RECOMMENDATION: City Planning staff and the Planning Commission recommend approval of a request for lesser dedication of right-of-way as described and shown for associated lot splits in the attached Exhibits ‘A’ and ‘B’. BACKGROUND: The subject properties are in northwest Fayetteville and are part of the Magnolia Park subdivision, which borders the western side of N. Rupple Rd. and extends from W. Weir Rd. to the north to W. Dahlia to the south. The preliminary plat of Magnolia Park showing all planned phases of the subdivision was initially approved in 2019, and subsequently the concurrent plat of Phase V was approved in March of 2026. Request: The applicant requests a reduction in right-of-way dedication with an approved concurrent plat of Phase V of the Magnolia Parks subdivision to create 7 new lots. Public Comment: Staff has not received any public comment on this item. DISCUSSION: The preliminary plat of the Magnolia Parks subdivision was approved in 2019 (PPL 19-6526). Phases I & II received final plat approval in 2021 (FPL-2021-000011) and Phases III & IV were approved in 2025 (FPL-2025- 0010). The final phase was prepared as a Concurrent Plat instead of a standard final plat given the existence of required infrastructure and was approved on March 09, 2026 (CCP-2026-0001). Unified Development Code section 166.04(B)(4)(a)(i) indicates that an infrastructure improvement required with any subdivision of land is to dedicate sufficient right-of-way to meet the Master Street Plan. Where right- of-way dedication represents a hardship or practical difficulty, an applicant may petition the City Council, by way of the Planning Commission, for lesser dedication. For the subject property, right-of-way dedication to meet the Residential Link Street requirements of 52 feet, or 26 feet from centerline of the street is required. At the March 09, 2026 Planning Commission meeting, commissioners unanimously voted (7-0-2) to forward this item to City Council with a recommendation of approval. The item was included on the consent agenda, with Commissioner Madden making the motion, and Commissioner Castin seconding; Commissioner Cabe and Commissioner McGetrick recused from this item. The item had been placed on the consent agenda at the March 05, 2026 agenda session by the commissioners, and no further discussion was made. No public comment was heard on the item. Lierly Lane. The water line will be tapped for domestic water and fire service to the lots and the sewer line will be tapped for domestic sewer service to the lots. Drainage: The drainage for these lots was included in the recently approved Magnolia Park subdivision so no additional improvements are required. Street Improvements: The lots have W. Lierly Lane across their northern frontage which is an improved Residential Link with pavement, curb and gutter and sidewalk. On the east side of the lots, Rupple Road is an improved Regional Link with pavement, and curb and gutter and trail. Staff does not recommend any additional street improvements Right-of-way to be dedicated: W. Lierly Lane: W Lierly Ln is classified as a Residential Link Street in the 2040 Master Street Plan. Staff recommends right-of-way dedication along this street in the amount of 50 feet to align with the typical standards for that street classification. The applicant is proposing to dedicate 50 feet of right-of-way along this street. Tree Preservation: 20% for NS-G, Neighborhood Services – General. Per Mitigation Requirements, phases 3 to 5 call for a total of 520 2” caliper trees to be planted. Landscape Requirements lists 14 street trees and 52 lot trees for phase 5. RECOMMENDATION: Staff recommends approval of CCP-2026-0001 with the following conditions: Conditions of Approval: 1. Planning Commission determination of right-of-way dedication. Staff recommends that the Planning Commission support maintaining a 50-foot right-of-way dedication along W Lierly Lane and 53 feet from centerline along Rupple Road. As the current Master Street Plan requires 52 feet of right-of-way along W Lierly Lane (previously 50 feet), maintaining the 50-foot dedication would constitute a lesser dedication and would require consideration by the City Council pursuant to §166.04(B)(4)(a)(i). Should the Planning Commission support this approach, staff will prepare a City Council item for final consideration. 2. All lots shall be labeled with addresses as approved by the 911 Coordinator on the concurrent plat (if applicable). 3.
