NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals subsection (A) of § 51.114 Water, Sewer Tap Connection Fees and enacts a replacement § 51.114(A) as shown in Exhibit A attached hereto and made a part hereof. Section 2: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 94.10 Fees/Schedule in Chapter 94 Fire Prevention and enacts a replacement § 94.10 as shown in Exhibit A. Section 3: That the City Council of the City of Fayetteville, Arkansas hereby repeals subsection (J) of § 110.03 Small Cell Facilities and Networks and enacts a replacement § 110.03(J) as shown in Exhibit A. BACKGROUND: Fayetteville's well-established history of charging user fees for City services can be traced to a the 1980s. Formal fee studies subsequently completed in the 1990s and 200s recommended that the city implement fees, particularly for development-related applications, that cover the costs of their associated services. These recommendations were not fully implemented, with many fees remaining the same in 2024 as they were adopted in 2004. Recognizing an increasing divide between the cost of services and the fees paid for those services, City Council approved a contract with MGT for an updated user fee study. The study evaluated the current fee structure, defined the cost of city services, and, ultimately, recommended fees based on the cost of services. All told, the divide between application fees and services was a subsidy of over $2,000,000. Given the marked increase the study proposed to close this gap, staff recommended a stepped implementation, with approximately 1/3rd of the study's proposed fees adopted annually beginning in 2025. City Council approved the first step of this in February of 2025 alongside a resolution creating seven new development review-related positions in the Engineering, Planning, Long-Range Planning, and Building Safety Divisions. DISCUSSION: The proposed amendment includes amendments to the following chapters of the Fayetteville Code of Ordinances: • Chapter 51, Water and Sewers • Chapter 94, Fire Prevention • Chapter 110, Telecommunication Franchise, Billposting, and Small Cell Facilities and Networks • Chapter 116, Door To Door Solicitation At Private Residence • Chapter 118, Business Registry and Licenses • Chapter 157, Notification and Public Hearings • Chapter 159, Fees • Chapter 178, Outdoor Vendors Mailing address: 113 W. Additional changes include the following: • Fees administered by the Fire Marshal (Chapter 94) will include a penalty for work without a permit (tripled application fee with a minimum of $250.00) and a fee for re-inspection ($125.00) • Renewal late fees for business licenses (Chapter 118) will decrease from $50.00 to $30.00 • Additional grading permit categories, Miscellaneous and Minor Utility Extension or Fireline, will be formalized with associated fees ($150.00 and $400.00 for application and $50.00 and $150.00 for resubmittal, respectively) • An associated service fee for pilot over-the-counter and same-day permit programs will be adopted, charging one and a half times the standard price The 2026 and 2027 dates of these fee enactments will be determined by the date of City Council approval. (4) A provider shall pay $10.00 per day for each small wireless facility that is attached to a city facility in violation of a permit or an applicable code for more than thirty (30) days after notice of the violation. This fee ensures that the city shall recover its costs associated with locating and remediating specific permit violations. (5) Refunds. No fees and charges specified in this section sha ll be refunded on account of any relinquishment or abandonment of a permit granted under this regulation. (6) Late Charges. If city does not receive payment for any amount owed within sixty (60) calendar days after it becomes due, wireless providers shall pay a late processing charge equal to 5% of the amount owed. In addition to assessing a late processing charge, if any fees or charges remain unpaid for a period exceeding ninety (90) days: (1) wireless providers shall be charged interest at the rate of 10% per year on the amount owed; (2) city may discontinue the processing of applications for new small wireless facilities and/or poles until such fees or charges are paid: and (3) city may cause the disconnection of electric service from wireless provider's small wireless facilities at wireless provider's expense. … (Ord. (b) The Mayor may exempt all or part of the applicable permit fees for buildings that can be proven to be more than fifty (50) years old. This exemption shall apply only to owner-occupied, single-family dwellings where there is to be no change of use or occupancy. (ii) Affordable Housing and Homeless Shelters. Construction of single-family, non-profit multi- family supportive housing, and homeless shelters funded wholly or primarily by federal Community Development Block Grants, non-profit service organizations such as Habitat for Humanity, Housing and Urban Development housing loans and similar programs designed to provide affordable, owner-occupied, single-family residences to low income individuals, non-profit multi-family supportive housing, and homeless shelters shall be exempted from payment of building permit fees. (iii) City-Owned Facilities. Construction projects that occur on city-owned properties for facilities that are partially or wholly owned by the city shall be exempted from payment of building permit fees.
