WHEREAS, PBS Properties, LLC has requested that the City share in the cost of constructing an 8-inch water main at
the southeast corner of West Cleveland Street and North Storer Avenue; and
WHEREAS, the newly constructed water main will replace and upsize a 6-inch diameter water main that was found to
conflict with plans to replace two single family structures with five attached 4-bedroom townhomes; and
WHEREAS, upsizing this water main to 8-inch diameter will allow development of the property, and will also provide
ample capacity for future developments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a cost share agreement in the
amount of $48,806.00 with PBS Properties, LLC for the construction of an 8-inch water main near the corner of West
Cleveland Street and North Storer Avenue.

SUBJECT: PBS Properties, LLC — Water Main Cost Share on Cleveland Street
RECOMMENDATION:
Staff recommends approval of a Cost Share Agreement with PBS Properties, LLC in an amount not to exceed
$48,806.00 for the construction of an 8-inch water main near the corner of Cleveland Street and North Storer
Avenue.
BACKGROUND:
Infill residential development is underway at the southeast corner of Cleveland St. and N. Storer Ave. This lot
originally contained two single-family structures, and now is being redeveloped with five attached 4-bedroom
townhomes. The developer, PBS Properties, LLC, has requested that the City share in the cost of constructing
the 8-inch water main necessary for this development and to have ample capacity for future developments.
DISCUSSION:
During construction, the existing 6-inch water main on Storer was found to conflict with the development plans.
The developer is relocating the water main along Storer and upsizing to an 8-inch water main for a distance of
approximately 160 linear feet. Three bids for the construction work have been obtained by the developer, and
the low bid received was $97,612.00.
Staff recommends a 50/50 cost share based on this low bid, with the City's obligation not to exceed
$48,806.00.
BUDGET/STAFF IMPACT:
Funds are available in the Water & Sewer Cost Sharing account within the Water & Sewer fund.

WATER MAIN INSTALLATION
COST SHARE AGREEMENT
This Agreement, made and entered into on this _____ day of September, 2026, by
and between the City of Fayetteville, Arkansas (“City”) and PBS Properties, LLC (“PBS
Properties”), witnesseth:
WHEREAS, PBS Properties, LLC has requested that the City share in the cost of
constructing an 8-inch water main near the southeast corner of Cleveland Street and North
Storer Avenue, a distance of approximately 160 linear feet, so that PBS Properties may
develop townhomes on properties located on Cleveland Street; and
WHEREAS, the current 6-inch water main serving the property on North Storer
Avenue was determined to be in conflict with the development, so it is necessary to relocate
the water main and upsize it to an 8-inch diameter; and
WHEREAS, constructing this segment of 8-inch water main will provide for ample
future capacity which the City recognizes will be necessary for the area that is served by
this water main.
NOW, THEREFORE, the City of Fayetteville, Arkansas and PBS Properties, LLC
agree as follows:
1.The City of Fayetteville, Arkansas agrees to:
A.Reimburse PBS Properties, LLC for 50.0% of the cost to install
approximately 160 linear feet of 8-inch water main in the area
identified in Exhibit “A” up to a maximum-not-to-exceed amount of
$48,806.00, as was estimated by the builder’s representatives and
shown on Exhibit “B”, attached.
B.Payments due to PBS Properties, LLC shall be remitted within sixty
(60)days after receipt of valid invoices.
2.PBS Properties, LLC agrees to:
A.Provide the necessary and normal project management, inspection,
and testing as necessary for a complete and acceptable water main
installation, including submittal of plans and specifications to the
City’s Engineering Department, per their standard procedures.

Dear Eddie,
I am pleased to offer my written quotation for the amount of NINTY-SEVEN THOUSAND SIX HUNDRED
TWELVE DOLLARS ($97,612.00) to install a new water main with meters at the above-mentioned
project. My quotation is based upon a site visit.
Included in this quotation are the following
Provide and install approximately 200’ of 8 water mains from the tapping valve to tapping valve
locations.
Provide and install 5 5/8” meter setters.
All cutting and patch of street included,
This quote is valid for 30 days from the date above.
Please note the following exclusions: landscaping, survey, domestic lines, density testing, erosion
control, sewer service lines, Grease trap, pipe bollards, Rock excavation that cannot be removed in a
timely manner by a rubber-tired backhoe.
