2. BLUEINGREEN, LLC AND CH2M HILL ENGINEERS, INC.: A resolution to
approve lease, maintenance and operation agreements with Blueingreen, LLC and CH2M
Hill Engineers, Inc. for office and lab space at the Noland Water Resource Recovery Facility
and an extension of Blueingreen’s warranty and service of its equipment.

3. STRIBLING EQUIPMENT, LLC: A resolution to authorize the purchase of a John Deere
loader with forks from Stribling Equipment, LLC of Springdale, Arkansas in the amount of
$131,350.00 pursuant to the Sourcewell Cooperative Purchasing Contract for use by the
Water and Sewer Operations Division.

4. PUREGREEN EQUIPMENT SERVICES, LLC: A resolution to authorize a contract
with Puregreen Equipment Services, LLC d/b/a EZ Fuel-Blue1usa for the purchase of
fueling equipment in the amount of $135,997.31 pursuant to the Sourcewell Cooperative
Purchasing Contract for the Fuel Station Improvement Project, and to approve a project
contingency in the amount of $20,000.00.

5. HAZMAT SERVICES REVENUE: A resolution to approve a budget adjustment
recognizing hazmat services revenue received by the fire department from Washington
County in the amount of $3,080.00 and increasing the related expense budget.

6. ASSISTANCE TO FIREFIGHTERS GRANT: A resolution to authorize the acceptance
of a 90/10 assistance to firefighters grant from the Federal Emergency Management
Agency in the amount of $123,637.00 for the purchase of physical fitness equipment, and
to approve a budget adjustment to provide for matching funds in the amount of $12,363.00
and a project contingency in the amount of $20,000.00.

7. ARKANSAS DEPARTMENT OF AERONAUTICS: A resolution to authorize
application for an of Aeronautics 50/50 Grant in the amount of $43,730.00 for the

8. 2018 JUSTICE ASSISTANCE GRANT: A resolution to authorize acceptance of a 2018
Justice Assistance Grant for federal and state funding of the Fourth Judicial District Drug
Task Force in the amount of $153,180.00, and to authorize Mayor Jordan to sign all
necessary documents to receive the grant funds.

9. MAPLE STREET CYCLE TRACK DESIGN: A resolution to authorize a cost share
with the University of Arkansas and the Walton Family Foundation for design services by
McGoodwin, Williams & Yates, a division of Olsson & Associates, Inc. for the Maple
Street Cycle Track with the amount to be paid by the city not to exceed $103,500.00.

10. 81 CONSTRUCTION GROUP, INC.: A resolution to approve a change order to the
contract with 81 Construction Group, Inc. in the amount of $53,750.00 for the East
Spyglass Hill Drive Drainage Improvements Project to expand the scope of services to
include additional rock excavation and to add 45 days to the contract time due to delays
caused by the unplanned rock excavation.

11. SALES & USE TAX CAPITAL IMPROVEMENT BONDS: A resolution to approve a
budget adjustment recognizing revenue generated from interest paid on funds for the Sales
& Use Tax Capital Improvement Bonds Series 2013 Project in the amount of $37,286.91.

12. LETTER OF AGREEMENT: A resolution to authorize the Mayor to sign a letter of
agreement with Thrash Law Firm, Williams & Anderson PLC, the Finnell Firm, and Bird
Law Group to file a claim on behalf of the City of Fayetteville for unpaid
hotel/motel/restaurant taxes owed by online travel companies.

13. BOUNDARY LINE AGREEMENT/QUITCLAIM DEED: A resolution to authorize
the Mayor to sign a boundary line agreement and quitclaim deed to clarify the boundary

South Futrall Drive and Red Arrow Subdivision.

repair quote of $22,176.02 from Ozark Kenworth, Inc. d/b/a MHC Kenworth/Volvo -
Springdale to repair a sewer cleaner truck that was involved in an accident.

2. 2018 MILLAGE LEVY: An ordinance levying a tax on the real and personal property
within the City of Fayetteville, Arkansas, for the year 2018 fixing the rate thereof at 2.3
mills for General Fund Operations, 0.4 mills for the Firemen’s Pension and Relief Fund,
0.4 mills for the Policemen’s Pension and Relief Fund, 2.5 mills for Fayetteville Public
Library Operations, and 1.2 mills for the Fayetteville Public Library Expansion; and
certifying the same to the County Clerk of Washington County, Arkansas.

3. REENACT § 177.04 (D)(4) AND (5): An ordinance to reenact § 177.04 (d)(4) and (5)

4. AMEND § 166.25 (D): An ordinance to amend § 166.25(d) of the unified development

5. AMEND § 50.20: An ordinance to amend § 50.20 service requirements in chapter 50:

and cpzd, commercial planning zoning district to rezone approximately 75.42 acres to ri-
u, residential intermediate-urban and approximately 44.01 acres to r-a, residential
agricultural, subject to a bill of assurance.
THIS ORDINANCE WAS LEFT ON THE FIRST READING.
9. C-PZD 18-6318 (2231 W. MARKHAM RD./PRATT PLACE INN & BARN): An
ordinance to approve a commercial planned zoning district entitled c-pzd 18-6318 for
property located at 2231 West Markham Road reducing the existing 68.99-acre commercial
planned zoning district to 24.06 acres while retaining the existing uses, and adding up to
5,000 square feet of event space, 12,000 square feet of restaurant or commercial space, 80
hotel rooms, and 43 dwelling units.

All interested persons may appear and address the City Council on Unfinished Business, New Business, and Public Hearings
at City Council meetings. If you wish to address the City Council on an agenda item, please wait for the Mayor or Chair to
request public comment then queue behind the podium. When the Mayor or Chair recognizes you, approach the podium and
give your name and address. Comments are to be addressed to the Mayor or Chair. The Mayor or Chair will direct your
comments to the appropriate elected officials, staff, or others for response. Keep your comments respectful, brief, to the
point, and relevant to the agenda item being considered. Each speaker from the public will be allowed one turn at the
microphone for discussion of an agenda item.
Below is a portion of the Rules of Order and Procedure of the Fayetteville City Council pertaining to City Council meetings:
Agenda Additions: A new item which is requested to be added to the agenda at a City Council meeting should only be
considered if it requires immediate City Council consideration and if the normal agenda setting process is not practical. The
City Council may only place such new item on the City Council meeting ’s agenda by suspending the rules by two -thirds
vote. Such agenda addition shall be heard prior to the Consent Agenda.
Consent Agenda: Consent Agenda items shall be read by the Mayor and voted upon as a group without discussion by the
City Council. If an Alderman wishes to comment upon or discuss a Consent Agenda item, that item shall be removed and
considered immediately after the Consent Agenda has been voted upon.
Unfinished Business and New Business:
Presentations by Staff and Applicants: Agenda items shall be introduced by the Mayor and, if an ordinance, read by the City
Attorney. City staff shall then present a report. An agenda applicant (city contractor, rezoning or development applicant,
etc.) may present its proposal only during this presentation period, but may be recalled by an alderman later to answer
questions. City staff, City Council members, and applicants may use electronic visual aids in the City Council meeting as part
of the presentation of the agenda item.
Public Comments: Public comment shall be allowed for all members of the audience on all items of old and new business and
subjects of public hearings. A simple majority of the City Council members, present and voting, may authorize a
representative of a Fayetteville citizens' group opposing the ordinance or resolution to present an electronic visual aid not to
exceed five minutes, but no other electronic visual aid presentations will be allowed; however, the public may submit photos,
petitions, etc. to be distributed to the City Council. If a member of the public wishes for the City Clerk to distribute materials
to the City Council before its meeting, such materials should be supplied to the City Clerk's Office no later than 9:00 A.M. on
the day of the City Council meeting. Any member of the public shall first state his or her name and address, followed by a
concise statement of the person's position on the question under discussion. Repetitive comments should be avoided; this
applies to comments made previously either to the City Council or to the Planning Commission when those Planning
Commission minutes have been provided to the City Council. All remarks shall be addressed to the Mayor or the City Council
as a whole and not to any particular member of the City Council. No person other than the City Council member and the
person having the floor shall be permitted to enter into any discussions without permission of the Mayor. No questions shall
be directed to a City Council member or city staff member except through the Mayor.
Courtesy and Respect: All members of the public, all city staff and elected officials shall accord the utmost courtesy and
respect to each other at all times. All shall refrain from rude or derogatory remarks, reflections as to integrity, abusive
comments and statements about motives or personalities. Any member of the public who violates these standards shall be
ruled out of order by the Mayor, must immediately cease speaking and shall leave the podium.
Interpreters or Telecommunications Devise for the Deaf (TDD), for hearing impaired are available for all City Council
meetings, a 72-hour advance notice is required. For further information or to request an interpreter, please call 479-575-8330.

Dear Fayetteville City Council, Planning Commission, Environmental Action Committee, and Urban Forestry Advisory Board,
As I write this, the total number of signatures so far on our petition to save Markham Hill from development and make it a nature and wildlife preserve is 1905. It's
been only two weeks. When a person signs the petition they have the option of writing down why they are signing. Please see the attachment. As you read
through the comments (really great!), please think of the people in the neighborhoods you represent. Sometimes it feels like our City cares more about the
developer than us. For example, should zoning in a neighborhood be determined by an outside developer whose goal is to make money or by the people who
actually live in that neighborhood? This has been a problem throughout Fayetteville.
Back to the petition, these signers aren't just anybody but people who really care about Markham Hill, the environment, Fayetteville history, wildlife, forests, plants,
trees, natural habitat, rock formations, photography, reptiles, birds, hiking, running, strolling, horseback riding, plein air painting, needing a place away from
civilization to be alone, water and air quality, climate change, springs and water flow, Native American artifacts, Evangeline Archer, Joy Markham, etc. - all things
that make Markham Hill what it is.

The Friends of Markham Hill want no change to the current PZD and RSF-4 zoning on Markham Hill.
The current PZD and RSF-4 zoning protects the tree coverage and natural habitat of the 144 acres of Markham Hill the most. It also allows Specialized Real
Estate Group to make money by fully utilizing the Pratt Inn and Event Barn and by doing Serenbe-type conservation development in the 72-acre RSF-4.
Fully utilizing the Pratt Inn would be splitting the large guest rooms upstairs into smaller ones so they can have more guests, having a restaurant in the Dining
Room on the first floor, and leasing out the many rooms in the basement to artists for studio space, massage therapists, yoga teachers, etc.
I recommend that the City Council asks Specialized REG to prove to Fayetteville that they can do Serenbe-type conservation development. That means preserving
the tree coverage and natural habitat of at least 50 acres (70% of 72 acres) and by building only 25 houses (the correct density for 72 acres which corresponds to
Serenbe's 350 houses in 1000 acres). Specialized REG will be destroying at most 22 acres of tree coverage and natural habitat under the current zoning, if they
truly followed the Serenbe model as they claim. The City Council would need to insist on this percent of preservation and density. Specialized REG would need to
resubmit their development plans, actually following the Serenbe model they claim to follow.
We don't want any development in the 72-acre PZD and no more commercial uses than the already existing Pratt Inn and Event Barn. This keeps a promise made
to the surrounding rural residential neighborhoods by a previous City Council and by Mayor Jordan. This can be an example to Fayetteville residents that the City
does consider the people in the neighborhoods they represent more important than the invisible out-of-state owner of a property in their midst or the developer the
owner hired to make as much money as possible off the property no matter the harm to the locals, their tree cover, urban forest, wildlife, environment, quality of
life, air and water quality, storm water, rural residential neighborhood, and emotional well-being.
However, what we really want is for RMD Properties (the owners we are still trying to find) to put all 144 acres into a conservation easement with the NWA Land
Trust so that Markham Hill can become a nature and wildlife preserve for the City of Fayetteville. RMD Properties can still make a nice profit on their investment by
simply selling the Pratt Inn and Event Barn.

Please save all 144 acres of Markham Hill (the land currently owned by
RMD Properties but formerly owned by the Pratt family for over 100 years)
from development and make it a nature and wildlife preserve for the
many reasons stated in the petition below. This begins with opposing any
rezoning.
We, the undersigned, respectfully request the City of Fayetteville to:
(1) Oppose the rezoning of the 144-acre Markham Hill property for
development.
(2) Secure and protect the 144-acre Markham Hill property as a nature and
wildlife preserve.
Specialized Real Estate Group is asking the City of Fayetteville, Arkansas
to rezone the 144-acre Markham Hill property, modifying the present
zoning with a new PZD and RIU in order to create a large commercial and
residential development.
Why do we want to save Markham Hill from development?
- Saving Markham Hill meets two of Fayetteville’s Vision 2050 Guiding
Principles: Naturally Beautiful City and Ecosystem Preservation. Markham
Hill is an important and significant part of Fayetteville because of its large
acreage of trees, wooded pastures, plants, birds, rock formations, wildlife,
and history. Markham Hill is the last large acreage of woods where wildlife
can take refuge this side of the interstate highway. For many years bird
enthusiasts, naturalists, and University of Arkansas professors and students
have studied and enjoyed the nature and wildlife of Markham Hill.
- Markham Hill is historically part of Fayetteville’s mature tree cover and
green infrastructure, contributing to the City’s environmental health. One
acre of trees will trap 2.6 tons of carbon dioxide, helping to eliminate
greenhouse gases and mitigate climate change. Tree cover improves a
city’s air quality by decreasing air pollution. Trees act as natural water
filters, providing cleaner water to our watersheds and resulting in less
expense to the City in dealing with sewage, drainage, erosion, and water
quality. Markham Hill is one of Fayetteville’s Natural Areas and so requires
conservation and preservation according to Fayetteville’s 2030 Plan.
- Markham Hill’s 144 acres of woods within the City is an example of
Fayetteville’s diversity in land and neighborhood types. Diversity is highly
valued in Fayetteville and is part of the City’s character and appeal. Having
144 acres of protected and preserved forest within a City is special and
unique.
- Markham Hill contributes to the physical and emotional well-being of
Fayetteville residents. Over the years nature lovers, bird enthusiasts,
horseback riders, hikers, runners, campers, and explorers have enjoyed
Markham Hill. Many can tell you stories of their fond experiences.
- Markham Hill/Pratt Place property is in the Arkansas Register of Historic
Places. Its history goes back to 1900 when the Pratt family settled the land.
Markham Hill has remained in the Pratt family ever since until very recently.
We would like to honor the two Pratt sisters, Joy Markham and Evangeline
Archer, by permanently protecting Markham Hill as a nature and wildlife
preserve. Both sisters did much for the good of Fayetteville and Arkansas
during their lives.
The future of Fayetteville is one of expansion. That means the City must
make a concerted effort to both protect and grow our urban forest in
order to continue to enjoy the benefits it provides. The plans outlined by
Specialized Real Estate Group for the 144 acres of Markham Hill would
seriously decrease these benefits. In summary, the 144 acres of Markham
Hill must be protected and preserved.

We would support the efforts of others to have Markham Hill preserved in some
manner for its natural beauty and historical significance if that becomes feasible. In the
absence of such result, we support the requests of Specialized Real Estate Group
(“SREG”) with respect to Markham Hill provided that the representations of SREG on
certain issues are included in the final approvals of the City Council.
In that regard, several of us who live in the University Heights neighborhood have
met with SREG numerous times over the last few months to discuss the proposals and
concerns of the neighborhood. The result has been an agreement that SREG will include
some changes in their PZD and rezoning requests. Those changes include a reduction
of ADUs in Planning Areas 1 and 2 of the PZD; a more detailed definition of “Special
Events”; restrictions on events with outdoor amplified music; a statement of position with
respect to South Sang Street; and the inclusion of public trails within the development
area and the RA conservation area.
It is not possible at this time to state in detail the representations have been agreed
to. It is our understanding that changes cannot be made by t he applicant once the PZD
and rezoning matters are on the City Council agenda for consideration. We further
understand that the revisions that have been agreed to by SREG will be included in further
filings to be made after 9/18/18 and before the second consideration of the applications.
We will wait until the revised wording is available before commenting further.

We are very disappointed.
The current 72-acre PZD and current 72-acre RSF-4 protect more acreage on Markham Hill from development
than the rezoning would. 72 acres of the PZD and 30% of the RSF-4 because of hillside/hilltop overlay are
protected with the current zoning.
Seth could even prove himself as a conservation developer by putting a lot of the current RSF-4 in a
conservation easement. He can still develop under the current zoning. RSF-4 is like the surrounding zoning.
RIU is not. Nor is his highly commercial PZD.
With the current zoning he is destroying at most 50 acres and preserving at least 94 acres. With the rezoning
he is destroying 100 acres and preserving 44 acres.
I think one problem with all this is that the neighborhoods, as a whole, surrounding Markham Hill do not trust
Seth and Specialized Real Estate Group. They were dishonest with us about being like Serenbe which
preserves 70% of the natural habitat and has a density of 350 homes and 600 people per 1000 acres.
Specialized REG's application/proposal to the City shocked us. Any promise or claim Seth makes now we don't
believe. It appears his desire for money overrides his care for us. It's as if we are being violated and abused.
However, people in general who haven't had negative experiences with him or Specialized Real Estate Group
believe him and think his plans are wonderful.
I pray the City Council will realize this. So many people don't want the rezoning and want to protect Markham
Hill. How does one property owner have the power to do so much damage to an historic, natural, wonderful
place and to the surrounding neighborhoods? I don't understand how a City can allow this.

To Environmental Action Committee and all concerned:
I am writing regarding Specialized Real Estate Group’s proposed rezoning plan for
Markham Hill. I am a botanist with a local environmental consulting company and, for
the purposes of this letter, represent no other group.
It is clear to me that because of local development pressure and the property’s central
location that development of Markham Hill is inevitable, and I would rather it be
developed by SREG than by a less conservation-minded company.
As you may know, the property is currently zoned for development and has no formal
tree preservation areas in place. I have had the opportunity to walk the property, and in
my opinion, the areas that are most important for conservation lie within the 44 acres
that will be immediately committed to permanent protection under SREG’s proposal.
I will be carrying out a botanical inventory and habitat assessment of the property - a
purely voluntary measure by the property owner - this fall and next spring to identify
any rare plants, sensitive habitats, legacy trees, and areas of most concern for invasive
plants. Based on the information I have been shown, I believe this is a responsible land
use plan and am in support of it.

is a part. I would like to share it with you because I think it illustrates how a lot of us feel. Thank you for your time. I know you all are trying to do

Dear University Heights neighbors,
It is so true about that bribe or bargaining tool developer Specialized REG is using. "If you give me the rezoning I want, then I will put
hillside/hilltop 30% of the 144 acres or 44 acres into a conservation easement on the far west". That is what won over the Environmental Action
Committee. If Specialized REG truly cares about Markham Hill and conservation development, they can prove that in the existing 72-acre RSF-4.
Specialized REG should therefore desire to put at least 30% of the existing 72-acre RSF-4 in a conservation easement, etc.
I was thinking last night after the Environmental Action Committee meeting how Specialized REG basically lied to us. They said they were wanting
to follow the Serenbe model of conservation development, i.e. preserve 70% of natural habitat and have low density housing with ratio of 350 houses
and 600 people per 1000 acres. That is 50 houses and 86 people (already have existing structures for some of this) in the 144 acres of Markham Hill.
Hey! That's pretty much how we are as a neighborhood. But their application/ proposal to the City was a shock to us with their high density RIU and
packed commercialized PZD with houses, hotel, cottages, restaurant, parking lots, etc. Over 500+ buildings, hotel, etc. crammed into those 144 acres.
That is not the character of our historic neighborhood at all. We are a wooded, rural residential neighborhood. Properties surrounding Markham Hill
are one house on one to five or more acres.
I feel lied to, betrayed, deceived, and violated. It feels like they are raping Markham Hill and the surrounding neighborhoods. Money is more
important to them than the mountain and its people and culture. Added to this is that people who don't know the truth believe them and not us. Just
like rape victims.
But we fight on because we don't want to be used and thrown away by Specialized REG or the City. We're going to stand up and speak.

Praying we don't get or remain bitter and angry. Praying we have success. Praying the City will care more about all of us than the one developer.
Praying there are many of us and we each speak well at the podium tonight. Praying they don't rezone. Praying Specialized REG and RMD Properties
will donate or sell the entire property to a group of conservationists at a reasonable price. Praying we can save Markham Hill from development and
make it a nature and wildlife preserve.

The existing building mix is eclectic. Architectural styles draw upon historical precedent while adapting
to local site conditions. The existing inn, barn, cabin, and cottage are a few hundred feet apart, but
create an ensemble that is nestled into the trees and frames clearings. Any new buildings will keep the
principles of the site’s dialogue between building and nature, regardless of architectural style.

The PZD consists of 24.05 acres consisting of two Planning Areas as described herein.
Most existing structures are to remain, including the 18,000 SF inn, the 6,300 SF event barn, 2,250 SF
cottage, 2,040 SF cabin, and the 1,400 SF storage barn. The existing cottage will be repurposed as a
commercial space for residents at the inn. The cabin will be utilized as part of the hospitality suites. The
other existing structures will continue their current uses.
New buildings will consist of several single-story cabins, a conference and meeting space, a two or
WKUHHVWRU\KRVSLWDOLW\H[SDQVLRQDQGVPDOOIRRWSULQWVWUXFWXUHVVXFKDVDGPLQLVWUDWLRQRIÀFHVJXHVW
services, and resort-based retail. These buildings will cluster around the inn and barn, creating a
“village” that promotes strolling through the grounds around heritage trees. The reprogrammed inn will
provide new experiences for the surrounding neighborhood. Neighbors have explicitly stated that the
property is not perceived as a public space. With small scale retail/commercial, a small restaurant,
and new meeting space, the new PZD will become a destination for the adjoining neighborhood as
well as downtown.
Primary vehicle access will be from Markham Road. This section of Markham has already been
improved as part of the existing PZD. The PZD includes limited opportunities for single family
homes fronting Markham Road and Sang Avenue to knit the outer boundaries of the PZD into the
IUDPHZRUNRIWKHVXUURXQGLQJQHLJKERUKRRG7KHDSSURDFKWRWKHLQQDQGEDUQLVEHLQJPRGLÀHGWR
accommodate the new program. All parking will meet the City of Fayetteville’s UDC for screening

This hilltop PZD consists of mostly clearing with rambles of legacy trees. The site is bordered
by a natural drainage draw and steep slope on the north, a wooded area and Sang
Avenue on the east, a municipal water tower on the south, and a meadow to the west.
There are no man-made or natural hazards that exist on the site.
As discussed above, the proposed PZD will be strategically located within a proposed and
existing residential neighborhood. Through compact development, the proposed Markham Hill
neighborhood, including the proposed PZD, will protect and nurture greenspace, protect tree
canopy, protect natural habitats and provide connections to the nearby walking trails
Although popular as a wedding venue, the Inn does not have a restaurant or enough rooms to
generate the income needed to justify the continued operation of the facility and the maintenance
of the historic buildings and grounds. SREG proposes to maintain the existing Inn, cottage and barn
and augment the hospitality offerings with an approximately 5,000 SF conference space, new

restaurant/commercial use for both the overnight guests and neighbors within walking distance. In

Water System.
Water service to the proposed PZD exists in the form of an 8-inch water line that terminates near the
southwest corner of the Inn. It is supplied by an existing 1 million gallon water storage tank adjacent
WRWKHVLWHZKLFKKDVDQRYHUÁRZHOHYDWLRQRI7KHJURXQGHOHYDWLRQDWWKH3UDWW,QQDQG%DUQ
is approximately 1490, so existing static pressures are less than 40 psi. To overcome the lack of
pressure, the existing Inn and Barn are currently operating on a hydropneumatic booster system for
domestic water demands.
Some of the new PZD is of a higher ground elevation, so the static pressure plane created by the

plane that will serve all existing and future development on top of Markham Hill. The new pressure
plane will be at approximate elevation 1630 and the tank volume will be approximately 200,000 to

also adjacent to the existing tank. Interconnections with the 1577 pressure plane will be modulated

existing system will be evaluated to determine if downstream improvements are required.
Franchised Utilities.

The PZD will include sidewalks and multi-use trails to promote connectivity with nearby trail networks
and the adjacent and nearby neighborhoods. Types of trails and walkways proposed include
both impervious and pervious types, depending on which is most appropriate for the proposed
location. Connections to the nearby neighborhood to allow guests to walk or bike to the area will be
encouraged. The exact location of the sidewalk and multi-use trail network will be provided during the
Large Scale Development review process
Streetlights.
The location and type of streetlights will be determined during the Large Scale Development review
process in consultation with the City Planning Division. Efforts will be made to select lighting types that
provide adequate visibility while reducing spillage to adjacent properties.
Water.
SREG will work with the City of Fayetteville Water Department during the Large Scale Development
review process to determine the appropriate size and location of the water infrastructure to serve the
proposed uses.
