AN ORDINANCE TO ALIGN DEVELOPMENT—RELATED USER FEES WITH THE COSTS OF

OUTDOOR VENDORS OF THE UNIFIED DEVELOPMENT CODE
WHEREAS, on February 21, 2023, City Council passed Resolution 39-23 approving a contract with MGT Consulting
for an updated user fee study that evaluated the city's fee structure, defined the cost of city services, and recommended
fees based on the cost of services; and
WHEREAS, on February 18, 2025, City Council passed Ordinances 6844, 6845, and 6846 approving a stepped user
fee implementation with approximately 1/3rd of the study’s proposed fees adopted annually beginning in 2025; and
WHEREAS, this proposed amendment will increase fees by 1/3rd of the user fee study recommended amount in both
2026 and 2027.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals subsection (A) of § 51.114 Water,
Sewer Tap Connection Fees and enacts a replacement § 51.114(A) as shown in Exhibit A attached hereto and made a
part hereof.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 94.10 Fees/Schedule in Chapter
94 Fire Prevention and enacts a replacement § 94.10 as shown in Exhibit A.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby repeals subsection (J) of § 110.03 Small
Cell Facilities and Networks and enacts a replacement § 110.03(J) as shown in Exhibit A.
Section 4: That the City Council of the City of Fayetteville, Arkansas hereby repeals the introductory paragraph of
subsection (C) Principal Permit in § 116.02 Door to Door Solicitation at Private Residence and enacts replacement
language as shown in Exhibit A.
Section 5: That the City Council of the City of Fayetteville, Arkansas hereby enacts § 116.02(C)(5) as shown in Exhibit
A.

SUBJECT: Continuing Alignment of Development-Related Fees with Service Costs
RECOMMENDATION:
City staff recommend approval of an amendment to Chapters 51, 94, 110, 116, 118, 157, 159, and 178 as
described in Exhibits 'A' and 'B' to align development-related user fees with the costs of associated services.
BACKGROUND:
Fayetteville's well-established history of charging user fees for City services can be traced to a the 1980s.
Formal fee studies subsequently completed in the 1990s and 200s recommended that the city implement fees,
particularly for development-related applications, that cover the costs of their associated services. These
recommendations were not fully implemented, with many fees remaining the same in 2024 as they were
adopted in 2004.
Recognizing an increasing divide between the cost of services and the fees paid for those services, City
Council approved a contract with MGT for an updated user fee study. The study evaluated the current fee
structure, defined the cost of city services, and, ultimately, recommended fees based on the cost of services.
All told, the divide between application fees and services was a subsidy of over $2,000,000. Given the marked
increase the study proposed to close this gap, staff recommended a stepped implementation, with
approximately 1/3rd of the study's proposed fees adopted annually beginning in 2025. City Council approved
the first step of this in February of 2025 alongside a resolution creating seven new development review-related
positions in the Engineering, Planning, Long-Range Planning, and Building Safety Divisions.
DISCUSSION:
The proposed amendment includes amendments to the following chapters of the Fayetteville Code of
Ordinances:
• Chapter 51, Water and Sewers
• Chapter 94, Fire Prevention
• Chapter 110, Telecommunication Franchise, Billposting, and Small Cell Facilities and Networks
• Chapter 116, Door To Door Solicitation At Private Residence
• Chapter 118, Business Registry and Licenses
• Chapter 157, Notification and Public Hearings
• Chapter 159, Fees
• Chapter 178, Outdoor Vendors

Fees proposed for amendment will increase by 1/3rd of the user fee study recommended amount in both 2026
and 2027. Additional changes include the following:
• Fees administered by the Fire Marshal (Chapter 94) will include a penalty for work without a permit
(tripled application fee with a minimum of $250.00) and a fee for re-inspection ($125.00)
• Renewal late fees for business licenses (Chapter 118) will decrease from $50.00 to $30.00
• Additional grading permit categories, Miscellaneous and Minor Utility Extension or Fireline, will be
formalized with associated fees ($150.00 and $400.00 for application and $50.00 and $150.00 for
resubmittal, respectively)
• An associated service fee for pilot over-the-counter and same-day permit programs will be adopted,
charging one and a half times the standard price
The 2026 and 2027 dates of these fee enactments will be determined by the date of City Council approval.

(A) All service connections made on city-owned water and sewer mains shall be made by the Water and Sewer

(B) Fees for connections where unusual field conditions exist shall be determined by the City Engineer. Unusual
field conditions would include but not be limited to the presence of rock, any state or U.S. Highway crossing,
extra thick concrete or asphalt paving, or conflicts with other utilities. The City Engineer may also modify the
stated fees if there are a number of taps to be made in the same location, or if a plumber or other contractor
is allowed to do the excavation.

(C) Supplementary Permit Fees:
(i) Work Without a Permit. Where work for which a permit is required is started or proceeded prior to
obtaining said permit, the fees specified herein shall be tripled with a minimum penalty of $250.00.
Payment of such fee shall not relieve any persons from fully complying with the requirement of any
standard or code in the execution of the work or activity not from any other applicable penalties.
(ii) Re-Inspection. For a re-inspection to correct a violation(s) and/or if installation is not ready for requested
inspections the fee shall be $125.00. All re-inspect fees must be paid prior to the inspection taking
place.

110.03 Small Cell Facilities and Networks

(J) Application Fees and Annual Rates.
(1) Fees. Fees shall be imposed, as set forth below, to cover a portion of the cost incurred in connection
with processing applications, plan reviews, amendments, permits, acceptance inspections and other
matters pertaining to small wireless facilities:

(2) Applicants shall pay a fee of $150.00 for each small wireless facility that does not pass an initial
inspection and requires re-inspection. This fee ensures the city shall recover its costs associated with
administering and conducting a reinspection.
(3) A provider who attaches a small wireless facility to a city pole or other structure without proper
authority shall pay a fee of $480.00 per year. This fee is in addition to any penalty that may be assigned
or adjudicated for violation of a city ordinance. This fee ensures that the City shall recover its costs
associated with locating and remediating unauthorized attachments.
(4) A provider shall pay $10.00 per day for each small wireless facility that is attached to a city facility in
violation of a permit or an applicable code for more than thirty (30) days after notice of the violation.
This fee ensures that the city shall recover its costs associated with locating and remediating specific
permit violations.
(5) Refunds. No fees and charges specified in this section sha ll be refunded on account of any
relinquishment or abandonment of a permit granted under this regulation.
(6) Late Charges. If city does not receive payment for any amount owed within sixty (60) calendar days
after it becomes due, wireless providers shall pay a late processing charge equal to 5% of the amount
owed. In addition to assessing a late processing charge, if any fees or charges remain unpaid for a
period exceeding ninety (90) days: (1) wireless providers shall be charged interest at the rate of 10%
per year on the amount owed; (2) city may discontinue the processing of applications for new small
wireless facilities and/or poles until such fees or charges are paid: and (3) city may cause the
disconnection of electric service from wireless provider's small wireless facilities at wireless provider's
expense.

116.02 Door To Door Solicitation At Private Residence

(C) Principal Permit. No peddling or solicitation shall be conducted within the city without a principal permit
being issued. The permit shall expire on December 31 in the year the permit is issued. In addition to the
principal's permit, the principal must also comply with the city's business license requirement pursuant to
Chapter 118: Business Registry and License of the Fayetteville Code. To obtain a permit, a representative of
the principal shall provide the required fee and a written, signed application stating:

(5) The cost for the principal to obtain a solicitor/peddler’s permit shall be paid to the business office
before any peddling or soliciting is conducted within the city.

159.01 Fees/Schedule
(A) Fees. Fees shall be imposed, as set forth below, to cover a portion of the cost of public notices and such
other expenses as may be incurred in connection with processing of applications, plan reviews, amendments,
permits, variances and other matters pertaining to the UDC.
A councilmember may present a resolution to the City Council to waive or reduce development permit fees
otherwise required by this chapter or elsewhere within the Unified Development Code, where it is permitted. If
the reduction or waiver would serve the public interest, alleviate an unfair burden upon an applicant, or be
beneficial to the city as a whole, the City Council may grant such reduction or waiver of permit fee.

(b) Permit Valuation.
(i) Permit valuation is the reasonable valuation of all services, labor, materials, and appliances
or devices entering into and necessary to the prosecution and completion of the work
ready for occupancy.
(ii) The permit valuation shall include total cost such as plumbing, electrical, gas, mechanical,
equipment, and other systems, however, the cost of excavation or grading, paving, and
land cost are not deemed a part of such permit valuation.
(iii) The building permit fee shall be based on the construction valuation as determined by the
published Building Code Fee Schedule or as submitted by the applicant, whichever is
greater.
(c) Building Construction. Building construction fees shall be as set forth in the Building Code, fees

(d) The Building Official shall administer the collection and reporting of fees as required herein. In
the event of whether a fee should be charged or not, the Building Official shall make the final

(ii) Emergency, Investigative and After Hour(s). In addition to the permit fee, an emergency fee
for after hours inspection, investigations and emergency inspections shall be $300.00 and
an additional $100.00 per hour after two (2) hours.
(iii) Outside City Limits. In addition to the permit fee, each inspection required outside
Fayetteville city limits shall be $20.00 per inspection.
(iv) Work Without Permit. Where work for which a permit is required is started or proceeded
prior to obtaining said permit, the fees herein specified shall be tripled, with a minimum
penalty of $250.00. Payment of such triple fee shall not relieve any persons from fully
complying with the requirement of any code in the execution of the work nor from any
other applicable penalties.
(v) Re-Inspection. For a re-inspection to correct a violation(s) and/or if installation is not ready
for requested inspections the fee shall be $125.00. All re-inspect fees must be paid prior to
the inspection taking place.
(vi) Over-the-Counter/Same-Day Permit. For permits eligible for Over-the-Counter or Same-
Day permitting, the fees herein shall be increased by one and a half.
(f) Exemptions from Permit Fees.
(i) Historical Buildings.
(a) Buildings identified and classified as historical buildings or structures by state or
local jurisdiction shall be exempt from permit fees.
(b) The Mayor may exempt all or part of the applicable permit fees for buildings
that can be proven to be more than fifty (50) years old. This exemption shall
apply only to owner-occupied, single-family dwellings where there is to be no
change of use or occupancy.
(ii) Affordable Housing and Homeless Shelters. Construction of single-family, non-profit multi-
family supportive housing, and homeless shelters funded wholly or primarily by federal
Community Development Block Grants, non-profit service organizations such as Habitat for
Humanity, Housing and Urban Development housing loans and similar programs designed
to provide affordable, owner-occupied, single-family residences to low income individuals,
non-profit multi-family supportive housing, and homeless shelters shall be exempted from
payment of building permit fees.
(iii) City-Owned Facilities. Construction projects that occur on city-owned properties for
facilities that are partially or wholly owned by the city shall be exempted from payment of
building permit fees.
(12) Temporary Closure Permits. The following application and use fees are due for each of the following
requests for closure:
(a) Application Fees. An application fee shall be due at that time of any request for temporary,
street/road closure, partial street/lane closure, parking closure, trail closure, or sidewalk closure.

(J) Application Fees and Annual Rates.
(1) Applicants shall submit a fee in the amount of $167.00 for each small wireless facility proposed to be
installed on an existing wireless support structure or pole.
(2) Applicants shall submit a fee in the amount of $267.00 for the installation, modification, or
replacement of a pole together with the collocation of an associated small wireless facility in the right -
of-way.
(3) Providers shall pay an annual rate of $70.00 per small wireless facility for use of the public right -of-way.
(4) Providers shall pay an annual rate of $150.00 per small wireless facility that is collocated on a city -
owned pole.

(5)(2) Applicants shall pay a fee of $150.00 for each small wireless facility that does not pass an initial
inspection and requires re-inspection. This fee ensures the city shall recover its costs associated with
administering and conducting a reinspection.
(6)(3) A provider who attaches a small wireless facility to a city pole or other structure without proper
authority shall pay a fee of $480.00 per year. This fee is in addition to any penalty that may be assigned
or adjudicated for violation of a city ordinance. This fee ensures that the City shall recover its costs
associated with locating and remediating unauthorized attachments.
(7)(4) A provider shall pay $10.00 per day for each small wireless facility that is attached to a city facility in
violation of a permit or an applicable code for more than thirty (30) days after notice of the violation.
This fee ensures that the city shall recover its costs associated with locating and remediating specific
permit violations.
(8)(5) Refunds. No fees and charges specified in this section shall be refunded on account of any
relinquishment or abandonment of a permit granted under this regulation.
(9)(6) Late Charges. If city does not receive payment for any amount owed within sixty (60) calendar days
after it becomes due, wireless providers shall pay a late processing charge equal to 5% of the amount
owed. In addition to assessing a late processing charge, if any fees or charges remain unpaid for a

period exceeding ninety (90) days: (1) wireless providers shall be charged interest at the rate of 10%

disconnection of electric service from wireless provider's small wireless facilities at wireless provider's
expense.

(C) Principal Permit. No peddling or solicitation shall be conducted within the city without a principal permit
being issued. The cost for the principal to obtain a solicitor/peddler's permit is $77.00, and shall be paid to

159.01 Fees/Schedule
(A) Fees. Fees shall be imposed, as set forth below, to cover a portion of the cost of public notices and such
other expenses as may be incurred in connection with processing of applications, plan reviews, amendments,
permits, variances and other matters pertaining to the UDC.
A councilmember may present a resolution to the City Council to waive or reduce development permit fees
otherwise required by this chapter or elsewhere within the Unified Development Code, where it is permitted. If
the reduction or waiver would serve the public interest, alleviate an unfair burden upon an applicant, or be
beneficial to the city as a whole, the City Council may grant such reduction or waiver of permit fee.
(B) Fee Schedule.

(b) Supplementary Permit Fees:
(i) Work Without a Permit. Where work for which a grading permit is required is started or
proceeded prior to obtaining said permit, the fees specified herein shall be doubled.
Payment of such fee shall not relieve any persons from fully complying with the
requirement of any code in the execution of the work not from any other applicable
penalties.
(ii) Re-Inspection. For a re-inspection to correct a violation(s) and/or if installation is not ready
for requested inspections the fee shall be $25.00. For each subsequent re-inspection, the
fee shall be double the amount of the previous fee, with a maximum of $200.00. All re -
inspect fees must be paid prior to the inspection taking place.

(11) Building Permits.
(a) General Fees. The following general provisions shall apply to all permits, including but not limited
to building, electrical, gas, mechanical and plumbing; and shall apply in addition to the fees and
requirements set forth in each separate code.
(b) Permit Valuation.
(i) Permit valuation is the reasonable valuation of all services, labor, materials, and appliances
or devices entering into and necessary to the prosecution and completion of the work
ready for occupancy.
(ii) The permit valuation shall include total cost such as plumbing, electrical, gas, mechanical,
equipment, and other systems, however, the cost of excavation or grading, paving, and
land cost are not deemed a part of such permit valuation.
(iii) The building permit fee shall be based on the construction valuation as determined by the
published Building Code Fee Schedule or as submitted by the applicant, whichever is
greater.
(c) Building Construction. Building construction fees shall be as set forth in the Building Code, fees
appendix, except as set forth below:

(i) Design/Build Fee. In addition to the permit fees, a design/build fee for fast-track,
design/build, and buildings permitted with construction progressing as design and
construction plans are in progress shall be paid. $1,200.00.

(ii) Emergency, Investigative and After Hour(s). In addition to the permit fee, an emergency fee
for after hours inspection, investigations and emergency inspections shall be $300.00 and
an additional $100.00 per hour after two (2) hours.
(iii) Outside City Limits. In addition to the permit fee, each inspection required outside
Fayetteville city limits shall be $20.00 per inspection.
(iv) Work Without Permit. Where work for which a permit is required is started or proceeded
prior to obtaining said permit, the fees herein specified shall be tripled, with a minimum
penalty of $250.00. Payment of such triple fee shall not relieve any persons from fully
complying with the requirement of any code in the execution of the work nor from any
other applicable penalties.
(v) Re-Inspection. For a re-inspection to correct a violation(s) and/or if installation is not ready
for requested inspections the fee shall be $125.00. All re-inspect fees must be paid prior to
the inspection taking place.
(vi) Over-the-Counter/Same-Day Permit. For permits eligible for Over-the-Counter or Same-
Day permitting, the fees herein shall be increased by one and a half.
(f) Exemptions from Permit Fees.
(i) Historical Buildings.
(a) Buildings identified and classified as historical buildings or structures by state or
local jurisdiction shall be exempt from permit fees.
(b) The Mayor may exempt all or part of the applicable permit fees for buildings
that can be proven to be more than fifty (50) years old. This exemption shall
apply only to owner-occupied, single-family dwellings where there is to be no
change of use or occupancy.
(ii) Affordable Housing and Homeless Shelters. Construction of single-family, non-profit multi-
family supportive housing, and homeless shelters funded wholly or primarily by federal
Community Development Block Grants, non-profit service organizations such as Habitat for
Humanity, Housing and Urban Development housing loans and similar programs designed
to provide affordable, owner-occupied, single-family residences to low income individuals,
non-profit multi-family supportive housing, and homeless shelters shall be exempted from
payment of building permit fees.
(iii) City-Owned Facilities. Construction projects that occur on city-owned properties for
facilities that are partially or wholly owned by the city shall be exempted from payment of
building permit fees.
(12) Temporary Closure Permits. The following application and use fees are due for each of the following
requests for closure:
(a) Application Fees. An $50.00 application fee shall be due at that time of any request for
temporary, street/road closure, partial street/lane closure, parking closure, trail closure, or
sidewalk closure.

(b) Closure Fees. Due to the impact of closures on functionality of streets, sidewalks and trails, the
following use fees shall apply based on the type, length and duration of closure requested:
