A RESOLUTION TO APPROVE AMENDMENT NO. 1 TO THE PROFESSIONAL ENGINEERING
SERVICES AGREEMENT WITH HAWKINS-WEIR ENGINEERS, INC. IN AN AMOUNT NOT TO
EXCEED $195,220.00 FOR ADDITIONAL SERVICES ASSOCIATED WITH THE NOLAND WATER
RESOURCE RECOVERY FACILITY PRIMARY SWITCHGEAR IMPROVEMENTS PROJECT.
WHEREAS, the primary electrical feed to the Noland Water Resource Recovery Facility (WRRF) has been identified
as a concern for reliability of keeping the plant in power continuously, primarily due to the arrangement of high-voltage
breakers and the WRRF’s tie in to both grid-power and standby generator power; and
WHEREAS, design and bidding are complete, and the project is ready to move into construction, and this amendment
provides for additional services including project administration, construction observation, engineering oversight, final
inspections and system start-up.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Rawn to sign
Amendment No. 1 with Hawkins-Weir Engineers, Inc. in an amount not to exceed $195,220.00 for additional services
associated with the Noland Water Resource Recovery Facility Primary Switchgear Improvements Project.

SUBJECT: Hawkins-Weir Engineers, Inc. - Amendment No. 1 for Noland WWTP Switchgear
RECOMMENDATION:
Staff recommends approval of Amendment No. 1 to the engineering services agreement with Hawkins-Weir
Engineers, Inc. for professional services associated with the Noland WRRF Primary Switchgear Improvements
Project in an amount not to exceed $195,220.00.
BACKGROUND:
The primary electrical feed to the Noland Water Resource Recovery Facility (WRRF) has been identified as a
concern for reliability of keeping the plant in-power continuously. This is primarily due to the arrangement of
high voltage breakers and the WRRF’s tie-in to both grid-power and standby generator power. Hawkins-Weir
Engineers was selected via RFQ# 24-01, Selection #8 to provide these professional services.
DISCUSSION:
The Noland WRRF Primary Switchgear Improvements Project began with a non-agenda agreement with
Hawkins-Weir in the amount of $19,900.00. Resolution 179-24 approved what the City referred to as
"Amendment No. 1" at the time, but it was actually a new agreement for Noland Switchgear engineering
services in the amount of $155,500.00 to bring the project to 100% design and bidding.
Design and bidding are complete, and the project is ready to move into construction. This proposed
amendment in the amount of $195,220.00 will be Amendment No. 1 to provide necessary funds for Hawkins-
Weir to be involved with project administration, construction observation, engineering oversight, final
inspections and system start-up.
Staff recommends approval of Amendment No. 1 to the engineering services agreement with Hawkins-Weir
Engineers, Inc. for professional services associated with the Noland WRRF Primary Switchgear Improvements
Project in an amount not to exceed $195,220.00.
BUDGET/STAFF IMPACT:
Funds are available in the WWTP Building Improvements account.

AMENDMENT NO. 1
TO THE
AGREEMENT For PROFESSIONAL ENGINEERING SERVICES
BETWEEN
CITY OF FAYETTEVILLE, ARKANSAS
AND
HAWKINS-WEIR ENGINEERS, INC.
In accordance with the AGREEMENT For PROFESSIONAL ENGINEERING SERVICES for the Noland
WWTP Switchgear Replacement (HW Project No. 2023055), dated July 2, 2024, between the City of
Fayetteville, Arkansas (hereinafter called Owner) and Hawkins-Weir Engineers, Inc. (hereinafter called
Engineer), Owner hereby authorizes Engineer to proceed with engineering services as modified by this
Amendment No. 1.
SECTION 1 – SCOPE OF SERVICES
1.1 Amendment No. 1 is for construction phase services for the Noland WWTP Switchgear
Replacement associated with Owner’s Project No. 26-30. Services are detailed in the Engineer’s attached
Scope of Services dated May 4, 2026.
SECTION 2 – TIME OF SERVICE
2.1 The scope of services as defined above is based on addressing the defined services within a 270-
calendar day construction Contract Time in 2026 for the Owner’s Project No. 26-30. Engineer will proceed
with providing the services set forth herein immediately upon execution of this Authorization by all parties.

SECTION 3 - COMPENSATION 3 .1 Owner shall compensate Engineer for providing the services set forth herein in accordance with the terms of the Agreement. Total payment for Scope of Services described herein shall not exceed One Hundred Ninety-Five Thousand Two Hundred Twenty and 00/100 Dollars ($195,220.00) without written approval of Owner. These additional services adjust the Agreement's not to exceed fee to $336,220.00,and adjusts the not to exceed reimbursable expenses to $14,500.00 for a total not to exceed fee of $350,720.00. Hawkins-Weir Engineers, Inc. (HW) proposes to provide the following construction phase
services for the Noland WWTP Switchgear Replacement project:
Task Description
D. Construction Phase – Noland WWTP Switchgear Replacement
1. Conduct Pre-Construction Conference with the Owner and Contractor
a. Field Survey to reestablish control monumentation
2. Provide periodic observation during construction(1)
3. Conduct up to two (2) progress meetings
4. Prepare, review, and coordinate the dissemination of construction documentation
including material submittals, testing results, field orders, and change orders as directed
by the Owner
5. Review the Contractor’s constructed quantities and prepare monthly pay requests for the
Owner’s approval
6. Conduct as-built surveys of completed improvements
7. Participate in Factory Witness Test at Caterpillar in Alpharetta, Georgia, coordinate and
assist with switchgear startup testing on site
8. Coordinate and conduct a final inspection with the Contractor and the Owner, and
prepare a punch list of deficient construction items for the Contractor to address
9. Prepare Record Drawings of the completed project and provide one (1) reproducible
hard copy and one (1) electronic copy for the Owner’s archives
(1) Based on a 270-calendar day Contract Time (240-calendar days until Substantial
Completion). Periodic construction observation is based on 8-hours per day
(Monday through Friday) during the construction of the below grade improvements
(assumed at 30-calendar days) and approximately 2-hours per day (Monday through
Friday) for the remaining site construction period (assumed 240-calendar days)
through Final Completion date for the Construction Observer.
