infill and it is not compatible with the surrounding land uses. Great care must be taken not to ignore the sense of place our old
neighborhoods and cherished wooded hills provide for the entire community.

In the absence of local examples of conservation communities, we have referred to Serenbe, a development in Georgia,
as an example of the type of development we plan at Markham Hill. Our development team spent three days at Serenbe
studying the ways this new community expresses traditional town form in the context of connections to nature.
While the Markham Hill property is 144 acres in the center of a growing town, Serenbe is located on 1,200 acres in a
rural setting half an hour outside of Atlanta, a much different context. Because they exist in such different contexts,
density comparisons are not relevant, but opponents to our proposal have been citing inaccurate numbers. At full build‐
out, Serenbe will have 1600 units. (See the attached ULI case study.)
Our intention in using Serenbe as an example has more to do with placemaking, architecture, and their success in the
combination of new urbanism and access to nature. The diversity of housing types woven into each Hamlet is excellent.
We aspire to such an agile balance between development and conservation.

SERENBE is a 1,000-acre (405 ha) community that broke
ground in 2004 in Chattahoochee Hills, Georgia, that currently
includes 200 homes (single family, multifamily, and live/work
units), commercial and arts space, and three restaurants, with
eventual plans for a total of 1,200 residents. The development
includes a number of food-based amenities, most notably a
25-acre (10 ha) professionally managed organic farm that forms
the heart of the community. Serenbe also features an extensive
nature trail system, conserves water through landscaping, and
naturally treats wastewater for use in irrigation.
Features and Innovations
• Organic farm: Serenbe Farms is a certified organic farm
where more than 300 varieties of vegetables, fruits, herbs,
and flowers are grown, many of which are used in Serenbe’s
on-site restaurants. Over 60,000 pounds (27,215 kg) of
produce are harvested each year.
• Saturday farmers market: Much of the produce grown at
Serenbe Farms is sold at the Serenbe Farmers and Artisan
Market. In addition, the market features food products from
other local farmers and regional food producers.
• Community-supported agriculture program: Food produced
at Serenbe Farms is available through a community-
supported agriculture program, which allows anyone to sign
up to receive a weekly box of produce and eggs throughout
much of the year.
• Public farm tours: Serenbe Farms offers tours that allow
people to learn about the benefits of organic produce,
composting, and pest and disease control, as well as how
to market local produce.
• Edible landscaping: Plants, such as blueberry bushes and
fig trees, are located throughout Serenbe, allowing people to
pick fruit for personal use.
Creating Value: People, Planet, Profit
Serenbe’s location in Chattahoochee Hills, Georgia, a city of
38,000 acres (15,378 ha) located on the southwest edge of
Atlanta, has directly influenced its development. Serenbe is
the first—and currently the only—community developed within
Chattahoochee Hills. Aside from Serenbe, the entire city consists
of forests and agricultural uses.
Preserving a significant portion of some of the last open space
near Atlanta allowed the creation of a community focused on food
and interaction between neighbors. Steve Nygren, president and
founder of Serenbe, explains that this vision required a rethink of
common development practices, stating, “Most of what we have
done is really common sense, but we had to work to rewrite local
zoning laws to allow for high-density residential ‘hamlets’ within
walking distance of community and commercial centers.”
Nygren continues, “We created plans for 20 percent more
residential units than would have been possible with traditional
development practices and preserved over 70 percent of ‘devel-
opable’ land for agriculture and open space—all of this within 30
minutes of the world’s busiest airport.”
Serenbe is unique in the region in that all other land that is
a similar distance from the center of Atlanta follows more tra-
ditional suburban development patterns. The added residential
units support the project’s financial success, while the village
atmosphere underpins the mission of the project—to create an
environment that facilitates mental and physical health, where
people connect with neighbors over food, nature, art, and events.
Serenbe’s lots are currently selling for around $150,000
to $400,000, with completed homes ranging from around
$470,000 to $1,400,000. Leased units range from around $1,000
to over $5,500, with custom homes selling for a substantial
market premium.
While creating a community centered around a working farm
supports Serenbe’s bottom line by differentiating the project
from others on the market, Nygren explains that the ability
to advance health and environmental sustainability goals is
even more important, stating, “Our development is financially
successful, but more essentially, we measure success in terms
of the well-being of our residents and by our ability to teach area
youth about topics like the seasonality of local produce.”

The Markham Hill property rezoning requests give us all a unique opportunity to effect the growth and
development of Fayetteville.It has been my hope throughout this process that we, the community, the
owner and developer, and the decision makers would be able to look at this property and make a wise
decision, not just based on facts, but a decision that reflects this property’s un ique value to the region and
to the City of Fayetteville.
Our neighborhood is residential, composed primarily of single-family residences on large lots. We each
made our investment in the neighborhood for a number of reasons, most of those decisions were made
prior to the adoption of the current 2030 plan. The natural environment attendant to these large lots with
mature trees played into many of our decisions to invest in University Heights.As a neighborhood, we
readily participate in creating an enduring green space for the benefit of our City and the greater Northwest
Arkansas region.
The requested proposals for rezoning are just too much development.Building a small city atop Markham
Hill is not in the best interest of our established neighborhood. We are not a high density,multi-family,
commercial neighborhood.We are a unique neighborhood that is highly valuable to many citizens as more
and more of the available land is converted to high density, and generally not affordable housing.This is not
appropriate infill. It is just over development.
Please deny these proposed rezoning of the Markham Hill property. The original PZD,established through
much work in 2005,needs to be respected and upheld. There are many possibilities for the future use of
this property. The proposed rezoning is not one of them.

Dear City Council,
I've been thinking that our fight to save Markham Hill and protect the University Heights neighborhood is a miniature of the Buffalo River
fight fought by the Ozark Society years ago. How ironic that Evangeline Archer worked on saving the Buffalo River and we are now
trying to save her property.
Developers and others wanted dams on the Buffalo River so they could build nice lake front homes. The Buffalo River was already
zoned for development and Congress had already approved two dams. The situation looked grim. But the Ozark Society fought
Congress to stop the dams and they saved the Buffalo River. It took ten years. We are so glad they did. We'd much rather have the
beautiful Buffalo River than a bunch of houses.
We are trying to save Markham Hill from as much development as possible in order to maintain its unpolluted beauty and history. We
are also trying to protect our University Heights neighborhood from inappropriate development in order to maintain its rural and historic
neighborhood charm, culture, and safety.
It took ten years to save the Buffalo River and it may take ten years to save Markham Hill and our University Heights neighborhood. We
are willing to pursue this until we succeed.
Aren't we happy that the Buffalo River was saved for Arkansas? In 20 years Fayetteville and our kids and grandkids will be just as
happy that we saved Markham Hill and our University Heights neighborhood as well.
Please vote against the rezonings of Markham Hill. The owner/developer can right now do RSF-4 development on the west side of the
mountain according to hillside/hilltop and tree preservation codes. We recognize this. Please do not allow any more destruction than
this by changing zoning to RIU and by breaking the promise with the existing and protective PZD.
Fayetteville will survive having too many houses and not enough houses in the years to come. Throughout history cities have survived
this. We simply live outside of town or in the next city over if needed. I've done this in Maryland for 30 years. It's no big deal. Lack of
local housing is not what destroys societies.

If we don't take care of our urban forests and native habitats but give in to man's desire for more money (by building dams, hog farms,
and houses), we end up with a polluted environment, lack of clean water and air, diseases, illnesses, and death. A polluted environment
destroys societies.
Please don't let your worry over possible lack of housing in Fayetteville blind you to the many other factors, environmental and human,
that contribute to our quality of life here.
